I APPRECIATE THE OPPORTUNITY TO ADJUST THE BOARD, UH, TODAY ABOUT SPRINGWOOD AVENUE ARE THE CONDITION OF THE ROAD AND THE CONCERNS THAT WE HAVE AS, UH, AS RESIDENTS ALONG THE ROAD. THE ROAD'S BEEN CALLED A PAPER SHEET, BUT FOR US, IT'S, IT'S THE ROAD HOME. SO THIS IS AN IMPORTANT ISSUE TO, UH, ALL THE PEOPLE WHO ARE JOINING ME ON THE CALL TODAY. IF IT'S OKAY, I'D LIKE TO SHARE MY, UH, SCREEN FOR A MINUTE. IT'S FINE. UM, AND WALK THROUGH SOME OF THE SLIDES. I UNDERSTAND THAT THE, UM, BOARD HAS RECEIVED COPIES OF THESE SLIDES, UH, SO I WON'T GO THROUGH THEM, UH, BIT BY BIT, BUT I DO WANT TO TOUCH ON A COUPLE OF IMPORTANT POINTS. AND THE FIRST WAS THE MAP THAT WAS INCLUDED ON PAGE FOUR, WHICH IS ON RECORD WITH THE COUNTY OF WESTCHESTER. UH, THIS MAP GOES BACK TO 1894. THIS IS A SUBDIVISION MAP, WHICH CLEARLY SHOWS THE EXISTENCE OF SPRINGWOOD AVENUE AT THAT TIME, ALONG WITH BLUECREST, EUCLID, RIVERVIEW, AND THE OTHER STREETS THAT ARE IN THE VICINITY OF, OF, UH, OF THAT, OF OUR ROAD. SPRINGWOOD AVENUE IS ALSO SHOWN ON THE 1925 MAP. UM, THESE THREE LOTS, 39, 40, 41 ARE THE LOTS ON WHICH MY HOUSE IS ON. I LIVE AT 25 SPRINGWOOD, LIVED THERE FOR 25 YEARS. ONE OF THE IMPORTANT THINGS THAT I WANNA MAKE SURE THE BOARD IS AWARE OF IN THIS IS THE INCLUSION OF SPRINGWOOD AVENUE AND THE DATABASE BY THE DEPARTMENT OF TRANSPORTATION, NEW YORK STATE'S DEPARTMENT OF TRANSPORTATION. THAT INCLUDES ALL THE PUBLIC ROADWAYS IN NEW YORK STATE. THERE ARE ACTUALLY 663 ROADS IN GREENBURG THAT ARE INCLUDED IN THIS DATABASE. AND THIS DATABASE IS GOVERNED BY AN INVENTORY MANUAL, WHICH I'LL TALK A LITTLE BIT MORE ABOUT IN A MINUTE, WHICH WAS UPDATED IN 2018. AND THE IMPORTANT POINTS OF THIS ARE THE ROADS IN THE DATABASE ARE USED FOR TOWN FUNDING FROM A PROGRAM CALLED THE CONSOLIDATED LOCAL STREETS AND HIGHWAY IMPROVEMENT PROGRAM OR SHIPS. SO THE INCLUSION OF SPRINGWOOD AVENUE IN THIS DATABASE ACTUALLY RESULTS IN A FINANCIAL BENEFIT TO THE TOWN OF GREENBURG BECAUSE WE SEE FUNDING BASED ON, UM, THE FUNDING DISTRIBUTION FORMULA, WHICH IS BASED ON ALL OF THE ROADS THAT ARE IN THE DATABASE, UH, FOR THE TOWN. IN ORDER TO BE IN THE DATABASE, THE TOWN HAS TO ACCEPT FULL CAPITAL RESPONSIBILITY FOR THE ROADS, ALSO HAS TO ACCEPT FULL LIABILITY FOR THE ROAD. AND THE LISTS ARE REVIEWED ANNUALLY, UH, BY THE TOWN AND BY ALL OF THE POLITICAL SUBDIVISIONS THAT, UH, ROADS ARE IDENTIFIED HERE. AND THERE'S A G I S, UH, SYSTEM ON THE, UM, ON, ON THE, ON THE WEB, ON THE INTERNET THAT YOU CAN FIND CALLED THE ROADWAY INVENTORY SYSTEM. AND I WANNA LOOK AT THAT IN A MINUTE FOR YOU ALSO. SO THIS IS AN EXCERPT FROM THE, UM, FROM THE LOCAL HIGHWAY INVENTORY MANUAL, PAGE THREE, WHICH STATES THAT THE TOWN BY INCLUDING A ROAD IN THAT DATABASE, HAS TO ACCEPT FULL LEGAL AND MAINTENANCE RESPONSIBILITY FOR THE ROAD MAINTENANCE RESPONSIBILITY DEFINED ON PAGE FOUR OF THE DOCUMENT. AND IT INCLUDES THE CONSTRUCTION RECONSTRUCTION AND RESPONSIBILITY FOR CAPITAL MAINTENANCE OF THE PAVEMENT OF ROADS THAT ARE INCLUDED IN THE DATABASE. THIS IS FROM PAGE TWO OF THE DOCUMENT, WHICH DESCRIBES THE ANNUAL PROCESS THAT THE STATE GOES THROUGH TO VERIFY THE DATE, THE DATABASE. NOW, THERE ARE PUBLIC DATABASES FOR 2017 ON, ON THE INTERNET, AND 2021 SPRINGWOOD IS INCLUDED IN BOTH OF THOSE DATABASES, THE PORTION IN THE TOWN OF GREENBURG. AND THERE'S A FORM MONTH PERIOD WITH WHICH THE TOWN HAS TO REVIEW THOSE, UM, 663 ROADS THAT ARE IN THE, IN THE DATABASE TO MAKE ANY CHANGES. AND FOR FIVE YEARS, THE TOWN HAS NOT MADE ANY CHANGES. SO, IN ADDITION TO WHAT I TALKED ABOUT REGARDING FUNDING, UM, IT'S IMPORTANT TO NOTE, AND THIS IS THE PAGE ACTUALLY THAT SPRINGWOOD AVENUE, UH, APPEARS ON IN THE DATABASE ITSELF UNDER THE TOWN OF GREENBURG COUNTY OF WESTCHESTER, AS A, AS A ROAD THAT [00:05:01] IS A PUBLIC ROAD, WHICH THE TOWN HAS RESPONSIBILITY FOR. THIS IS A SNAPSHOT OF THE G I S I PUT THIS UP HERE FOR SEVERAL REASONS. FIRST, I WANT TO NOTE THAT HALF OF THE, UH, STREET OF SPRINGWOOD IS IN THE TOWN OF GREENBURG. THAT'S THE GREEN PORTION. AND THE PURPLE PORTION IS IN THE TOWN OF, OF, IN THE VILLAGE OF ARDSLEY. THE LEDGER MAKES CLEAR THAT BOTH THE VILLAGE FOR ITS PORTION AND THE TOWN FOR ITS PORTION HAS MAINTENANCE JURISDICTION OVER THOSE ROADS, AS IT DOES FOR EUCLID AND THE OTHER ROADS THAT APPEARED ON THE 1894 MAP THAT I SHOWED YOU EARLIER. NOW, THERE ARE OTHER ROADS THAT ARE INDICATED IN THE G I S THAT ARE WITHIN THE TOWN OF GREENBURG THAT ARE NOT PUBLIC ROADS, SUCH AS WINDING FARM, WINDING ROAD, FAITH LANE, ST. ANDREWS. AND THEY'RE CLEARLY, CLEARLY SHOWN AS ROADS THAT ARE NOT UNDER THE JURISDICTIONAL RESPONSIBILITY OF THE TOWN OF GREENBURG. AND INTERESTING ENOUGH, IF YOU LOOK AT RIVERVIEW AVENUE HERE AT THE TOP, YOU SEE THAT THE, THE VILLAGE OF ARDSLEY HAS ACCEPTED MAINTENANCE RESPONSIBILITY FOR ITS PORTION OF THAT ROAD. BUT THE TOWN OF GREENBURG HAS NOT ACCEPTED RESPONSIBILITY FOR THE PORTION THAT RESIDES IN THE TOWN OF GREENBURG. HAD THE TOWN INTENDED FOR SPRINGWOOD TO BE EXCLUDED FROM THE DATABASE, IT CLEARLY COULD HAVE TREATED IT LIKE IT TREATS RIVERVIEW AVENUE. THERE'S SOME INDICIA IN ADDITION TO THE INCLUSION IN THE LA IN THE L H I, UM, JUST DRIVING DOWN THE ROAD, YOU CAN SEE IT, THERE ARE STORM DRAINS THAT HAVE BEEN INSTALLED BY THE TOWN OF GREENBURG. THERE'S LIGHTING, WHICH WAS NOT ONLY INSTALLED, BUT UPGRADED WHEN THE TOWN MADE ITS UPGRADES TO L E D LIGHTING FOR ALL THE STREET LIGHTS THROUGHOUT THE TOWN. THERE'S A CURB WAY THAT HAS BEEN INSTALLED ALONG THE ENTIRE WESTERN SIDE OF THE, UH, ROAD, STARTING AT THE GREEN, STARTING AT THE VILLAGE OF LEY, OH, EXCUSE ME, THE VILLAGE OF LEY HERE, WHERE YOU SEE THAT CONCRETE PIECE, THAT'S WHERE THEIR ROADWAY ENDS. THE TOWN A COUPLE OF YEARS AGO CAME BY, INSTALLED THAT MCADAM, UH, CURBING ALL THE WAY DOWN TO THE FIRST CURB CUT AT, UH, 32 SPRINGWOOD AVENUE. TOWN HAS DONE PATCHING OVER THE YEARS OF THE ROAD. THIS IS JUST ONE INDICATION. THERE ARE MANY PATCHES ON THE ROAD, AND IT CONTROLS THE STREET PARKING ON THE ROAD. OTHER OF THIS YEAR ARE THE, THE TOWN PLOWS. THE ROAD HAS DONE STREET CLEANING RECENTLY, THE TOWN BOARDS, THE, THE, UM, ZONING AND PLANNING BOARDS HAVE TAKEN ACTION RELATIVE TO A NEW SUBDIVISION ALONG THE ROAD THAT IMPACTS THE ROAD, UM, AND, AND ALLOWS FOR CURB CUTS AND ALLOWS FOR VARIANCES IN ORDER FOR THE, UH, DEVELOPER TO BE ABLE TO ACCESS THE ROAD, THE TOWN PROVIDED. UH, THE TOWN, UH, UH, TOWN ATTORNEY, UH, DID A TITLE SEARCH RECENTLY AND FROM HIS REPORT TO ME, THAT TITLE SEARCH FAILED TO IDENTIFY AN OWNER OF THE ROAD. UH, MY REVIEW OF THE TOWN'S, UH, TAX RECORDS THAT ARE AVAILABLE ONLINE DOES NOT INDICATE THAT ANY TAXES ARE BEING, UH, COLLECTED RELATIVE TO THE ROAD. THERE'S NO PROHIBITORY SIGNAGE ANYWHERE IN THE ROAD. NO, NO, UH, NO TRESPASSING SIGNS, NO PRIVATE ROAD SIGNS AT ALL, OR NOR HAVE THERE EVER BEEN IN THE 25 YEARS THAT I'VE LIVED ON THE ROAD, AND THAT THE PROPERTY OWNERS UNIFORMLY HAVE SAID THAT THEIR, UH, DEEDS AND THE OTHER DOCUMENTS THAT THEY RECEIVED AT THE TIME THEY PURCHASED THEIR PROPERTY, UH, HAVE NO INDICATION THAT THE ROAD IS A, IS A, IS IS A PRIVATE ROAD. THERE ARE TWO POINTS THAT THE, UM, TOWN ATTORNEYS RAISED WITH ME THAT I WANT TO ADDRESS AT THIS POINT. AND ONE IS, UM, HE STATED THAT THERE IS A LACK OF A DEDICATION DOCUMENT FOR THIS ROAD. AND I DON'T THINK THAT'S DISPOSITIVE TO THE QUESTION HERE, BECAUSE THERE IS A LAW ON THE BOOKS IN NEW YORK STATE. IT'S HIGHWAY LAW 180 9, UH, SECTION 180 9, UH, ARTICLE TWO, WHICH STATES THAT A ROAD THAT'S USED AS A PUBLIC ROAD FOR A PERIOD OF 10 YEARS IS, UM, UH, IS CONSIDERED A PUBLIC ROAD. UM, THERE'S BEEN NO ENCUMBRANCES TO THE PUBLIC'S USE OF OUR ROAD EVER THAT I'M AWARE OF. UM, AND IN FACT, FOR 128 YEARS NOW, UH, OR MORE, IT'S BEEN A PUBLIC ROAD IN THE, IN THE, UH, TOWN OF GREENBURG, I WOULD CALL YOUR ATTENTION AGAIN TO, UH, PAGE SEVEN OF THE HIGHWAY OF THE LOCAL HIGHWAY INVENTORY MANUAL, WHICH IS ONLINE, WHICH MAKES IT VERY CLEAR THAT, UH, HIGHWAY LAW ARTICLE 180 9 WAS ADOPTED TO ADDRESS CONDITIONS WHERE ROADS HAVE BEEN USED FOR A LONG PERIOD OF TIME PRIOR TO EVEN 1930S. UM, BUT WERE NOT DEDICATED, OR THERE WAS NO FORMAL, UM, ACCEPTANCE BY THE, UH, TOWN OF THOSE ROADS. THEY IS STILL PUBLIC ROADS. ONE OTHER ITEM THAT THE, UH, TOWN ATTORNEY RAISED IN HIS DISCUSSIONS WITH ME IS THE WIDTH OF THE ROAD. THAT THE ROAD IS, UH, 16 FEET WIDE, AND IT DOESN'T READ, IT DOESN'T, UH, COMPLY WITH THE 26 [00:10:01] FOOT REGULATION OF THE TOWN AND ITS CODE. UM, I'D CALL YOUR ATTENTION TO THE FULL DATABASE OF THE 663 ROADS, UM, IN THE TOWN OF GREENBURG, OF WHICH, UH, 74% OF THEM ARE UNDER THE TOWN STANDARD, AND 17 OF THEM ARE, UH, 16 FEET OR LESS OF YOU. LASTLY, I JUST WANNA MAKE YOU AWARE OF THE DANGEROUS CONDITIONS OF THE TOWN OF THIS ROAD. UH, FIRST THIS PICTURE TO THE LEFT HERE IS A PICTURE OF WHERE OUR STREET, UH, THE, UM, PORTION OF THE TOWNS ROAD MEETS THE VILLAGE OF ARDSLEY. THE VILLAGE OF ARDSLEY HAS, UM, PAVED ITS ROAD TWICE IN THE 25 YEARS THAT I'M HERE, AND THAT HAS RESULTED IN A LIP WHERE THE TWO ROADS MEET, WHERE THE SECTION FROM THE TOWN AND THE VILLAGE MEET. AND THAT REALLY HAS BECOME ALMOST A LAUNCHING PAD FOR TRUCKS THAT TRAVEL MOST OF THE TIME AT A HIGH RATE OF SPEED DOWN THIS ROAD. AND YOU CAN SEE THE DETERIORATION THAT'S OCCURRING WHERE THERE'S TRUCKS LAND AS THEY COME OFF THE VILLAGE SIDE AND HIT THE TOWNSIDE FOR MANY POTHOLES ALONG THE ROAD, THIS IS PROBABLY THE, THE WORST ONE, WHICH IS RIGHT HERE IN THIS AREA. UM, AT THE END OF THE ROAD, THERE'S A LITTLE BIT OF A TURNAROUND, A, A SMALL CUL-DE-SAC WHERE, UH, TRUCKS CONSTANTLY TURN AROUND, AND THIS IS DIS DISINTEGRATING GREATLY. AND YOU CAN SEE THERE'S NO CURBING AT THE EDGE OF THE ROAD, WHICH IS CAUSING FURTHER DETERIORATION HERE. SO, UH, THAT CONCLUDES MY PRESENTATION HERE. AND, UH, I APPRECIATE YOUR ATTENTION AND YOUR, UM, GIVING US TIME TO BE ABLE TO PRESENT OUR FACTS HERE THAT WE BELIEVE ARE NECESSARY. LEWIS MADE US AWARE THAT THE TOWN'S, UH, PRELIMINARY DECISION HERE WAS THAT SPRINGWOOD AVENUE IS NOT, A TOWN IS NOT A PUBLIC ROAD. UM, AT THAT TIME, WE RAISED THE ISSUE OF THE BOARD, AND IT WAS THE, UH, ZONING BOARD OF APPEALS AT THE TIME NEEDED TO DETERMINE THAT BEFORE THEY, UH, PERMITTED SOMEONE TO MAKE A CONNECTION, UH, THROUGH A CURB CUT TO THE ROAD. UM, THEY DID NOT OPINE ON THAT. THEY SAID THAT WAS NOT WITHIN THEIR JURISDICTION, BUT THEY WERE AWARE OF IT. AND WE RAISED THE ISSUE ALSO WITH THE, UM, SO WITH THE, UH, UM, UH, PLANNING BOARD, UH, TOO, SO THEY WERE AWARE OF THE ISSUE, UM, BUT THEY DID NOT OPINE ON IT. SO THERE WAS NO VARIANCE GRANTED FOR NOT HAVING ACCESS TO A TOWN ROAD IN THOSE CASES. UH, THE, THERE WAS A VARIANCE GRANTED BY THE, UM, ZONING BOARD OF APPEALS TO REDUCE THE OFFSET TO THE ROAD. UM, AND THE PLANNING BOARD, I BELIEVE I DID NOT FOLLOW THE END OF THE PROCEEDING, BUT I BELIEVE PERMITTED A CURB CUT TO ACCESS THE ROAD. NICK, DID YOU HAVE ANYTHING THAT YOU WANTED TO SAY? SO FROM THE BEGINNING, MAYBE ABOUT APPROXIMATELY 60 FEET INTO THE STREET WHERE THERE'S, THERE ARE HOUSES FROM THEN ON IS 26 AND A HALF FEET AND BEYOND. IT GOES TO LARGER OR LARGER WIDTH TO 29 FEET, TO 31 FEET, TO 35 AND A HALF TO 33. SO WE'RE, REGARDLESS OF WHETHER OR NOT THE WHOLE STREET IS NOT 26 AND A HALF WHERE THERE IS HOUSES, IT DEFINITELY IS. UM, I WANTED TO ALSO POINT OUT THAT, UM, AS JIM SAID, THE TOWN HAS BEEN RECEIVING FUNDING FROM, FOR ALL THESE YEARS, FROM NEW YORK STATE REGARDING MAINTENANCE OF THE ROAD THAT WE LIVE ON. AND UP UNTIL ABOUT TWO YEARS AGO, THREE YEARS AGO, WHEN WE STARTED BEING A LITTLE BIT MORE PERSISTENT ON THE TOWN, REPAVING THE STREET, AFTER WE WATCHED SPRINGWOOD AVENUE ON GET REPAVED TWICE, UM, DID WE START TO SEE RESISTANCE FROM THE TOWN ITSELF? UM, THE, THE TOWN HAS BEEN RECEIVING THIS FUNDING, THEY'VE BEEN MAINTAINING IT, AND UP UNTIL MAYBE POSSIBLY, YOU KNOW, A COUPLE YEARS, HAS THERE BEEN A LEADERSHIP CHANGE WHERE THE PHILOSOPHY HAS CHANGED THAT THEY PIVOTED TO SAYING THAT OUR STREET IS PRIVATE AS OPPOSED TO, YOU KNOW, THE A HUNDRED YEARS PLUS THAT IT'S BEEN PUBLIC. UM, SO I'M NOT SURE WHAT HAPPENED THERE. UM, THERE ARE SIGNS ON THE STREET FROM THE TOWN OF GREENBURG SEWERS, UM, UH, MANHOLE COVERS, UM, YOU KNOW, JUST LIKE JIM HAS POINTED OUT AND SHOWED YOU, UM, IN HIS PRESENTATION, POLICE HAVE BEEN PATROLLING OUR AREA TO MAKE SURE THAT OUR ROADWAY IS CLEAR AND THAT THERE'S CARS NOT PARKED TO, UM, YOU KNOW, BLOCK, YOU KNOW, THE FREEWAY, UH, FOR, YOU KNOW, VEHICLE SAFETY. AND THEY HAVE BEEN GIVING, UH, GIVEN SUMMONSES TO SOME OF OUR NEIGHBORS WHO WERE PARKED A LITTLE BIT TOO CLOSE TO, YOU KNOW, THE STREET AND TAKEN UP TOO MUCH, YOU KNOW, SPACE THERE. SO POLICE HAVE BEEN PATROLLING, MAINTENANCE HAS BEEN TAKEN CARE OF, CURBS BEEN CONSTRUCTED WITHIN TWO YEARS, THREE YEARS. UM, AND PATCHES, HUGE PATCHES OF ROAD HAVE BEEN AS WELL PAVED. SO I'M JUST NOT REALLY SURE WHY ALL OF A SUDDEN IN THE LAST FEW YEARS HAVE, UH, YOU KNOW, THE DOWN OF GREENBURG STARTED TO PIVOT AND, YOU KNOW, SAY THAT OUR STREET WAS PRIVATE WHEN IT'S BEEN PUBLIC FOR SO MANY YEARS, AND THAT THEY'VE RECEIVED FUNDING. SO, UM, I THOUGHT JIM DID AN EXCELLENT PRESENTATION, AND I, I BELIEVE HE PROVED, UM, BEYOND ANY DOUBT THAT THERE IS, UH, A, A REAL STAKE HERE THAT, THAT SAYS THAT THIS, UH, STREET'S A PUBLIC STREET AND THAT, YOU KNOW, WE SHOULD REALLY BE GETTING REPAVED LIKE VERY SOON. UH, IT, IT IS CURRENTLY PAVED, BUT THAT'S NOT, NOT WHAT THE MANUAL THAT YOU'RE RELYING ON SAYS.
