This meeting will take place in the Town Hall Auditorium, located at 177 Hillside Avenue, Greenburgh, NY, and will also take place via Zoom. Case No. PB 18-03 Nukho, 16 Rockhill Lane (P.O. Scarsdale, N.Y.) – Planning Board Steep Slope Permit Amendment Request
A work session to discuss the decision of an amended Planning Board steep slope permit application involving the legalization of a boulder wall constructed on the property, which deviated from the originally approved plans associated with the project. The applicant was approved to construct a retaining wall with Redi-Rock interlocking blocks but, over the course of work, generated a large amount of rock boulders and elected to utilize those to construct the retaining wall. This resulted in disturbance outside the approved limits of disturbance and an approximately 63 sq. ft. increase in the disturbance to 25-35% slopes (VERY STEEP SLOPES) and an approximately 2,251 sq. ft. increase in the disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The property consists of approximately 52,459 sq. ft. and is situated on the east side of Rockhill Lane approximately 950 feet from the intersection of Underhill Road and Rockhill Lane. The property is located in the R-20 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.350-252-53.

Case No. PB 23-03 Jiang, 2 High Point Terrace (P.O. Scarsdale, N.Y.) – Preliminary Subdivision (Initial Conference)
An initial conference to discuss a potential future preliminary subdivision application involving the subdivision of one (1) existing lot into two (2) lots. Proposed Lot 1 would contain an existing residence to remain, and proposed Lot 2 would be laid out as a buildable lot, with the purpose of constructing one (1) new single-family residence on the newly proposed lot, in the future. Proposed Lot 2 would have access through High Point Terrace, to the north of the existing residence, and could connect to utility services via an easement within the southerly portion of the property. The applicant has indicated that four (4) area variances likely would be required in connection with the project, as currently proposed: (1) maximum floor area: 10,500 sq. ft. (permitted) to 14,763 sq. ft. (proposed); (2) maximum floor area ratio: 0.14 (permitted) to 0.2 (proposed); (3) maximum impervious coverage: 29% (permitted) to 30.1% ft. (proposed); and (4) subdivision resulting in a non-conforming lot with an existing building. The property consists of approximately 125,017 sq. ft. (2.87 acres) and is situated on the easterly side of High Point Terrace. The property is located in the R-20 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.520-356-71.

Case No. PB 22-19 McGourty, 5 Hillcrest Avenue (P.O. Ardsley, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, and Tree Removal Permit
A work session to discuss a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application involving the proposed subdivision of one (1) lot with an existing house into two (2) lots, for the purpose of constructing one new single-family home on the newly proposed lot. The applicant proposes for the new lot to front on Chestnut Street, which would be improved as part of this project. The applicant proposes approximately 872 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 0 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 0 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposed twelve (12) Cultec chambers to handle runoff created by new impervious surfaces. The applicant proposes the removal of three (3) regulated trees, requiring a tree removal permit, and is in the process of preparing a landscaping plan. The application has been reviewed by the Town Building Inspector who, in a memorandum dated October 20, 2022, determined that the following area variance is required: required street frontage on a public road or road built to Town standards. The property consists of approximately 20,000 sq. ft. (0.46 acres) and is situated on the southwest side of the intersection of Hillcrest Avenue and Chestnut Street. The property is located in the R-7.5 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.380-271-54.

Case No. PB 22-27 Liberty Coca-Cola, 111 Fairview Park Drive (P.O. Elmsford, N.Y.) – Planning Board Amended Site Plan and Tree Removal Permit
A continued work session (January 18, 2023) to discuss a Planning Board amended site plan and tree removal permit application involving the proposed implementation of a sustainable energy project that would enable the existing, on-site Coca-Cola bottling plant to generate its own electrical power, along with thermal and cooling energy, through utilization of cogeneration technology. The project involves the proposed construction of an onsite energy system, a carbon recovery system, and related equipment, within the southern portion of the site. The applicant proposes the removal of three (3) regulated trees, requiring a tree removal permit from the Planning Board. The applicant is in the process of preparing a landscape plan to satisfy the requirements of Chapter 260 of the Town Code. The project also requires five (5) area variances from the Zoning Board of Appeals, as outlined in a memorandum issued by the Town Building Inspector, dated January 12, 2023. The property consists of approximately 439,342 sq. ft. (22.03 acres) and is situated on the west side of Fairview Park Drive, at the intersection of Ridgewood Drive. The property is located in the PD Non-Residential Planned Development District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.110-14-5.

Case No. PB 22-20 Elmwood Preserve, 850 Dobbs Ferry Road, (P.O. White Plains, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit
A work session to discuss a preliminary subdivision, Planning Board steep slope permit, wetland/watercourse permit, and tree removal permit application involving a proposed conservation subdivision. In connection with an approved zoning map amendment, a CD Conservation District Overlay was added to the site. Consistent with the findings statement, the applicant proposes to subdivide and develop 113 single-family homes, while preserving 25.2 acres of open space. The easterly 14.2 acre parcel is proposed to be dedicated to the Town for use as an extension of East Rumbrook Park. The applicant proposes two (2) new curb cuts on Dobbs Ferry Road, the easternmost of which is proposed to be full-movement, while the westernmost is proposed to be right-in and right-out only. The applicant proposes approximately 476,854 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 152,501 sq. ft. of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 85,653 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 217,059 cubic yards of excavation and approximately 257,392 cubic yards of imported fill, requiring a Fill Permit from the Bureau of Engineering. The applicant proposes to disturb approximately 49,832 sq. ft. of regulated wetland/watercourse buffer area. No direct disturbance to wetlands or watercourses is proposed. The applicant proposes the removal of regulated trees, the total amount of which is being determined, and has prepared preliminary landscaping plans for review by the Town Forestry Officer. The property is located in the R-20 and R-30 One-Family Residence Districts, with a CD – Conservation District Overlay, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.370-265-1, 8.370-265-2, 8.370-265-3 and 8.370-265-4.

Case No. PB 22-24 Hart Hills Hospitality, 45 North Washington Avenue (P.O. Hartsdale, N.Y.) – Site Plan, Planning Board Steep Slope Permit, and Tree Removal Permit (2nd Pre-Submission Conference)
A 2nd pre-submission conference (November 2, 2022) to discuss a potential future site plan, Planning Board steep slope permit, and tree removal permit application involving the demolition of an existing, two-story frame residence, garage, and related improvements, and the construction of a new, two-story, 8-unit multifamily apartment building, together with eighteen (18) off-street parking spaces, a 1,500 sq. ft. open space area, and related improvements. The applicant has indicated that three (3) area variances likely will be required in connection with the project: (1) minimum lot area for eight [8] units: 24,000 sq. ft. (required) to 22,912 sq. ft. (proposed); (2) maximum building coverage: 18.3% (permitted) to 21.56% (proposed); and (3) minimum distance of off-street parking to principal building: 10 ft. (required) to 0 ft. (proposed). The property consists of approximately 27,378 sq. ft. (0.63 acres) and is situated on the westerly side of North Washington Avenue, approximately 150 feet southwest of the intersection of Elmwood Road and North Washington Avenue. The property is located in the M-14 Multifamily Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.250-183-3.
