1.   Old Cases
ZBA Case 21-26 - Bloom Energy Corporation, for property located at 151 S. Fulton Street, (P.O. White Plains, N.Y.). Applicant is requesting an area variance from Section 285-36J to allow an accessory structure in the front yard (proposed) instead of the rear or side yard (permitted).  The property is located in an IB- Intermediate Business District and is designated on the Town Tax Map as Parcel ID:  8.80-42-1 & 2.
       ZBA Case No. 21-26 has requested an adjournment to April 28, 2022
 
2.   ZBA Case 21-35 – Fleetwood Life Estate/Alison Berry, for property located at 33 Dunham Road, (P.O. Hartsdale, N.Y.). Applicant is requesting an area variance from Section 285-15B((4)(d) of the Zoning Ordinance reduce the rear yard setback from 26 ft. (required) to 23.7 ft. (proposed), in order to replace an existing deck with a new roofed deck.  The property is located in an R-7.5 One-Family Residential District and is designated on the Town Tax Map as Parcel Lot ID:  8.180-132-18.
 
3.   ZBA Case 21-36 – Dimonte Realty Inc., for property located at 183 S. Central Avenue, (P.O. Hartsdale, N.Y.). Applicant is appealing the Building Inspector’s determination of Section 285-29.1B(5.1)(b)(1) of the Zoning Ordinance or in the alternative a use variance in connection with a proposed cigar lounge.  The Building Inspector’s interpretation of this Section is that requiring a variance.  The property is located in the CA-Central Avenue Mixed Use Impact District and is designated on the Town Tax Map as Parcel Lot ID:  8.290-220-15.

4.   ZBA Case 22-03 – Mathew & Jancy Abraham, for property located at 11 Poe Street, (P.O. Hartsdale, N.Y.  Applicant is requesting area variances from Section 285-15(B)(3)(d) of the Zoning Ordinance to increase the maximum impervious surface from 40.75 % (permitted), 49  % (existing) to 45.83  % (proposed); from Section 285-15(B)(4)(a) to reduce the front yard from 20 ft. (required), 15.9 ft. (existing) to 15.9 ft. (proposed); and from Section 285-42(C)(1) to enlarge a nonconforming structure so as to increase such nonconformance, in order to construct a sunroom.  The property is located in an R-7.5 One-Family Residential District and is designated on the Town Tax Map as Parcel Lot ID:  8.120-71-38.
 
5.   NEW CASES
ZBA Case 22-04 – 625 Dobbs Ferry Realty, LLC & DJM Realty NY, LLC, for property located at 625 Dobbs Ferry Road, (P.O. White Plains, N.Y.).  Applicants are appealing the Building Inspector’s determination that construction of a farm market at the site requires a use variance, or, in the alternative, request a use variance to permit  a proposed farm market.  In addition, applicants request a variance from Section 285-42(B)(1) of the Zoning Ordinance, to increase a nonconforming use so as to increase such nonconformance, in order to construct a farm market at the property.   The property is located in an R-30 One-Family Residential District and is designated on the Town Tax Map as Parcel Lot ID:   8.50-28-1.
 
6.   ZBA Case 22-05 – Orly Gez, for property located at Clarendon Road, (P.O. Scarsdale, N.Y). Applicant is applying for area variances from Section 285-15B(1) of the Zoning Ordinance to reduce the minimum lot area from 7,500 sq. ft. (required) to 6,105 sq. ft. (proposed); and from Section 285-15B(2) to reduce the minimum lot width from 75 ft. (required) to 62.5 ft. (proposed), in order to construct a one-family house.  The property is located in an R-7.5 One-Family Residence District and is designated on the Town Tax Map as Parcel Lot ID:  8.460-324-8 & 9
 
7.   ZBA Case 22-06 – Mohammad Haq, for property located at 65 Midvale Road, (P.O. Hartsdale, N.Y).  Applicant is applying for area variances from Section 285-5 to reduce the rear yard patio setback from 10 ft. (required) to 7.8 ft. (proposed); and from Section 285-14B(4)(b) to reduce the side yard driveway setback from 12 ft. (required) to 10.6 ft. (proposed), in order to legalize a patio and driveway.  The property is located in an R-10 One-Family Residential District and is located on the Town Tax Map as Parcel Lot ID: 8.360-256-13
 
8.   ZBA Case 22-07 - Aaron Schweiger, for property located at 176 Old Colony Road, (P.O. Hartsdale, N.Y).  Applicant is applying for an area variance from Section 285-39(D)(2)(a) of the Zoning Ordinance to increase the maximum Floor Area Ratio (F.A.R.) from 4,285 sq. ft. (permitted), 4,446 sq. ft. (existing) to 4,735 sq. ft. (proposed), in order to legalize a cabana on the property. The property is located in an R-10 One-Family Residential District and is designated on the Town Tax Map as Parcel Lot ID:  8.360-259-15
 
9.   CORRESPONDENCE
 ZBA Case 22-08 – Scarsdale Golf Club, for property located at 1 Club Way (P.O. Hartsdale, N.Y.). The Zoning Board of Appeals will consider declaring its intent to be Lead Agency with respect to the State Environmental Quality Review Act (SEQRA). The Applicant has applied for area variances associated with an active amended site plan application. The matter will be heard by the ZBA April 28, 2022.
