Due to the COVID-19 pandemic, there will be no public gathering in Town Hall for this meeting. Planning Board Members will participate remotely. a.   Case No. PB 20-20 Newman, 13 Southwood Place (P.O. White Plains, N.Y.) – Preliminary Subdivision and Tree Removal Permit
A work session to discuss the decision of a preliminary subdivision application involving the proposed subdivision of one existing lot into two (2) buildable lots, for the purpose of constructing one (1) new single family home, with related improvements. Proposed Lot 1 contains an existing residence to remain, with a curb cut along Southwood Place, and would consist of approximately 7,551 sq. ft. (0.17 acres) in area. The applicant is proposing the construction of one (1) new, 2-story residence on proposed Lot 2, which would consist of approximately 9,852 (0.23 acres) in area. Proposed Lot 2 would contain a new curb cut onto Juniper Hill Road. The applicant is proposing an increase in total impervious surfaces of approximately 1,624 sq. ft., and is proposing the addition of three (3) 330XL Cultec chambers to handle the additional stormwater runoff. The project requires approximately 204 cubic yards of excavation. The project requires the removal of one (1) regulated tree, requiring a tree removal permit form the Planning Board. On May 19, 2022, the Zoning Board of Appeals granted the following area variance required in connection with the project: Lot Width from 75 feet (required) to 59 feet (approved). The property consists of approximately 17,403 sq. ft. (0.4 acres) and is situated on the northerly side of the intersection of Southwood Place and Juniper Hill Road. The properties are located in the R-7.5 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.80-39-22 & 23.
 
b.  
Case No. PB 20-21 Brightview-Metropolis, 289 Dobbs Ferry Road (P.O. White Plains, N.Y.) – Final Subdivision
A work session to discuss the decision of a final subdivision application for a project consisting of the proposed construction of a 155-unit (186 bed), approximately 174,571 sq. ft. Continuum of Care Facility on an approximately 5 acre lot (Lot 1) of what currently is part of the Metropolis Country Club property. The project includes an approximately 3.17 acre lot (Lot 3), consisting of an adjacent and contiguous conservation easement area, to meet the required 8 acres for a Continuum of Care Facility. Lot 2, consisting of approximately 123.86 acres, will continue to operate as the Metropolis Country Club. On February 24, 2021, the Town Board adopted a resolution approving, with conditions, the applicant’s special permit, site plan, and tree removal permit applications (TB 20-10). The subject properties consist of approximately 132.03 acres and are situated on the southerly side of Dobbs Ferry Road, west and south of Sciortino Place. The properties are located in the R-15 and R-20 Zoning Districts and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.10-1-6, 8.141-94-15, 16, 17 & 18.
 
c.   Case No. TB 22-02 Chapter 285 – Adult-Use Cannabis – Zoning Text Amendment (Referral from Town Board)
A work session to consider the issuance of a report and recommendation associated with a zoning text amendment referral from the Town Board related to the comprehensive regulation of cannabis in the Town of Greenburgh, to be consistent with the guiding principles established in Town Board Resolution CD-2 – 12/13/2021, and consistent with the Marijuana Regulation & Taxation Act (MRTA) and related guidance of the Office of Cannabis Management (OCM). The draft local law is entitled “Cannabis,” and would amend Section 285-5 of the Code of the Town of Greenburgh entitled, “Definitions;” Section 285-32 entitled, “LI Light Industrial District;” Section 285-33 entitled, “GI General Industrial District;” Section 285-34 entitled, “PD Nonresidential Planned Development District;” Section 285-36 entitled, “Supplementary use regulations,” and Section 285-38 entitled, “Off-street parking, loading, and landscaping requirements.”
 
d.   Case No. PB 20-24 Bloom Energy, 151 Fulton Street (P.O. White Plains, N.Y.) – Planning Board Amended Site Plan
A continued work session (September 14, 2021, October 20, 2021, and May 4, 2022) to discuss a Planning Board amended site plan application involving the proposed installation of six (6) outdoor natural gas clean fuel cell energy servers. The applicant is proposing the installation of six (6) energy servers to provide approximately 1,500 kW of base load power to the site. The installation would have a footprint of approximately 2,450 sq. ft. and be surrounded by bollards, and located within an existing parking lot. The project requires the removal of 14 of the existing 30 off-street parking spaces. The applicant has proposed the addition of 13 off-street parking spaces to compensate, resulting in 29 parking spaces, where 29 are required. The applicant has added a gravel service area around the servers to offset the additional impervious surfaces from the parking spaces. The project has been reviewed by the Town Building Inspector, and the following area variance is required: accessory structure proposed within the front yard. The properties consist of approximately 53,578 sq. ft. (1.23 acres) and are situated on the northern side of the intersection of Fulton Street and Russell Street. The properties are located in the IB Intermediate Business District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.80-42-1 & 2.
 
5.   NEW BUSINESS - WORK SESSION
 
a.   Case No. PB 22-13 Anderson & Ball, Vacant Lot – Old Army Road (P.O. Scarsdale, N.Y.) – Planning Board Steep Slope Permit and Tree Removal Permit
A work session to discuss a Planning Board steep slope permit and tree removal permit application involving the proposed construction of a single-family home, with related improvements. The site features steep slopes immediately adjacent to Old Army Road, along the southern property line, and to the rear of the property. The applicant proposes approximately 1,352 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 310 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 409 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant requires approximately 140 cubic yards of excavation and approximately 360 cubic yards of imported fill, requiring a Fill Permit from the Bureau of Engineering. The applicant proposes the removal of two (2) regulated trees, requiring a tree removal permit from the Planning Board, and has prepared a landscaping plan providing for the planting of 19 trees and 14 shrubs, as replacement. The property consists of approximately 9,476 sq. ft. (0.22 acres) and is situated on the easterly side of Old Army Road, approximately 225 feet from the intersection of Old Army Road and Doris Drive. The property is located in the R-7.5 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.540-371-47.2.
