YOU KNOW, OBVIOUSLY WE CAN MAKE PRESENTATIONS AND ALL THAT, BUT IT REALLY COMES DOWN TO THIS IS, UH, ROUND THREE OF OUR BIG BOXING MATCH WITH THE ENERGY WORLD.

AND SO THAT, WE'VE BEEN THROUGH THAT TWICE AS YOU'RE VERY WELL AWARE BECAUSE WE'VE BEEN COMING BEFORE YOU ON THAT.

SO, UH, WE'RE TAKING ANOTHER RUN AT IT, BUT AT THE SUGGESTION ACTUALLY OF ONE OF THE VILLAGE ADMINISTRATORS, WE HAVE MODIFIED THE M O U AND, UH, THE, THE NEW DRAFT THAT YOU HAVE THERE, UH, USES ESSENTIALLY KIND OF TRADITIONAL, UM, UH, MUNICIPAL PURCHASING LANGUAGE AND IT CALLS FOR THE LOWEST, UM, RESPONSIBLE BID RATHER THAN SETTING A TARGET AT, YOU KNOW, THIS TIME AND THEN GOING OUT A FEW WEEKS AND FINDING THAT WE'RE IN THE WRONG PLACE AND NOT ABLE TO DO ANYTHING.

SO THAT'S THE MAJOR CHANGE IN WHAT YOU HAVE THERE.

UH, THERE'S ALSO AN EXPANDED WINDOW IN TERMS OF WHEN THAT'S WHEN THE STARTING POINT WOULD BE IN JUST TO PROVIDE FOR, IN THE EVENT THAT WE CALL FOR BIDS, WE DON'T GET ANYTHING SENSIBLE AND WE WANNA BASICALLY CALL DO, DO OVER AND REBID AFTER THREE WEEKS OR WHATEVER, YOU KNOW, WHICH WOULD PUSH THAT, THE ACTUAL ENROLLMENT STARTING POINT OUT.

SO THAT'S WRITTEN WITH A, UH, A WINDOW RATHER THAN A FIXED, FIXED DATE AS WELL.

SO THOSE ARE THE TWO SORT OF SUBSTANTIVE CHANGES TO THE APPROACH.

UH, AS YOU KNOW, JUST IN TERMS OF THE CONTEXT, THE CONTRACT IS ENDING, THE CURRENT CONTRACT IS ENDING JUNE 30TH, AND, AND WE HAVE, UM, TRIED TO GET OUT THERE IN FRONT OF ALL THE, THE PARTICIPANTS AND, AND, UH, ALERT THEM.

WE SENT OUT A, UH, A MAILER TO EVERY PARTICIPATING CUSTOMER, UH, MADE SURE IT GOT TO THEM BEFORE THE CON ED NOTICE, WHICH IS JUST A SIMPLE NOTICE SAYING YOU'RE BEING SWITCHED BACK TO CON ED SO THAT THEY WOULD'VE THE CONTACT, THEY'D KNOW THAT, UM, YOU KNOW, WE WERE CONTINUING TO WORK ON THAT CONTRACT.

AND THEN FOR THIS INTERIM PERIOD THERE WILL BE, UH, SWITCH BACK TO CONED.

BUT AS WE, UH, SECURE THE NEW CONTRACT, THEN IT WOULD GO THROUGH THE SAME PROCESS THAT WE GO THROUGH EVERY TIME, BASICALLY WITH THE, WITH THE OPTOUT LETTER, GETTING ALL THE INFORMATION ABOUT WHAT THE, THE NEW, UH, CONTRACT WOULD, UH, COMPRISE THE RATES, THE TWO PRODUCTS STANDARD AND GREEN, THE DEFAULT PRODUCT, UH, BEING GREEN IN IN GREENBURG, AND, UM, OF COURSE ALL THE CONTACT INFORMATION THEY, THEY NEEDED TO MAKE ANY CHANGES THEY THEY WANNA MAKE.

AND, UM, AND THE NEW LETTERS IN ENGLISH AND SPANISH AS WELL.

SO JUST TO ALERT THEM OF THAT PROCESS.

AND WE'VE BEEN OUT IN FRONT OF, UH, PROBABLY 10 BOARDS ALREADY.

WE HAVE SEVEN, UH, MOUS IN HAND.

WE HAVE, UH, THREE OR FOUR MORE THAT WE ARE, WE KNOW HAVE BEEN APPROVED, BUT WE DON'T HAVE THE PAPER YET.

WE'RE, UH, THIS IS MY SECOND MEETING TONIGHT.

AND, UH, SO WE'RE TRYING TO GET THEM ALL CORRAL BY, UH, JULY 5TH, WHICH WOULD BE THE OFFICIAL ISSUANCE OF THE R F P AND THE, UM, SUBMISSION DATE WOULD BE, UM, JULY 15TH IS WHAT WE'RE TARGETING.

SO, SO YOU BASICALLY, IF IT TURNS OUT THAT YOU DO THE BIDDING AND THE RATES ARE NOT FAVORABLE, THEN WE'LL JUST CONTINUE TO PUT, SO YEAH.

NOW, SO IN THIS CASE, UH, YOU MAY WELL ASK, YOU KNOW, WHAT IS, WHAT CONS CONSTITUTES UNFAVORABLE WHEN, WHEN WE'RE SAYING IT'S, UH, LOWEST RESPONSIBLE BID.

AND WHAT I'M ASSURE TO OTHERS IS, YOU KNOW, SAY, WELL, YOU KNOW, IF IT'S 30, 30 CENTS OR SOMETHING, WE'RE NOT TAKING 30 CENTS, BUT WHAT, WE'LL, WE DO HAVE, YOU KNOW, SOME INFORMATION WE CAN TRIANGULATE BY.

AND WHAT I'M TELLING PEOPLE IS WE, WE NEED TO BE DOWN WHEREVER THE LOWEST ESCO GREEN ESCO RATES ARE.

SO IF WE'RE AT THE BOTTOM LEVEL OF THAT, THEN WE'RE IN THE RIGHT, RIGHT TARGET AREA.

THAT WOULD BE SENSIBLE.

IF WE GET SOMETHING THAT'S, YOU KNOW, OUT IN SOME OTHER PLACE, THEN, UH, THE, THE R F P DOES NOT REQUIRE US TO MAKE AN AWARD UNDER SUCH CIRCUMSTANCES.

AND AGAIN, THAT'S WHY WE ALSO, WE BUILT IN THIS ABILITY TO JUST, YOU KNOW, REBID ASK FOR ANOTHER, ANOTHER ROUND.

BUT YOU'RE SAYING THAT THE NEW CONTRACTS HAVE STANDARD LANGUAGE THAT WE'RE AGREEING TO HAVE YOU SIGN THE LOWEST, UH, BID.

YOU MAY HAVE THE OPTION OF NOT DOING IT, BUT WHAT DID MUNICIPALITIES HAVE IF WE SIGNED SUBJECT AGREEMENT

THAT DOESN'T HAVE A HIGH, LOW, UH, RANGE BID? YEAH, THE, THAT, THAT CALL TO AWARD THE BID AS IT USUALLY DOES, UH, WOULD RESIDE WITH US.

AND ONCE AN AWARD IS MADE, THEN THE, THE, ALL THE MUNICIPALITIES WOULD BE EXECUTING THE ASSOCIATED CONTRACTS.

UM, BUT IF OBVIOUSLY YOU'RE NOT PART OF THE PROCESS RIGHT NOW, YOU'RE NOT, YOU'RE NOT GETTING CUSTOMERS RIGHT NOW BECAUSE YOU'RE IN THOSE STORES.

UH, NOT SAYING THAT THIS WOULD HAPPEN, BUT IF WE SIGN AN AGREEMENT THAT IT'S REALLY WE'RE LEAVING IT UP TO YOU TO DECIDE WHAT THE REASONABLE OF RATE AND IT'S OUT OF OUR HANDS, AND YOU WANNA GET BACK INTO THE ENERGY BUSINESS, UH, YOU MIGHT WANT TO JUMP BACK IN AGAIN AT A, A HIGHER RATE THAN, YOU KNOW, WE MIGHT THINK IS, IS REASONABLE.

MM-HMM.

NOT PUT INTO THE CONTRACT FOR OUR FAMILIES, UH, WHAT WE WOULD CONSIDER TO BE THE HIGH, UH, VALUE.

AND ANYTHING ABOVE THAT WAS NOT IT, IF IT WAS IN A DIFFICULT POSITION.

NO, I UNDERSTAND.

IT'S, IT'S, UH, DEFINITELY A DIFFERENT DECISION THAN IT HAS BEEN IN, IN THAT SENSE.

UM, IT'S, YOU KNOW, THIS IS THE ONLY, UH, SENSIBLE WAY THAT WE COULD COME UP WITH TO, YOU KNOW, ACCOMMODATE THE FACT THAT EV EVERY WEEK THINGS ARE MOVING UP AND DOWN BY RADICAL AMOUNTS AND THE ATTEMPT TO, TO FIX A POINT ON THAT CURVE AND THEN, YOU KNOW, THREE WEEKS LATER GOING OUT TO BED AND IT'S SOMEWHERE ELSE JUST WAS NOT A, A POSSIBILITY.

SO WHAT DURATION ARE YOU LOOKING FOR? BECAUSE THIS IS A TERRIBLE TIME TO ACTUALLY HAVE TO DO THIS.

WE DON'T HAVE A CHOICE, BUT IT'S A TERRIBLE TIME TO HAVE TO DO THIS.

SO WHAT DURATION CONTRACT ARE YOU LOOKING FOR? YEAH, AND UM, IT'S TRUE, IT'S JUST A, A BAD TIME IN A SENSE.

BUT WE ALSO, IN TERMS OF WHAT DURATION WE WILL AS NORM AS WE NORMALLY DO, ASK FOR BIDS ON MULTIPLE TERMS, YOU KNOW, ONE YEAR, 18 MONTHS, TWO YEARS, UH, TO 30 MONTHS AND WE'LL, WE'LL LOOK AT WHERE THE SWEET SPOT IS.

ONE THING THAT'S, UH, A CURRENT, YOU KNOW, FACTOR IN THE MARKET IS THIS WINTER IS PRETTY OUTLANDISH IN THE WAY IT LOOKS.

WE'RE THE, THE NUMBERS JUST FOR JANUARY AND FEBRUARY FOR THOSE, THOSE FUTURE INDICATIVES JUST FOR THOSE MONTHS WERE UP LIKE 24 CENTS OR SOMETHING LIKE THAT.

SO ONE OF THE THINGS, YOU KNOW, RATHER EARLIER IN THE YEAR WE WERE LOOKING FOR A SHORT-TERM CONTRACT, DIDN'T, DIDN'T GET THERE, BUT NOW IT ACTUALLY LOOKS LIKE IT, IT'S SENSIBLE TO BE RE-LOOKING AT THE, THE ONE, THE TWO, TWO YEAR CONTRACTS IN ORDER TO PULL IN SOME OF THE LOWER, UM, FUTURE RATES AND, AND, UH, AMELIORATE SOME OF THE NEAR TERM CRAZY RATES AND AVERAGE THEM OUT A BIT.

SO, SO IT WOULD BE, YOU KNOW, LONGER THAN, UH, YOU KNOW, I THINK EVEN ONE YEAR, MAYBE SHORT IN ORDER TO, IF WE WANNA BRING IN SOMETHING THAT IS MORE COMFORTABLE IN THE, IN THE NEAR TERM, SO IT COULD BE MAYBE TWO YEARS.

AND THE OTHER ISSUE WE HAVE IS OUR NEXT MEETING IS ON THE 13TH OF JUNE, JULY AFTER YOUR .

YEAH.

SO WE ACTUALLY, YOU KNOW, YOU CAN IMAGINE WE HAVE A WHOLE TRACKING MATRIX WITH 24 MUNICIPALITIES AND TRYING TO FIGURE OUT WHO IS WHEN, AND UH, ORIGINALLY WE WERE TRYING TO BRING EVERYTHING IN AROUND THE 11TH OR 12TH, BUT THERE'S A COUPLE OF MUNIS, YOU'RE, YOU'RE ONE AND THERE'S ONE OR TWO OTHERS.

WE'RE OUT AROUND THE TWO 13TH.

SO THEN WE'RE FIGURING, WELL, OKAY, YOU'RE NOT GONNA GET, YOU KNOW, THE, THE ACTUAL SIGNED DOCUMENT UNTIL THE 14TH.

THAT'S WHY WE MOVED THE, UM, THE, THE BID SUBMISSION TO THE 15TH.

SO IS THERE A WAY THAT, UM, YOU KNOW, LET'S SAY YOU DO THE BID AND IT TURNS OUT THAT WE FAIL AS A BOARD, THAT THE PRICES ARE EXCESSIVE TO THE TOWN, COULD, YOU KNOW, SAY, YOU KNOW, WE DON'T WANNA PARTICIPATE, YOU KNOW, RATHER THAN LOCKING US IN, BECAUSE I THINK LIKE GRANT HAD SAID, YOU KNOW, WE COULD BE GIVING YOU SELECT ALMOST A BLANK CHECK AND IT MAY NOT BE FAVORABLE TO GREENBERG RESIDENTS.

AND YOU KNOW, I I I FEEL THAT IF WE GO BID AND WE WERE CONSULTED BEFORE THE BID IS AWARDED, MAYBE WE COULD HAVE LIKE 48 HOURS OR, OR SOME TIME WHERE WE COULD, UH, SAY, YOU KNOW WHAT, WE DON'T WANT TO PARTICIPATE BECAUSE A LOT OF OUR RESIDENTS,

YOU KNOW, THEY DON'T WANT THE TOWN TO, UM, UM, SIGN UP.

IT'S GONNA COST THEM, YOU KNOW, IF IT'S LIKELY THAT'S GONNA COST MORE.

UM, IF THERE'S A REASONABLE CHANCE THAT PEOPLE WILL SAVE MONEY TO SAY GO AHEAD, BUT RIGHT.

YOU KNOW, PEOPLE ARE STRUGGLING AND THEY JUST CAN'T AFFORD IT.

SO IF WE SAY, OH, WE LIKE SUSTAINABLE WESTCHESTER, BUT IT IS GONNA COST YOU $300 MORE A YEAR, PEOPLE ARE GOING TO, YOU KNOW, WE'LL PROBABLY NEED PROTECTION.

YEAH, NO, I, NO, I, I UNDERSTAND YOUR POINT.

AND I WOULD SAY THERE'S A COUPLE OF THREADS IN THERE.

ONE IS JUST THE, THE USUAL, WHICH IS, UM, NOBODY KNOWS WHETHER THE WE'RE GOING TO, IT'S GONNA BE A GOOD PRICE OR NOT UNTIL LATER ON WHEN, WHEN WE SEE WHAT THE UTILITY RATES ARE ARE DOING.

SO THAT'S A, UH, KIND OF A TOUGH THING.

IT'S A FUTURE, FUTURE BASED THING.

THE OTHER THING IS JUST TO AGAIN, REITERATE THAT, THAT THIS IS, UH, CONSUMER FRIENDLY IN THE, IN THE, UH, IN THE, UH, CONSIDERATION THAT THE, THERE IS NO OPT-OUT CHARGE AT ANY TIME.

SO PEOPLE CAN OPT OUT IF THEY SEE THE MARKET GOING OTHER WAY.

LIKE THE ISSUE IS THAT THE AVERAGE PERSON THAT I'VE SPOKEN TO, LIKE HAS NO IDEA WHAT'S GOING ON.

YOU KNOW, THEY DON'T REALLY READ, SO WE CAN SAY OPT OUT, BUT PEOPLE ARE REALLY CONFUSED.

UM, SO I'M WONDERING IF THE TOWN, LET'S SAY YOU GET A BID, YOU DO THE BIDS AND A MONTH FROM NOW, YOU KNOW, YOU PRESENTED TO THE TOWN AND THEN GIVE US LIKE TWO, THREE DAYS, UM, TO SAY WE'RE IN, OR WE'RE, YOU KNOW, WE'RE OUT.

AND I THINK YOU SHOULD DO THAT WITH ALL THE OTHER COMMUNITIES AND, UH, YOU KNOW, JUST LITTLE, IT'S JUST MORE TRANSPARENT AND WILL MAKE PEOPLE FEEL THAT WE'RE ALL, UM, YOU KNOW, DOING OUR HOMEWORK AND, AND DOING THE BEST FOR, FOR THE RESIDENTS.

UM, I MEAN THAT'S WHAT I, I I WOULD THINK THAT THAT WOULD HELP A LOT.

REALLY.

WELL, SO THE THIRD POINT, WE JUST DON'T WANT PEOPLE CHARGING MORE TO CHARGE MORE, BUT WOULD YOU SAY, I MEAN, IS MY THOUGHTS, UH, REFLECTIVE OF THE BOARD OR DO YOU THINK I'M WRONG? YOU KNOW, I'M NOT, I THINK YOU'RE SAYING JUST MAY RESPOND TO THE THIRD POINT, WHICH IS, YOU KNOW, 48 HOURS OR WHATEVER TO CONSIDER.

AND, UH, YOU, YOU COULD STRUCTURE IT THAT WAY, BUT WE HAVE ALWAYS, UH, UH, STRUCTURED THIS SO THAT WE'RE MAKING THE AWARD ON THE DAY OF THE BID OR OTH OTHERWISE THE, THE PRICES BECOME ESSENTIALLY INVALID.

OR IF YOU WANT THEM TO BE VALID FOR THAT LONG, THEN THEY HAVE TO PRICE IN WHATEVER SORT OF RISK COMPONENT THAT THEY, THEY FEEL IS, IS NECESSARY FOR ANY PRICE MOVEMENTS BECAUSE THEY'RE, THEY'RE PLACING THEIR HEDGES ESSENTIALLY ON THE, ON THE DAY OF THE AWARD.

SO THAT WOULD CHANGE THINGS, UM, FUNDAMENTALLY IN THE WAY WE BID.

AND WHAT, WHAT WOULD YOU SAY, WHAT WOULD OTHER BOARD MEMBERS, YOU KNOW, WANT TO DO ON THIS? I MEAN, WE COULD CALL LIKE A SPECIAL MEETING, UM, YOU KNOW, OR EVEN A ZOOM MEETING, LIKE WITHIN 48 HOURS, UH, AND COMMIT TO MAKING A DECISION.

YOU KNOW, THAT'S FINE.

YOU, YOU LIKE THAT IDEA? WELL, THEY, I, I'VE BEEN AT THESE BID AWARD THINGS WHERE THEY'RE, THEY'RE TRACKING THE BID THAT ARE COMING IN AND THEY DO A AWARD THAT MIGHT BEEN INSTANTANEOUSLY BECAUSE, UH, THEY, WHEN THE BIDDERS START OUT BID EACH OTHER, THEY KIND OF LIKE THE FRENZY THAT OCCURS TOWARDS THE END.

UH, I DON'T KNOW IF THAT'S GONNA HAPPEN.

IF YOU, YOU KNOW, YOU SAY, OKAY, HOLD THAT, HOLD THAT THOUGHT FOR MY, MY CONCERN IS THAT WE'RE NOT PUTTING INTO THE CONTRACT, YOU KNOW, IN ADVANCE, YOU KNOW, WHAT IS OUR TOP NUMBER THAT WE ACCEPT AS OPPOSED TO HOLDING THE BID 48 HOURS AFTERWARDS OUT BID DUE.

AND, WELL, THE PROBLEM IS WITH, WITH THE WHOLE INDUSTRY, YOU KNOW, THE PRICES KEEP, CHANGE IT.

LIKE RIGHT NOW, IF I C P IS THAT $4 AND 75 CENTS? I THINK IT'S A, IT'S A, A SALE.

UH, I'M REALLY HAPPY.

I MEAN, A MONTH AGO, YOU KNOW, I WOULD'VE, UH, GONE MY BICYCLE, I WOULD'VE, YOU KNOW, IT WAS, YOU KNOW, YOU THE SAME THING.
