Due to the COVID-19 pandemic, there will be no public gathering in Town Hall for this meeting. Planning Board Members will participate remotely. This meeting will be broadcast live on Cable Television and a recording likely will be available on cable television therafter. The Planning Board is a group of volunteers appointed by the Town Board to evaluate land use applications in accordance with the Town Code. When property owners seek to develop their land or make improvements via subdivision or if they will be disturbing an area with a steep slope or within a wetland, watercourse or adjacent, regulated buffer area, they must apply to the Planning Board for approval. It is the job of the Planning Board to balance the rights of land owners while ensuring the adverse impacts to the surrounding community are minimized. Decisions on adjustments to the proposed plan are based on factual evidence and reviewed for consistency with our Town code and Comprehensive Plan. This evidence primarily comes from applicants and their advisors, site visits conducted by Planning Board members, and input from Town staff, the appropriate Fire District, and the public as part of the public hearing process. The relative popularity of an application is not a factor in Planning Board decisions. Decisions are based on the facts presented.

Case No. PB 20-20 Newman, 13 Southwood Place (P.O. White Plains, N.Y.) – Preliminary Subdivision and Tree Removal Permit
A public hearing to discuss a preliminary subdivision and tree removal permit application involving the proposed subdivision of one existing lot into two (2) buildable lots, for the purpose of constructing one (1) new single family home, with related improvements. Proposed Lot 1 contains an existing residence to remain, with a curb cut along Southwood Place, and would consist of approximately 7,551 sq. ft. (0.17 acres) in area. The applicant is proposing the construction of one (1) new, 2-story residence on proposed Lot 2, which would consist of approximately 9,852 (0.23 acres) in area. Proposed Lot 2 would contain a new curb cut onto Juniper Hill Road. The applicant is proposing an increase in total impervious surfaces of approximately 1,624 sq. ft., and is proposing the addition of three (3) 330XL Cultec chambers to handle the additional stormwater runoff. The project requires approximately 204 cubic yards of excavation. The project requires the removal of one (1) regulated tree, requiring a tree removal permit form the Planning Board. On May 19, 2022, the Zoning Board of Appeals granted the following area variance required in connection with the project: Lot Width from 75 feet (required) to 59 feet (approved). The property consists of approximately 17,403 sq. ft. (0.4 acres) and is situated on the northerly side of the intersection of Southwood Place and Juniper Hill Road. The properties are located in the R-7.5 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.80-39-22 & 23.

a.  


Case No. PB 21-23 Worthington Estates (DiNapoli), 1490 & 1952 Saw Mill River Road (P.O. White Plains, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, and Tree Removal Permit
A work session to discuss a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application involving the proposed subdivision of two (2) existing tax lots into thirteen (13) building lots for the purpose of constructing thirteen (13) single-family homes and associated improvements. The applicant proposes a new curb cut and cul-de-sac off of White House Road to access each of the proposed lots. The applicant proposes approximately 33,810 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 18,720 sq. ft. of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 11,810 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant requires approximately 2,242 cubic yards of excavation and 0 cubic yards of imported fill. The applicant proposes four (4) 3500 MC stormwater infiltration chambers on each of the thirteen (13) lots, with an additional 64 3500 MC stormwater infiltration chambers for a total of 116 stormwater infiltration chambers, to handle the runoff created by impervious surfaces. The applicant proposes the removal of over 560 regulated trees, requiring a tree removal permit, and is in the process of preparing a landscaping plan. The properties consist of approximately 349,974 sq. ft. (8.03 acres) and are situated at the intersection of Saw Mill River Road and Whitehouse Road. The properties are located in the R-20 One-Family Residential District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 7.450-256-22.1 & 22.2.

Case No. PB 22-05 Secor Woods, Vacant Lots – Secor Road (P.O. Hartsdale, N.Y.) – Preliminary Subdivision and Tree Removal Permit
A work session to discuss a preliminary subdivision application involving the proposed resubdivision of four existing (4) lots into four (4) building lots and one (1) lot for a proposed roadway, built to Town standards. One (1) of the existing lots currently is occupied by a commercial building, proposed to be removed. The remaining three (3) lots are vacant. The applicant proposes the construction of four (4) new single-family homes, with related improvements. The applicant proposes a total of 20 Cultec 330 XLHD stormwater detention units, spread across the four (4) lots proposed to be improved with one-family residences, to handle stormwater runoff created by new impervious surfaces. The applicant proposes three (3) drywells under the roadway, to handle stormwater runoff created from the newly proposed roadway. The project requires approximately 500 cubic yards of excavation and 0 cubic yards of imported fill. The applicant proposes the removal of approximately 30 regulated trees, requiring tree removal permit approval from the Planning Board, and has prepared a landscaping plan providing for the planting of twelve (12) new trees, as replacement. The subject properties consist of approximately 46,600 sq. ft. and are situated on the southerly side of Secor Road, midway between the intersection of Secor Road and Ivy Place and the intersection of Secor Road and Eastway. The properties are situated in the R-7.5 One-Family Residence District, and are designated on the tax map of the Town as Parcel ID: 8.170-103-6, 7, 8, 9.

Case No. PB 22-10 Chao, Vacant Lots – Clayton Road (P.O. Scarsdale, N.Y.) – Preliminary Subdivision (Pre-Submission Conference)
A pre-submission conference to discuss a potential future preliminary subdivision application involving the proposed resubdivision of 3 existing tax lots (8.400-281-27, 30 & 31). The applicant will be presenting two alternative layouts for discussion. The first involves the merging of the three (3) tax lots in order to create one (1) flag lot, consisting of 86,649 sq. ft., for the purposes of constructing one (1) new single-family residence. The second alternative layout involves the resubdivision of the three (3) tax lots for the purposes of creating a two (2) lot subdivision with a new roadway built to Town standards for required access off of Clayton Road. The properties, in total, consist of approximately 86,649 sq. ft. (1.99 acres) and are situated on the east side of Clayton Road between Sheridan Road and Underhill Road. The properties are located in the R-30 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.400-281-27, 30 & 31.
