Please Take Notice that the Zoning Board of Appeals of the Town of Greenburgh will hold a Public Hearing on Thursday, September 15, 2022 at 7:00 p.m, at Greenburgh Town Hall, 177 Hillside Avenue, 10607. 1.   ZBA Case 22-16 – Renard Self Storage, LLC, for property located at 42-44 Hayes Street, (P.O. Elmsford, N.Y).  

Applicant is requesting area variances from Section 285-32B(3)(a) of the Zoning Ordinance increase maximum building coverage of the principal building from 15% (permitted) to 62.2% (proposed); from Section 285-32B(3)(c) to increase the maximum building coverage of all buildings from 20% (permitted) to 62.2% (proposed); from Section 285-32B(3)(d) to increase the maximum impervious surface from 80% (permitted) to 88.1% (proposed); from Section 285-32B(4)(b) to reduce one side yard setback from 50 ft. (required) to 12.5 ft. (proposed); and the other side yard setback from 50 ft. (required) to 12.5 ft. (proposed); from Section 285-(5) to reduce a total of two side yards setback from 100 ft. (required) to 25 ft. (proposed); from Section 285-32B(4)(d) to  reduce the rear yard setback from 50 ft. (required) to 5 ft. (proposed); from Section 285-32B(6)  to increase the  building height from 45 ft. (permitted) to 58.5 ft. (proposed); to increase the number of stories from 3 (permitted) to 5 (proposed); and from Section 285-E to reduce off-street parking spaces from 30  (required) to 14  (proposed), in order to construct a building.   The property is located in an LI – Light Industrial District and is designated on the Town Tax Map as Parcel Lot ID: 7.180-57-1.1.5.

2.   ZBA Case 21-26 - Bloom Energy Corporation, for property located at 151 S. Fulton Street, (P.O. White Plains, N.Y.).

Applicant is requesting an area variance from Section 285-36(J) to allow an accessory structure in the front yard (proposed) instead of the rear or side yard (permitted).  The property is located in an IB- Intermediate Business District and is designated on the Town Tax Map as Parcel ID:  8.80-42-1 & 2.
 
 
3.   ZBA Case 22-08 – Scarsdale Golf Club, for property located at 1 Club Way, (P.O. Hartsdale, N.Y).

Applicant is applying for area variances from Section 285-10A(2)(a)(2) of the Zoning Ordinance for the Tennis Bubble to reduce the front yard setback from 200 ft. (required) to 92.1 ft. (proposed), for the side yard setback from 25 ft. (required) to 6 ft. (required), from Section 285-12B(6) to increase the maximum height from 30 ft. (permitted) to 38 ft. (proposed); for the Driving Range Netting from Section 28540B(4) to increase the maximum height from 12 ft. (permitted) to 90 ft. (proposed); and for the 16th Hole Netting from Section 12B(5)(b) to reduce the side yard setback from 16 ft. (required) to 3.4 ft. (proposed); and from Section 285-40B(4) to increase the maximum height from 12 ft. (permitted) to 25 ft. (proposed), in order to install a temporary seasonal enclosure over two (2) of the lower elevation tennis courts and Driving Range Netting.  The property is located in an R-20 One-Family Residential District and is designated on the Town Tax Map as Parcel Lot ID:  8.361-263-1..SG, 8.361-263-1..SE

4.   ZBA Case 22-22 – Syed & Nadeem Kirmani, Kirmani Group, for property located at 350 Saw Mill River Road, (P.O. Elmsford, N.Y).  Applicant is requesting area variances from Section 240-3C(9) of the Sign & Illumination Law to increase the number of wall signs on a non-corner lot (“World Famous Chicken,” Colonel Sanders Logo, Taco Bell Logo and “Taco Bell” lettering) from one (1) (permitted) to seven (7) (proposed); from Section 240-3D(7)(a) to increase the height of logo (Colonel Sanders Image) from 4 ft. (permitted) to 7.08 ft. (proposed); and to increase the overall stacked height of logo and wall (Taco Bell Logo and “Taco Bell”) from 4 ft. (permitted) to 4.66 ft. (proposed).  The property is located in a DS – Design Shopping District and is designated on the Town Tax Map as Parcel Lot ID: 7.120-19-25.
                                          
 
5.   NEW CASE
ZBA Case 22-26 – Lewis Masters holdings, lp,
for property located at 320 Saw Mill River Road, (P.O. Elmsford, N.Y).  Applicant is requesting an area variance from Section 240-3D(7)(b) of the Sign & Illumination Law to increase a yard sign from 50 sq. ft. (permitted) to 70. sq. ft. (proposed), in order to install a new yard sign.  The property is located in a DS – Design Shopping District and is designated on the Town Tax Map as Parcel Lot ID: 7.120-19-25.
