Please Take Notice that the Zoning Board of Appeals of the Town of Greenburgh will hold a Public Hearing on Thursday, March 16, 2023 at 7:00 p.m. The meeting will take place in the Town Hall auditorium, 177 Hillside Avenue, Greenburgh, NY, at 1025 Fifth Avenue, New York, NY 10028 (contact planning@greenburghny.com for additional details), and also online via Zoom.  If you would like to participate via Zoom please pre-register through the Department of Community Development and Conservation by emailing publichearing@greenburghny.com or calling 914-989-1530, specifying the application(s) that you would like to speak on. 1.   Case No. ZBA 22-05: Orly Gez, Clarendon Place (P.O. Scarsdale, N.Y.) – Appeal of Building Inspector Determination; Area Variances
The Applicant is appealing a determination of the Building Inspector that variances are required.In the alternative, if its appeal is denied, the Applicant requests area variances from Section 285-15(B)(1) of the Zoning Ordinance to reduce the minimum lot area from 7,500 sq. ft. (required) to 6,105 sq. ft. (proposed); from Section 285-15(B)(2) of the Zoning Ordinance to reduce the minimum lot width from 75 ft. (required) to 62.5 ft. (proposed); and from Section 285-40(C)(6) of the Zoning Ordinance, in order to construct a one-family home on a lot that has been reduced in area and/or width by voluntary act of an owner that owned land adjoining the lot in question so as to become nonconforming as to size.The property is located in the R-7.5 One-Family Residence District and is designated on the Town Tax Map as Parcel Lot ID: 8.460-324-8 & 9.
 
2.   Case No. ZBA 22-38: S&J Service Center, 245 S Central Avenue (P.O. Hartsdale, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 285-29.1C(3) of the Zoning Ordinance to decrease the distance from a detached accessory structure to the front lot line from 20 ft. (required) to 10.66 ft. (proposed); and from Section 285-40B(4) of the Zoning Ordinance to increase the height of an accessory structure from 12 ft. (permitted) to 18 ft. (proposed), to construct a canopy over fuel pumps on the subject property. The property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.290-225-2.
 
3.   Case No. ZBA 22-40: Kimona Hanson, 128 Florence Avenue (P.O. White Plains, N.Y.) – Use Variance
The Applicant is requesting a use variance to permit the construction of a two-family residence in the R-5/LTF One-Family/Limited Two-Family Residential District on property designated on the tax map of the Town of Greenburgh as Parcel ID: 7.140-229-1.

4.   Case No. ZBA 22-41: BJ’s – Crossroads Shopping Center, 399 Tarrytown Road (P.O. White Plains, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 240-3C(8) of the Code of the Town of Greenburgh to increase the height of a logo wall sign from 6 ft. (permitted) to 8 ft. (proposed); and from Section 240-3C(8) to increase the stacked height of wall sign from 6 ft. (permitted) to 12’-3” (proposed), in order to install two stacked wall signs on the subject property.The property is located in the UR Urban Renewal District (Planned Commercial Development) and is designated on the Town Tax Map as parcel ID: 7.480-295-1.
 
3.   NEW CASES
 
1.   Case No. ZBA 23-01: Darryl Abrams, 31 Mt. Joy Avenue (P.O. Scarsdale, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 285-16B(4)(b) of the Code of the Town of Greenburgh to reduce the minimum side yard setback from a principal building from 8 ft. (required) to 5.8 ft. (proposed); from Section 285-16B(3)(a) to increase the principal building coverage from 30% (permitted) to 32.10% (proposed); and from Section 285-39D(2)(a) to increase the floor area ratio (FAR) from 2,535 sq. ft. (permitted) to 2,566 sq. ft. (proposed), in order to construct a one story addition to an existing residence on the subject property.The property is located in the R-5 One-Family Residence District and is designated on the Town Tax Map as parcel ID: 8.460-329-6.
 
2.   Case No. ZBA 23-02: Hector Batista, 60 Charlotte Place (P.O. Hartsdale, N.Y.) – Area Variance
The Applicant is requesting an area variance from Section 285-15B(5)(b) of the Code of the Town of Greenburgh to reduce the minimum side yard setback from an accessory structure (generator) from 10 ft. (required) to 7.3 ft. (proposed) in order to install a generator at an existing residence on the subject property.The property is located in the R-7.5 One-Family Residence District and is designated on the Town Tax Map as parcel ID: 8.310-235-15.
 
3.   Case No. ZBA 23-03: Liberty Coca-Cola, 111 Fairview Park Drive (P.O. Elmsford, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 285-34B(3)(a)(5) of the Code of the Town of Greenburgh to increase the maximum impervious surface of the site from 70% (permitted) to 84.65% (proposed); from Section 285-34B(3)(a)(4) to increase the maximum height of an accessory structure (stripper tank) from 40 ft. (permitted) to 75.42 ft. (proposed), and from Section 285-34B(3)(a)(4) to increase the maximum height of an accessory structure (absorber tower) from 40 ft. (permitted) to 77 ft. (proposed), in order to construct components of a cogeneration system on the subject property.The property is located in the PD Non-Residential Planned Development District and is designated on the Town Tax Map as parcel ID: 7.110-14-5.
 
4.   Case No. ZBA 23-04: Dren Idrizi, 452 Ardsley Road (P.O. Scarsdale, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 285-12B(5)(b) of the Code of the Town of Greenburgh to reduce the minimum setback form a driveway to a side lot line from 16 ft. (required) to 0 ft. (proposed); and from Section 285-38B to increase the maximum driveway width from 30 ft. (permitted) to 37.25 ft. (proposed), in order to expand a driveway at an existing home on the subject property. The property is located in the R-20 One-Family Residence District and is designated on the Town Tax Map as parcel ID: 8.460-318-17.
