Case No. PB 21-05 Ferncliff Cemetery, 280 Secor Road (P.O. Hartsdale, N.Y.) – Planning Board Steep Slope Permit
A work session to discuss the decision of a Planning Board steep slope permit application involving the proposed development of a portion of the Ferncliff Cemetery to install underground concrete vaults, with related improvements. The applicant is proposing the construction of various crypts and burial vaults on previously undeveloped cemetery land, with related retaining walls and landscaping. The applicant proposes approximately 12,928 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 2,255 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 1,118 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). On July 27, 2021, the Town Board issued a resolution approving an amended site plan and tree removal permit application associated with the project (TB 21-07). Te project involves the removal of 48 regulated trees and has prepared a landscaping plan providing for the planting of 15 trees, 1,362 shrubs, and various groundcovers, as replacement. An additional 21 shrub plantings are proposed to screen adjacent properties. The property consists of approximately 2,765,189 sq. ft. (63.48 acres) and is situated along the north side of Secor Road. The property is located in the R-30 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.171-123-1.

Case No. PB 20-17 Housing Action Council, 112 North Lawn Avenue (also fronting on Evarts Avenue) (P.O. Elmsford, N.Y.) – Final Subdivsion and Tree Removal Permit
A work session to discuss the decision of a final subdivision and tree removal permit application for a proposal consisting of the subdivision of one existing lot into two (2) buildable lots for the purpose of constructing two (2) new single family affordable housing residences, with related improvements. The applicant is proposing the construction of two (2) new 2-story residences with stone patios on lots proposed to be 7,956 sq. ft. (0.18 acres) and 8,055 (0.19 acres) in area. The applicant proposes both driveways to have curb cuts on Evarts Avenue. The applicant proposes approximately 2,897 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 152 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 25 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 900 cubic yards of excavation. The applicant proposes the removal of two (2) regulated trees in connection with the project, requiring a tree removal permit from the Planning Board, and proposes the planting of 15 trees, as replacement. The property consists of approximately 16,011 sq. ft. (0.37 acres) and is situated along the east side of North Lawn Avenue, approximately 250 feet south of the intersection of North Lawn Avenue and Payne Street. The property also fronts on Evarts Avenue, approximately 250 feet south of the intersection of Evarts Avenue and Payne Street. The property is located in the R-5 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.190-80-10.

Case No. PB 21-04 Regeneron, 777 Old Saw Mill River Road (P.O. Tarrytown, N.Y.) – Planning Board Steep Slope Permit & Wetland/Watercourse Permit
A work session to discuss the decision of a Planning Board steep slope permit & wetland/watercourse permit application involving the proposed construction of a 2-story, 207,940 sq. ft. Research & Development (R&D) building and structured parking facility within an existing R&D Campus, with related improvements. The proposal includes the demolition of existing parking areas and other site features. The location of the project was the subject of prior amended site plan (TB 14-05) and related approvals (PB 14-16) for a differently configured building and parking layout, which was never constructed. The Applicant no longer seeks to construct per the prior approvals, based on its updated needs for the site. The applicant proposes a total disturbance area of 500,940 sq. ft. (11.55 acres) as part of the project. The applicant proposes approximately 29,064 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 9,764 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 3,137 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes disturbing approximately 87,987 sq. ft. of wetland/watercourse buffer area, of the 957,355 sq. ft. of total wetland/watercourse and buffer area on the property. The project also requires amended site plan and tree removal permits from the Town Board (TB 21-06). The applicant proposes the removal of 152 regulated trees and has prepared a preliminary landscaping plan identifying replacement trees, shrubs, and groundcovers. The project also requires area variances from the Zoning Board of Appeals. The property consists of approximately 2,859,367 sq. ft. (65.64 acres) and is situated along the south side of Old Saw Mill River Road, approximately 500 feet west of the intersection of Saw Mill River Road and Old Saw Mill River Road. The property is located in the OB Office Building Zoning District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.71-6-1..1. This matter is being reviewed in conjunction with Case No. TB 21-10/PB 21-09, described below, which would provide a temporary staging and parking area on adjacent property during the construction of this project.

Case No. PB 21-09 Regeneron, 555 Saw Mill River Road (P.O. Tarrytown, N.Y.) – Planning Board Steep Slope Permit & Wetland/Watercourse Permit
A work session to discuss the decision of a Planning Board steep slope permit & wetland/watercourse permit application involving the proposed development of a temporary area for construction staging and construction employee parking, to facilitate the construction of a new two-story research and development building on the neighboring lot, 777 Old Saw Mill River Road, which is being applied for as Case No. TB 21-06/PB 21-04. The applicant is proposing to develop a portion of the property for use as construction staging and construction employee parking for a period of approximately 5 years, after which the construction staging and parking areas would be removed and the area replanted. The applicant proposes a total disturbance area of 264,845 sq. ft. (6.08) acres as part of the project. The applicant proposes approximately 28,911 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 10,555 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 14,940 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes disturbing approximately 12,718 sq. ft. of wetland/watercourse buffer area, of the 551,837 sq. ft. of total wetland/watercourse and buffer area on the property. The applicant proposes the removal of 129 regulated trees, requiring a tree removal permit from the Town Board, and has noted that, once this temporary area no longer is needed, it will be restored with trees, shrubs, and groundcovers. The project also requires an area variance from the Zoning Board of Appeals. The property consists of approximately 1,735,153 sq. ft. (39.8 acres) ) and is situated along the south side of Old Saw Mill River Road, approximately 500 feet west of the intersection of Saw Mill River Road and Old Saw Mill River Road. The property is located in the PED Planned Economic Development District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.71-6-2.2.

Case No. PB 21-10 Parashis, 23 Springwood Avenue (P.O. Ardsley, N.Y.) – Planning Board Steep Slope Permit
A continuation of a work session (August 4, 2021) to discuss a Planning Board steep slope permit application involving the proposed construction of a two-car garage, as well as front and rear additions to the home. The applicants propose to demolish retaining walls and staircases at the front of the house and construct a new two-car garage, a new stairway up to the house with planters, an extended front entrance to the house, and a retaining wall. The applicants currently do not have a driveway. The applicants propose to construct a three-season room/enclosed deck in the rear of the house. The applicants additionally propose to replace their roof to support 17kW solar panels. The applicants propose approximately 567 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 734 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 331 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 178 cubic yards of excavation. The applicants propose the addition of two (2) new drywell units to handle the runoff created by impervious surfaces. The following five (5) area variances are required: (1) front setback to principal building from 20 feet required to 17.5 feet proposed; (2) accessory structure setback to principal building from 10 feet required to 3.666 feet proposed; (3) accessory structure setback to side yard from 10 feet required to 0 feet proposed; (4) accessory structure coverage from 6% permitted to 6.4% proposed, and; (5) accessory structure in a front yard. The property consists of approximately 7,500 sq. ft. (0.17 acres) and is situated along the west side of Springwood Avenue, approximately 700 feet from the intersection of Springwood Avenue and Riverview Avenue. The property is located in the R-7.5 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.320-238-13.
 
5.   ITEMS FOR PUBLIC HEARING & PUBLIC DISCUSSION
The Planning Board is a group of volunteers appointed by the Town Board to evaluate land use applications in accordance with the Town Code. When property owners seek to develop their land or make improvements via subdivision, or if they will be disturbing an area with a regulated steep slope or within a wetland, watercourse or adjacent buffer area, they must apply to the Planning Board for approval. It is the job of the Planning Board to balance the rights of land owners while ensuring adverse impacts to the surrounding community are minimized. Decisions on adjustments to the proposed plan are based on factual evidence and reviewed for consistency with our Town code and Comprehensive Plan. This evidence primarily comes from applicants and their advisors, site visits conducted by Planning Board members, and input from Town staff, the appropriate Fire District, and the public as part of the public hearing process. The relative popularity of an application is not a factor in Planning Board decisions. Decisions are based on the facts presented.

Case No. PB 19-26 Kaufmann, 36 Hillcrest Avenue (P.O. Ardsley, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, and Tree Removal Permit
A public hearing to discuss a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application for a proposal consisting of the subdivision of 3 existing tax lots (8.320-238-10, 8.320-238-11 & 8.320-238-9..L6) into two buildable lots to allow the construction of one new single family home. The applicant proposes approximately 1,891 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 4,985 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 4,283 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project involves approximately 70 cubic yards of excavation and 0 cubic yards of imported fill. The applicant proposes the removal of 24 regulated trees and proposes the planting of 18 new trees and 9 new shrubs, as replacement. On June 17, 2021, the Zoning Board of Appeals granted an area variance related to the newly proposed lot not having frontage onto a roadway built to Town standards. The properties consist of approximately 23,334 sq. ft. (0.54 acres) and are situated on the east side of Hillcrest Avenue approximately 350 ft. north of the intersection of Larchmont Street and Hillcrest Avenue. The properties are located in the R-7.5 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.320-238-10, 8.320-238-11 & 8.320-238-9..L6.

a.  


Case No. PB 21-11 Grolier, 6 Chauncey Circle (P.O. Ardsley, N.Y.) – Planning Board Steep Slope Permit
A work session to discuss a Planning Board steep slope permit application involving the proposed construction of an in-ground pool and patio area, on an existing single-family residential property. The applicant proposes approximately 1,376 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES) and approximately 107 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES). The applicant is proposing the addition of a 3 foot by 5 foot rip rap level spreader to handle runoff created by new impervious surfaces. The property consists of approximately 41,382 sq. ft. (0.95 acres) and is situated along the west side of the cul-de-sac on Chauncey Circle. The property is located in the R-40 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.380-271-4.2.

Case No. PB 20-24 Bloom Energy, 151 Fulton Street (P.O. White Plains, N.Y.) – Planning Board Amended Site Plan
A work session to discuss a Planning Board amended site plan application involving the proposed installation of six (6) outdoor natural gas clean fuel cell energy servers. The applicant is proposing the installation of six (6) energy servers to provide approximately 1,500 kW of base load power to the site. The installation would have a footprint of approximately 2,450 sq. ft. and be surrounded by bollards, and located within an existing parking lot. The project requires the removal of 14 of the existing 30 off-street parking spaces. The applicant has proposed the addition of 13 off-street parking spaces to compensate, resulting in 29 parking spaces, where 29 are required. The applicant has added a gravel service area around the servers to offset the additional impervious surfaces from the parking spaces. The project has been reviewed by the Town Building Inspector, and the following area variance is required: accessory structure proposed within the front yard. The properties consist of approximately 53,578 sq. ft. (1.23 acres) and are situated on the northern side of the intersection of Fulton Street and Russell Street. The properties are located in the IB Intermediate Business District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.80-42-1 & 2.
