UM, I'D ALSO LIKE TO, UH, THEN COUNCILWOMAN, UH, GINA JACKSON FOR, UH, SHE HAD A LITTLE COLD YESTERDAY AND IS BEING RESPECTFUL OF EVERYBODY AND MEETING BY ZOOM FROM, SHE'S IN THE BACK THERE, BUT DOESN'T WANT ANYBODY TO GET SICK.

SO WE REALLY THANK HER FOR, UH, FOR HER SENSITIVITY.

UM, AND, UM, NEXT, UH, WE, UH, WOULD LIKE TO MENTION THAT, UM, WE'RE GONNA DO THE PLEDGE

[ MOMENT OF SILENCE In memory of Bill Lawyer, who will be appreciated for generations to come thanks to Bill's decades of hard work, innovative leadership and dedication to a more sustainable planet. The Greenburgh Nature Center and the Town of Greenburgh will always be grateful to Bill for his efforts. He has left a legacy that will be forever remembered. In memory of Jim Brennan, a lifelong resident of the Village of Irvington, who was drafted into the Army in 1966 where he spent 1 year in 'state side duty" and 13 months as a Vietnam Medic. He later worked for the NY Telephone/AT&T/Lucent Technologies and retired in 2000. Jim then took his favorite job al all, working for the Irvington Police Department as its Parking Enforcement Officer. He was a member of the Irvington Fire Department for 50 years, 6 of them as Chief. He also belonged to the Irvington Ambulance Corps for 23 years and received a Lifesaving Award in 2008. He served as Recreation Commissioner in the Recreation Department for 20 plus years, 18 as Chairman. Jim also served on the Village Vietnam Veterans Memorial Committee and helped research all the names honored there. The walls in his home are filled with awards he earned over the years. In memory of the people in Ukraine killed during Russia's invasion and relentless intentional targeted bombing of civilians in apartment buildings, hospitals, train stations, schools and children centers, deliberating targeting utilities used by civilians to leave them without electricity and heat through the brutal winter weather, with mass graves being found after invaded areas have been retaken, all in Russia's effort to destroy Ukraine and its people, who are forced to fight for their land, their freedom, and general democratic principles. May they rest in peace and peace be restored to Ukraine]

A MOMENT OF SILENCE AND MEMORY OF, UH, BILL LAWYER, UH, WHO WILL BE APPRECIATED FOR GENERATIONS, UM, TO COME.

THANKS TO BILL'S DECADES OF HARD WORK, INNOVATIVE LEADERSHIP, AND DEDICATION TO A MORE SUSTAINABLE PLANET.

UH, WE HAVE THE GREENBERG, UH, NATURE CENTER AND THE TOWN OF GREENBERG WILL ALWAYS BE GRATEFUL TO BILL FOR HIS EFFORTS.

HE LEFT A LEGACY THAT WILL BE REMEMBERED, UM, BY, UM, PEOPLE FOR GENERATIONS TO COME.

AND WE ALSO HAVE, UM, A MOMENT OF SILENCE IN MEMORY OF JIM BRENNAN, WHO'S A LIFELONG RESIDENT OF THE VILLAGE OF IRVINGTON, WHO WAS DRAFTED IN THE ARMY IN 1966.

HE WAS A MEMBER OF THE IRVINGTON FIRE DEPARTMENT FOR 50 YEARS, AND SIX OF THEM AS CHIEF.

HE ALSO BELONGED TO THE IRVINGTON AMBULANCE CORPS FOR 23 YEARS AND RECEIVED A LIFETIME SAVING AWARD IN 2008.

HE SERVED AS RECREATION COMMISSIONER AND THE RECREATION DEPARTMENT FOR 20 PLUS YEARS, 18 AS CHAIR, AND HE SERVED, UH, ON THE VILLAGE VIETNAM VETERANS MEMORIAL COMMITTEE AND HELPED, UM, RESEARCH ALL THE NAMES HONORED THERE.

THE WALLS IN HIS HOME WERE FILLED WITH AWARDS THAT HE EARNED OVER THE YEARS.

AND FINALLY, WE HAVE A MOMENT OF BEFORE YOU GO ON.

YES.

UM, SADLY, WE FOUND OUT THIS AFTERNOON THAT WE LOST PATSY ELLO.

HE DIED PEACEFULLY TODAY SURROUNDED BY FAMILY.

PATSY RETIRED AS A GENERAL FOREMAN FOR THE HIGHWAY DEPARTMENT IN 2003 AFTER A 37 YEAR CAREER.

AFTER HE RETIRED.

HE WORKED FOR ABOUT FIVE YEARS, UH, AFTER HE RETIRED FROM THE HIGHWAY DEPARTMENT, AND HE WAS A PART-TIME DRIVER FOR THE NUTRITION PRO DEPARTMENT, DELIVERING MEALS FOR SENIOR CITIZENS.

UM, HIS TWO SONS, MIKE AND GARY ELLO, PRESENTLY BOTH WORK FOR D P W, MIKE FOR THE WATER DEPARTMENT, AND GARY FOR THE HIGHWAY DEPARTMENT.

THANK YOU.

LAST ONE, AND A MEMORY OF THE PEOPLE IN UKRAINE KILLED DURING RUSSIA'S INVASION, A RELENTLESS, INTENTIONAL, TARGETED BOMBING OF CIVILIANS IN APARTMENT BUILDINGS, HOSPITALS, TRAIN STATION SCHOOLS, AND CHILDREN'S CENTERS, DELIBERATING TARGETING UTILITIES USED BY CIVILIANS TO LEAD THEM WITHOUT ELECTRICITY AND HEAT THROUGH THE BRUTAL WINTER WEATHER WITH MASS GRAVES BEING FOUND AFTER INVADED.

SO WE CAN MAKE PEDESTRIANS, UM, SAFER WHEN WALKING MANY PEOPLE, UH, AT NIGHT.

YOU KNOW, WHEN YOU'RE DRIVING, YOU MAY SEE SOMEBODY WALKING ON THE ROAD AND YOU CAN'T SEE THEM.

UM, AND WE'VE HAD PEDESTRIAN ACCIDENTS AND FATALITIES OVER THE YEARS.

SO THE GOAL IS TO KEEP PEOPLE SAFE.

AND, UM, THESE HOSPITALS ARE, UM, UM, INSTEAD OF TRYING TO GET MORE BUSINESS, UH, THEY'RE TRYING TO GET LESS BUSINESS BY KEEPING PEOPLE HEALTHY AND, AND, AND, YOU KNOW, AND SAFE.

AND, UM, I'D JUST LIKE TO ASK THE POLICE CHIEF TO SAY A FEW WORDS BECAUSE THEY'RE DOING SOMETHING THAT'S REALLY VERY EXCITING.

AND THEN WE WILL HONOR THE HOSPITALS.

I KNOW I'M WALKING UP HERE WITH A LOT OF PAPER, BUT I WILL BE BRIEF.

SEVERAL YEARS AGO, THE GREENBERG POLICE DEPARTMENT STARTED THE WALK SAFE GREENBERG CAMPAIGN, UM, WHICH WAS AN EFFORT TO INCREASE PEDESTRIAN SAFETY AWARENESS.

UM, WHAT THE DEPARTMENT DID WAS WE STARTED TO SECURE REFLECTIVE BRACELETS AND DISTRIBUTE THEM TO SOME OF THE SCHOOLS IN GREENBURG.

THE, UM, OUR BC IN GREENBURG CAMPAIGN IS A CONTINUATION OF WALK SAFE, AND WE'VE PARTNERED WITH SEVERAL AREA HOSPITALS FOR DONATIONS OF REFLECTIVE BRACELETS AND BANDS, WHICH ARE TRAFFIC UNIT AND COMMUNITY POLICE OFFICERS HAVE BEEN GIVING OUT AT OUR LOCAL SCHOOLS.

WE'LL ALSO BE SUPPLYING THEM TO OUR PATROL OFFICERS SO THAT THEY CAN OFFER THEM THE RESIDENCE WHEN THEY SEE THEM OUT WALKING, EITHER EARLY IN THE MORNING OR LATE AT NIGHT AT DAWN, OR AT DUSK, UM, WALKING IN LOW LIGHT.

SO, I WOULD LIKE TO TAKE THIS OPPORTUNITY TO THANK THE WESTCHESTER MEDICAL CENTER, WHITE PLAINS HOSPITAL, AND PHELPS NORTHWELL HEALTH FOR THEIR DONATIONS, THEIR CONTRIBUTIONS, THEIR ENERGY, AND, UM, JUST HELPING THIS PROGRAM WORK.

SHE MIGRATED TO THE UNITED STATES FROM THE ISLAND OF JAMAICA.

SHE SETTLED IN ELMSFORD IN THE TOWN OF GREENBURG WITH HER HUSBAND AND FIVE SONS.

SHE HAS 22 GRANDCHILDREN, 15 GREAT, UH, GRANDCHILDREN, AND THREE GREAT, UM, GREAT-GRANDCHILDREN.

UM, SO GONE, BUT NOT FORGOTTEN.

ON SEPTEMBER 11TH, IVY, UH, DARLING LOST HER GRANDDAUGHTER, ELIZABETH AND DARLING, IN THE ATTACK ON THE WORLD TRADE CENTER.

SHE EXPERIENCED FURTHER GRIEF ON SEPTEMBER 4TH WHEN HER SON, PASTOR EARL DOUGLAS DARLING PASSED AWAY.

COMING FROM A HUMBLE BEGINNING, SHE WORKED HER WAY UP, UH, TO BEING AN ASSISTANT DIETICIAN.

SHE EXCELLED AND ACHIEVED HER L P N AND OBTAINED HER BACHELOR'S DEGREE FROM MERCY COLLEGE.

IN DOBBS FERRY, SHE BECAME A REGISTERED NURSE FOR NUMEROUS YEARS.

SHE EMBODIED A COMMITMENT TO SERVICE OVER FOUR DECADES AGO.

SHE WAS INSTRUMENTAL IN INITIATING THE FIRST F W P FOOD PANTRY, ALONG WITH OTHER MEMBERS.

SHE WAS VERY COMPASSIONATE.

AND FOR 20 YEARS, SHE CARED FOR TWO VETERANS FROM THE VA MEDICAL CENTER, MONTROSE CAMPUS.

WHEN THEY PASSED AWAY, SHE RECEIVED A CITATION FROM WASHINGTON D C THANKING HER FOR ADMINISTERING THE BEST CARE TO THESE VETERANS.

IVY IS A POET.

SHE'S AN AUTHOR, SHE'S A SONGWRITER.

SHE HAS WRITTEN MANY POEMS, UH, WHICH SHE IS STILL ABLE TO RECITE FROM MEMORY.

AND ON JUNE 9TH, 2011, SHE PUBLISHED BEAUTIFUL SPRING, A REMARKABLE SONGBOOK ABOUT LIFE.

SHE ALSO WROTE AND PUBLISHED THE PRINCIPLES OF HOMESCHOOLING A HANDBOOK FOR HOMESCHOOLING ON DECEMBER 23RD, 2021.

IVY DARLING WAS HOMESCHOOLED UNTIL AGE SEVEN BY HER GRANDPARENTS, WHO TEACHERS, AND SHE COMPILED THIS BOOK FOR CHILDREN WITH THE HOMESCHOOL PRINCIPLES THAT SHE LEARNED.

SHE IS THE OLDEST MEMBER OF THE FIRST SEVENTH DAY AT ADVENTIST CHURCH IN WHITE PLAINS.

IT'S LOCATED IN GREENBURG, AND THEY ARE PROUD TO HAVE A, UM, 10 IN THE MIDST AND ATTRIBUTE HER LONGEVITY TO HER HEALTH PRACTICES AND HER CONSTANT THANKS AND PRAISE TO GOD.

BUT AS A RESULT OF THAT EFFORT, UH, THE COUNCILMAN ORGANIZED A PETITION EFFORT AND, UH, THAT HAWK LIGHT WILL BE OPERATIONAL, UM, WITHIN THE NEXT, UM, COUPLE WEEKS.

SO, ALRIGHT.

UH, COUNCILMAN, YOU WANT TO TELL EVERYBODY A LITTLE BIT ABOUT THE, UH, THE HAWK LIGHTEN HOWER WORKS.

SO, THIS, THIS WAS, UH, INITIATED BY UNFORTUNATELY, UH, A SCHOOL CHILD, ACTUALLY TWO, UH, AT THE SACRED HEART CHURCH WHO WAS CROSSING THE STREET, AND ONE WAS HIT BY A CAR THROWN OVER THE CAR AND WAS SERIOUSLY INJURED.

AND IT'S A VERY DANGEROUS CROSSWALK, FROM WHAT I UNDERSTAND, FROM DOING A LITTLE BIT OF HISTORY.

IT WAS, THE CROSSWALK WAS ACTUALLY PUT THERE SO THAT THE RESIDENTS COULD GO ACROSS TO THE NATIONALLY FAMOUS PET CEMETERY.

AND THE CHURCH JUST HAPPENED TO ENJOY THE BENEFIT OF IT.

AND THEN IT GOT USED MORE AND MORE AND MORE, AND THEY WOULD NOT GIVE US A REGULAR TRA TRAFFIC LIGHT 'CAUSE IT WAS TOO CLOSE TO FOUR CORNERS.

BUT THEY WOULD GIVE US WHAT'S A FLASHING YELLOW BEACON.

BUT FRANKLY, A YELLOW BEACON FOR SOME PEOPLE MEANS SPEED UP BEFORE IT TURNS RED.

SO THAT WASN'T ACCEPTABLE.

AND SO WE TOOK THE POSITION THAT EVEN THOUGH THAT'S WHAT THE STATE WAS WILLING TO GIVE US RIGHT AWAY, WITHOUT ANY QUESTIONS, WE DIDN'T WANT IT.

WE'D RATHER HAVE NO LIGHT THAN HAVE A YELLOW LIGHT THAN MAY CAUSE THE TRAFFIC TO SPEED UP AND JUST HIT SOMEBODY HARDER.

AND THE STATE HAS REALLY BEEN QUITE GOOD.

NOW, OF COURSE, WE HAD TO MEET ALL THE REQUIREMENTS AND THERE ARE MANY, WE HAD TO DEAL WITH THE PANDEMIC, AND WE KNOW HOW THAT WENT.

WE HAD TO DEAL WITH A SUPPLY SHORTAGE, AND WE KNOW HOW THAT WENT.

SO THIS ACTUALLY EFFORT STARTED WITH A PETITION DRIVE IN NOVEMBER OF 2019.

AND IF YOU REMEMBER, OF COURSE, THE PANDEMIC STARTED MARCH OF 2020.

IT WAS THE EASIEST PETITION TO GATHER SIGNATURES.

WE GATHERED OVER 800 SIGNATURES IN TWO DAYS, AND OVER THE COURSE OF THE WEEK, WE HAD OVER 2000 SIGNATURES.

NOW WE'RE GETTING WHAT'S KNOWN AS A HAWK LIGHT, RIGHT? HAWK LIGHT.

AND IT'S REALLY STRAINED HOW YOU GET THE ACRONYM OF HAWK.

IT LOOKS LIKE A HAWK A BIT BECAUSE OF THE ARMS THAT ARE BE GOING TO BE STICKING OUT.

BUT IT'S REALLY A HIGH INTENSITY, UM, ACTIVATED CROSSWALK.

AND IF YOU FIGURE OUT THE H A C K ALL SPREAD OUT THROUGH THOSE WORDS, YOU GET HAWK, IT'S A, IT'S A STRETCH.

IT'S A STRETCH, BUT IT'S SOMETHING THAT HAS NEVER BEEN DONE IN THE TOWN OF GREENBURG.

IT WASN'T DONE IN WESTCHESTER, BUT THERE IS NOW ONE IN WHITE PLAINS.

AND PART OF THE AGREEMENT FOR THEM TO PUT THIS IN IS THAT WE WOULD EDUCATE THE PUBLIC ABOUT THIS TRAFFIC LIGHT THAT HAS NO GREEN LIGHT, RIGHT? HAS NO GREEN LIGHT.

NOW THAT DOESN'T MEAN THAT YOU'LL ALWAYS HAVE TO BE STOPPED, RIGHT? THERE'S GOTTA BE ANOTHER WAY.

SO ARE WE JUST PLAYING IT? ALRIGHT, IF YOU CAN, UH, SCROLL DOWN TO THE TOP OF PAGE TWO AND THEN BLOW IT UP IF YOU CAN.

AS MUCH AS YOU CAN GO SIDE TO SIDE ON THE PAGE.

SO IF YOU'RE LOOKING A LITTLE MORE, THAT'D BE GREAT.

SO THIS IS WHAT IT'S GONNA LOOK LIKE ON EACH SIDE OF THE STREET.

NOW, WHAT'S THE ADVANTAGE OF A HAWK LIGHT OVER WHAT'S CALLED A RECTANGULAR RAPID, UM, FLASHING BEACON, WHICH IS THE YELLOW LIGHT, BUT THAT FLASHES, THIS HAS AN ARM THAT GOES DIRECTLY OUT OVER TRAFFIC.

HOW DID THE CHILD GET HIT? THERE WAS A TANDEM BUS COMING DOWN IN THE RIGHT LANE, AND THE CHILDREN COULD, UH, THE, UH, DRIVER IN THE CENTER LANE COULD NOT SEE THAT THERE WAS A CHILD COMING OUT.

AND THAT WAS, THAT WAS A REAL TRAGEDY.

AND IT, AND UNFORTUNATELY IT'S ON VIDEO, SO IT MAKES IT EVEN HARDER TO WATCH.

THIS TAKES CARE OF THAT PROBLEM.

'CAUSE THE ARM COMES OUT AND YOU HAVE A TRAFFIC LIGHT OVER BOTH LANES ON CENTRAL AVENUE.

AS YOU KNOW, THERE ARE TWO LANES GOING NORTH, TWO LANES GOING SOUTH.

AND SO THIS ADDRESSES THAT PROBLEM, WHICH IS A MAJOR ISSUE FOR US.

BUT THERE'S NO GREEN LIGHT.

SO HOW DOES THIS WORK? AND THIS IS PART OF OUR EDUCATION OUTREACH, RIGHT? IS WHEN NOBODY PUSHES THE BUTTON AT THE CROSSWALK, THIS THING GOES ENTIRELY DARK.

SO YOU DON'T STOP.

THERE'S NOTHING TO TELL YOU, HEY, SLOW DOWN.

IT'S TOTALLY DARK.

ONCE SOMEBODY PRESSES THE CROSSWALK BUTTON, IF YOU CAN SCROLL DOWN JUST A LITTLE BIT, AARON, PLEASE.

YOU'LL SEE ON THE LEFT IS WHAT THE DRIVERS WILL SEE.

AND ON THE RIGHT, WHAT THE PEDESTRIANS WILL SEE AT THE CROSSWALK.

'CAUSE ONCE IT'S INSTALLED, UH, WE, WE NEED AS MANY PEOPLE TO KNOW AS POSSIBLE.

SO IF YOU LOOK, WHEN YOU ARE AT THE PEDESTRIAN SIDE AND YOU HAVE A HAND UP, OBVIOUSLY THAT MEANS DON'T CROSSWALK.

DON'T CROSS THE WALK, RIGHT? WE ALL KNOW THAT.

SO WHAT DO THE DRIVERS SEE? THEY SEE NOTHING.

THEY SEE A DARK LIGHT.

ONCE THE BUTTON IS PUSHED, YOU THEN GET A FLASHING YELLOW LIGHT.

WHAT DOES THE PEDESTRIAN DO? YOU WAIT.

BECAUSE YELLOW DOES NOT MEAN TO CROSS.

IT MEANS CAUTION.

AFTER A PERIOD OF TIME, THE FLASHING YELLOW LIGHT WILL GO SOLID YELLOW.

WHAT DOES THE PEDESTRIAN DO? YOU WAIT.

BECAUSE YELLOW STILL COULD MEAN SPEED UP TO GET THROUGH THIS THING.

BUT WE HAD TOWN OFFICIALS THERE, WE HAD THE POLICE THERE, WE HAD D O T THERE.

IT'S JUST A VERY TREACHEROUS AREA.

AT SOME POINT, GENERALLY BY THE TIME YOU GET ACROSS THE, THE, UH, STREET, THE RED LIGHTS ARE GONNA START TO FLASH.

AT THAT POINT, IF YOU'RE WAITING TO CROSS THE STREET, YOU HAVE TO WAIT.

THAT IS FOR THE PEOPLE ALREADY IN THE STREET TO GET TO THE OTHER SIDE.

IT'S NOT ENOUGH TIME FOR YOU TO START.

UM, AND, UH, THE QUESTION WAS WHETHER IT SHOULD EXPLICITLY INCLUDE, UH, RENTAL CONVERSIONS TO CONDOMINIUM.

UH, THE FIRST ISSUE WAS, UH, THAT THE FACT THAT THIS LOCAL LAW DOESN'T, UH, EXPLICITLY ADDRESS, UH, CONDO CONVERSIONS FROM RENTAL UNITS.

SO IN REGARDS TO THE FIRST QUESTION, WITH RENTALS BEING CONVERTED TO CONDOMINIUMS, WE DO HAVE ANOTHER

LAW IN REGARDS TO CONVERTED CONDOMINIUMS, TOWN CODE FOUR 40 DASH 82, WHICH ADDRESSES THIS ISSUE.

AND WE MAY WANT TO AMEND THAT LAW TO MEET THE REQUIREMENTS THAT YOU JUST SAID ABOUT A RENTAL BEING CONVERTED TO A CONDOMINIUM.

I WOULD, I WOULD SAY THAT THE CURRENT LAW IS IN REGARDS TO NEWLY CREATED CONDOMINIUMS ARE COOPERATIVE.

SO IT DOESN'T HAVE AN EFFECT ON THIS LAW, BUT BOTH THE TOWN CODE THAT HAS ALREADY BEEN APPROVED AND THE TOWN CODE BEING CONSIDERED TONIGHT, BOTH USE THE EXACT WORDING THAT'S ALLOWED BY THE STATE UNDER HOME RULE, UH, LAWS.

AND WERE, THE TOWN IS ATTEMPTING TO, UH, COMPLY WITH THE STATE'S VERBIAGE.

AND AT THIS POINT, I DON'T THINK WE CAN MAKE ANY FURTHER AMENDMENTS UNLESS GOING BACK TO THE STATE, IF ANY AMENDMENTS ARE NEEDED AT THIS POINT, I WOULD RECOMMEND CHANGING FOUR 40 DASH 82, WHICH SPECIFICALLY DEALS WITH CONVERTED UNITS.

UM, THE CREATION OF, OF, OF SOME TAX EQUITY BETWEEN THE CO-OPS AND THE, AND THE CONDO OWNERSHIP AND THE SINGLE FAMILY OWNERS IS LONG OVERDUE.

UM, ALSO, I'M GLAD TO SEE THAT.

WELL, YOU ADDRESSED THE LOOPHOLE OF, OF HOUSES THAT, UH, THAT, UH, OF, UH, RENTALS THAT MIGHT BE CONVERTED MM-HMM.

, SO I'M GONNA SKIP THAT PART.

UM, THEY, UM, TAX FAIRNESS SHOULD, SHOULD ALWAYS BE THE PRI THE PRIMARY GOAL OF THE BOARD.

UM, SOMEHOW I THINK I FELL THROUGH THE CRACKS.

I, I FIRST PRESENTED TO THE VILLAGE OF HASTINGS FOR A ZONE CHANGE IN NOVEMBER OF 2021.

I RECEIVED THAT ZONE CHANGE JUST RECENTLY IN MARCH OF 2023.

MORE IMPORTANTLY, AS PART OF THE C Q R REQUIREMENTS THAT I KNOW YOU'RE AWARE OF WITH THE HASTINGS PLANNING BOARD.

ONE OF THE IMPACTS, POTENTIAL NEGATIVE IMPACTS THEY STUDIED WAS FISCAL AT THE TIME, KNOWING NOTHING ABOUT, UH, ANY GREENBERG PROPOSED RESOLUTION.

THIS WAS NOW OCTOBER OF 22.

I MADE A PRESENTATION TO THE HASTINGS PLANNING BOARD TO SATISFY MY C REQUIREMENTS.

AND WHAT I DID WAS I LOOKED AT, UH, ALL OF THE CONDOMINIUMS AND MANY I COULD IN HASTINGS TO SEE WHAT THE TAXES WERE.

FOR EXAMPLE, UH, A CONDOMINIUM ON, I THINK IT WAS OLD SPRAIN ROAD, WAS SELLING FOR $1.2 MILLION TAX BILL, ALL TAXING JURISDICTIONS OF $21,000.

SO AT THE TIME, I THOUGHT I WAS DOING THE RIGHT THING, AND SO DID THE PLANNING BOARD.

I TOOK MY UNITS AND I MULTIPLIED THEM BY 21,000.

YOU SHOULD KNOW, BY THE WAY, THREE OF MY 20 UNIT PROJECTS IN GREENBURG ARE AFFORDABLE.

HASTINGS HAS A 15% SET ASIDE, UH, NOT 10, THERE'S TAXES AT THE END OF 2021.

ALL TAXING DISTRICTS AS ASSESSED BY GREENBERG, WAS SOMEWHERE BETWEEN 88, 80 9,000.

I PROPOSED TO INCREASE THOSE TAXES, TAXES TO ALMOST $400,000.

I AND WHOLE PREMISE OF THE PROJECT IS THAT PEOPLE HAVE LIVED IN SOME OF THE RIVER TOWNS IN GREENBURG FOR A LONG TIME.

THEY NO LONGER NEED THOSE SCHOOL DISTRICTS.

YOU HAVE MANY, YOU KNOW, THEM GREAT SCHOOL DISTRICTS WITHIN YOUR TOWN.

YOU HAVE MANY PEOPLE THAT HAVE LIVED HERE 30, 40 YEARS.

THE KIDS HAVE LONG GONE, BUT THEY HAVE A DESIRE TO STAY HERE.

GREENBERG AND CENTRAL WESTCHESTER, YOU KNOW THAT IT'S A GREAT PLACE TO LIVE.

I THINK THE LURE OF CONDOMINIUMS IS WHAT YOU'RE ABOUT TO ERADICATE.

THERE ARE LOTS AND LOTS OF PEOPLE WHO GREW UP IN THE RIVER TOWNS, FOR EXAMPLE, OTHER PARTS OF GREENBURG WHO NOW PAY TAXES IN THE MID AND HIGH THIRTIES, THOUSANDS.

THAT'S OKAY BECAUSE MOST OF THAT MONEY, AS YOU ALL KNOW, GOES TO THE SCHOOL DISTRICT.

THE EDUCATION THAT CHILDREN GOT WAS THE SACRIFICE THOSE PEOPLE MADE.

NOW THEY'RE MY AGE, MAYBE A FEW YEARS YOUNGER THAN ME, MID SIXTIES, PEAK EARNING POWER HAS GREATLY DIMINISHED.

NOW THEY HAVE THE EQUITY TO BUY A CONDO FROM ME, A MILLION DOLLAR CONDO IN HASTINGS USING THE MONEY FROM THEIR EXISTING HOUSE.

WHAT THEY DON'T HAVE IS LOTS OF DISPOSABLE MONTHLY INCOME.

'CAUSE THEY DON'T MAKE A LOT OF MONEY ANYMORE.

SO MY LURE TO THEM HAD BEEN, COME TO LIVE IN HASTINGS, STAY IN GREENBURG, SELL YOU A MILLION DOLLAR HOUSE THAT'S APPRECIATED, HUNDREDS OF THOUSANDS OVER THE YEARS WHILE YOU PUTTING THE KIDS TO SCHOOL.

BUY A HOUSE FOR ME AND YOUR TAXES ARE GONNA BE 20, 21, 20 2000 AS OPPOSED TO 35, 30 7,000 THAT I THINK WILL HAPPEN NOW.

UM, YOU KNOW, REAL ESTATE HAS TWO MAJOR RULES.

LOCATION, LOCATION, LOCATION AND CAVEAT MTOR, BUYER BEWARE, WHERE MY LOCATION IS.

GREAT.

IT'S IN HASTINGS, IN THE TOWN OF GREENBURG ON THE HUDSON RIVER WITH A VIEW OF THE PALISADES.

UH, I'VE ALREADY SPOKEN TO YOU GUYS AT THE FIRST PUBLIC HEARING ON THIS TOPIC, WHICH, UH, FEELS LIKE MONTHS AGO AT THIS POINT ABOUT WHAT I THINK THE NEGATIVE IMPACTS THIS WILL HAVE ON INCREASING ACCESS TO MODERATELY PRICED HOUSING IN THE MIDST OF AN INCREASINGLY EXPENSIVE HOUSING ENVIRONMENT AND THE IMPACT IT WILL HAVE ON REDIRECTING INVESTMENT AND DEVELOPMENT AWAY FROM GREENBURG.

AS A REMINDER, THIS LEGISLATION IS FOR GREENBURG AND ITS VILLAGES ONLY.

NO OTHER PART OF NEW YORK STATE IS BEING IMPACTED BY THE RECENT LAW BECAUSE GOVERNOR HACKEL VETOED A BASICALLY EXACT SAME VERSION FOR A STATEWIDE BILL.

AND HER REASONING FOR DOING SO WAS SOUND AND DIRECT.

SHE SAID THIS BILL WOULD RESULT IN AN EFFECTIVE TAX INCREASE UPON NEWLY CONSTRUCTED HOUSING BUILT AS CONDOMINIUMS IN JURISDICTIONS THAT CHANGE THEIR ASSESSMENT, WHICH WOULD MAKE THIS HOUSING LESS ATTRACTIVE TO POTENTIAL HOMEOWNERS AND ULTIMATELY LEAD TO FEWER UNITS OF HOUSING BEING BUILT.

PAUL IS RECUSING HIMSELF IN THIS HEARING.

BUT EARLIER THIS WEEK, AS THE AFOREMENTIONED SPEAKER NOTED, HE HAD A LETTER TO THE EDITOR PUBLISHED IN THE NEW YORK TIMES WITH THE HEADLINE, BETTER WAYS FOR SUBURBS TO BUILD MORE HOUSING BY PUTTING IN AN EFFECTIVE TAX INCREASE ONLY IN GREENBURG, SOLELY DESIGNED TO TARGET NEW CON.

YOU DON'T NEED TO BE AN ECONOMICS MAJOR TO KNOW THAT YOU WILL GET EXACTLY THE OPPOSITE OF THAT.

MANY OF YOU HAVE BEEN ON THE TOWN BOARD FOR OVER A DECADE, BUT WHILE WE'VE BEEN BUSY INCREASING TAXES ON DEVELOPMENTS THAT DON'T EXIST YET AND SCHEDULING PUBLIC HEARINGS ON DOG BREEDERS AND LEGISLATING OVER LEAF BLOWERS, WE STILL HAVE NO LEGISLATION THAT WOULD MANDATE AFFORDABLE HOUSING IN NEW SINGLE FAMILY HOME DEVELOPMENTS.

THIS BILL, EVEN IF YOU DISAGREE WITH EVERYTHING I JUST SAID, IS INHERENTLY FLAWED.

IT ADDRESS IGNORES THE MAJOR LOOPHOLE OF RENTAL TO CONDO CONVERSIONS.

AND I KNOW THAT THE, UH, INTERIM AND SOON TO BE, UH, FULL-TIME CONGRATULATIONS TOWN ATTORNEY, UH, OPINED ON THAT.

GREENBERG IS FORTUNATE IN THAT WE HAVE, ODDLY ENOUGH IN EDGEMONT THE FORD AND CHEVROLET DEALER, AND IN FAIRVIEW WE HAVE THE TESLA AND B M W DEALER, BUT NEVERTHELESS, WE HAVE AN OPPORTUNITY TO CHOOSE THE SELLING PRICES OF THOSE VEHICLES VARY.

OBVIOUSLY, TYPICAL CHEVROLET IS NOT GONNA SELL FOR WHAT A TYPICAL B M W IS GOING TO SELL FOR.

SO THE QUESTION IS, IS A B M W AND A CHEVROLET THE SAME RIDE? NO.

WHAT YOU HAVE IN A CONDOMINIUM DEVELOPMENT IS A DUMPSTER.

DO MANY SINGLE FAMILY HOMES HAVE DUMPSTERS ON THEIR PROPERTY? WHAT YOU HAVE IN A CONDOMINIUM DEVELOPMENT IS A PARKING PAVED PARKING AREA WITH NUMBERED SPACES.

IS THAT THE EQUIVALENT OF WHAT YOU HAVE IN A SINGLE FAMILY HOME? THERE ARE MANY OTHER REASONS WHICH SUGGEST THAT EVEN THOUGH THE MARKET VALUE MAY GO FOR A CERTAIN AMOUNT OF DOLLARS, THE LIFESTYLE OF LIVING IN A CONDOMINIUM UNIT IS NOT THE LIFESTYLE OF LIVING IN A SINGLE FAMILY HOME.

SO WHY ARE WE TAXING THEM THE SAME? THE OTHER ASPECT OF IT IS, GEE, THIS IS GREAT FOR POLITICS AND GREAT FOR ALL THE 4,500 UNITS WHICH ALREADY EXIST, WHICH CAN CONTINUE TO PAY LOWER TAXES.

THIS IS NOT AN ISSUE SO MUCH ABOUT WHAT THE RETAIL SALES VALUE MAY BE OF A PRE 2023 UNIT VERSUS A POST 2023 UNIT.

BUT FOR ALL THE YEARS OF OCCUPANCY BY THOSE OWNERS OF THE 4,500 UNITS, THEY WILL BE PAYING LESS IN TAXES.

AND THAT'S THE BENEFIT THAT THEY'RE GETTING.

IF YOU WANTED TO DO THIS FAIRLY, YOU HAD OPTIONS, ONE, MAKE IT RETROACTIVE, BUT THAT WOULD BE POLITICALLY NOT ABLE TO HAPPEN, OF COURSE.

BUT YOU HAVE OTHER OPTIONS ON HOW TO DELIVER THIS END PRODUCT IF THE REASON FOR DOING SO WAS REALLY TO CREATE REVENUE.

AND AMONG THOSE OPTIONS ARE ONLY DEAL WITH CONDOMINIUMS WHICH SELL FOR A CERTAIN PRICE, SAY $750,000 MIGHT BE AFFECTED UNDER A NEW LAW.

WHAT ABOUT GIVING A LONGER PERIOD OF TIME TO BREAK THE LAW IN? THERE ARE PEOPLE WHO HAVE INVESTMENTS IN LAND NOW WITH THE INTENTION OF DEVELOPING THEM AS CONDOS, BUT WILL BE FROZEN OUT.

SO GIVE THEM FOUR YEARS BEFORE THIS LAW TAKES EFFECT.

ANOTHER OPPORTUNITY IS TO HAVE A TAX INCREASE, BUT TO BRING IT IN IN STEPS SO MUCH A YEAR OVER, SAY A FIVE YEAR PERIOD BETWEEN WHAT IS CURRENTLY BEING PAID BY THOSE CURRENT OWNERS AND WHAT THEY WOULD PAY BASED UPON IF THE THE NEW UNIT WAS BUILT IN 2023.

UPON REFERRAL FROM THE TOWN BOARD, THE PLANNING BOARD REVIEWED THE APPLICANT'S REQUEST, AND ON MARCH 1ST, 2023 ISSUED A POSITIVE RECOMMENDATION BACK TO THE TOWN BOARD.

THE PLANNING BOARD IS PART OF ITS RECOMMENDATION, RECOMMENDED THAT THE PETITION BE MODIFIED TO REFLECT THAT THE ALTERNATIVE TRANSPORTATION PROVIDED TO THE WILDWOOD RESIDENCE BE DONE.

SO AT NO ADDITIONAL COST TO ANY SUCH RESIDENTS THAT TAKE ADVANTAGE OF THE SERVICE.

UM, AS WAS INDICATED, THE COMMUNITY IS AN 86 UNIT CONDOMINIUM COMPLEX THAT PURSUANT TO ITS ORIGINAL DECLARATION, WAS REQUIRED TO PROVIDE A JITNEY SERVICE IN THE MORNINGS AND EVENINGS, UH, FOR TRANSPORTATION TO THE SELECTED TRAIN STATION.

THE COMMUNITY PROVIDED THAT SERVICE TO ALL ITS RESIDENTS UP THROUGH AND INCLUDING THE PANDEMIC.

BUT WHEN THE PANDEMIC BEGAN, THE SERVICE WAS DISCONTINUED BECAUSE, NUMBER ONE, THE COMMUNITY DIDN'T REQUIRE IT ANYMORE.

NO ONE WAS TRAVELING INTO THE CITY.

AND NUMBER TWO, UH, THE PROVIDER WHO DID PROVIDE THAT SERVICE PREVIOUSLY FOR MANY YEARS CEASED PROVIDING THAT SERVICE.

UH, WHEN PEOPLE STARTED TO RETURN TO WORK, THE COMMUNITY LOOKED AT RESUMING THAT SERVICE.

THEY FOUND IT TO BE COST PROHIBITIVELY EXPENSIVE.

UH, THAT SERVICE COST, I WANNA SAY FOUR TIMES.

THE, THE PRE PANDEMIC COST IS WHAT IT WAS GOING TO BE COSTING TO PROVIDE THAT SERVICE ON A GOING FORWARD BASIS.

UM, SO WHAT WE'RE COMING TO THE BOARD TO REQUEST IS A MODIFICATION TO THE SET OF RECORDED DOCUMENTS TO ALLOW US TO PROVIDE SERVICE TO OUR RESIDENTS ON AN AS NEEDED BASIS.

INSTEAD OF PROVIDING A CONTINUOUS SHUTTLE, UH, IN THE MORNINGS, IN THE AFTERNOONS TO SELECT TRAIN STATIONS.

UH, IT'S BEING DONE SO FOR ECONOMIC REASONS TO SAVE THE COMMUNITY MONEY, BUT ALSO, UH, FOR ENVIRONMENTAL PURPOSES.

WE DON'T NEED TO RUN A PASSENGER SHUTTLE WHEN NO ONE'S USING IT AND WE DON'T NEED TO PAY FOR IT.

UH, OUR PROPOSAL THAT WE SUBMITTED WAS VERY SPECIFIC IN LANGUAGE THAT WOULD ALLOW US TO PROVIDE IT IN THE WAY THAT THE BOARD OF MANAGERS OF THE COMMUNITY SELECTED.

THAT BOARD OF MANAGERS IS ELECTED BY THE COMMUNITY SUCH AS YOURSELVES IN THE SENSE THAT THEY'RE ELECTED BY THEIR CONSTITUENTS.

SO IF THE COMMUNITY'S NOT HAPPY WITH THE LEVEL OF SERVICE IS BEING PROVIDED AND NOT HAPPY WITH THE BOARD IN MAKING A DECISION AS TO HOW TO PROVIDE THAT SERVICE, WELL, THE COMMUNITY CAN BRING ON A NEW BOARD AND MODIFY THE SERVICE TO BE PROVIDED.

WHAT WE'RE DOING IN PRESENTING THE LANGUAGE IS TRYING TO AVOID HAVING, HAVING TO DO THIS PROCESS OVER AGAIN.

IF WE LIMITED THE SERVICE TO, LET'S SAY, CAB SERVICE, AND LATER ON WE WANNA RESUME SHUTTLE SERVICE, WE WOULD ACTUALLY HAVE TO COME BACK BEFORE YOU, WHEREAS OUR LANGUAGE IS PRESENTED IS IN SUCH A WAY THAT PROVIDES THE BOARD THE RIGHT TO MAKE THOSE CHANGES.

THEIR, THEIR COST OF LIVING IN THE CONDO WILL BE, YOU KNOW, LESS EXPENSIVE, POSSIBLY, CORRECT? WELL, WE'RE NOT PROVIDING IT RIGHT NOW BECAUSE THE COST TO DO THE EXACT JITNEY SERVICE WOULD BE PROHIBITIVELY EXPENSIVE.

WE ARE PROVIDING THE RESIDENTS WITH TRANSPORTATION AS AN ONGOING BASIS, JUST LIKE AS WE ARE PLANNING ON DOING.

WE HAVE TO GIVE THEM THE CHANCE TO COME UP WITH A NEW WAY OF DOING IT.

THAT IS ENVIRONMENTALLY SOUND, WHICH MEANS MAKING A RESERVATION OR SHARING ONE VEHICLE AS NEEDED TO A FACILITY LIKE UBER OR SOMETHING LIKE IT.

NEW YORK CITY IS MOVING FROM YELLOW CABS TO AN ON-DEMAND SERVICE THROUGHOUT THE INDUSTRY.

THE CONCEPT OF A HAIL CAB DRIVING AROUND THE NEW YORK CITY WILL END WITHIN THE NEXT FEW YEARS.

THAT'S RATHER SOMETHING THAT I WOULD NEVER HAVE IMAGINED TO HAPPEN.

YOU KNOW, I, I WOULD HATE TO HAVE TO COME AND SPEND TIME BEFORE THIS BOARD WHEN WE ARE DEALING WITH SUCH A SMALL MICROCOSM OF THE COMMUNITY, WHEN THE COMMUNITY ALREADY HAS A DEMOCRATIC PROCESS IN PLACE TO MAKE SURE THAT THE SERVICES THAT THEY WANT ARE BEING PROVIDED TO THEM AND THEIR NEIGHBORS.

SO AT THE INCEPTION, AND BY THE WAY, THIS SERVICE WASN'T REQUIRED TO BE PROVIDED UNTIL HALF THE UNITS WERE BUILT.

UM, AT THE INCEPTION, YOU HAD ONE DEVELOPER WHO CONTROLLED THAT BOARD, IF THAT DEVELOPER ELECTED TO, RIGHT? THAT DEVELOPER COULD HAVE BUILT ALL 86 UNITS AND RENTED ALL 86 UNITS AND RUN A RENTAL COMMUNITY.

AND THEY WOULD'VE CONTROLLED THE BOARD AND THEREFORE COULD HAVE ELECTED IN THEIR OWN ACCORD NOT TO PROVIDE THE SERVICE.

IF THE LANGUAGE THAT WE HAD EXISTED THEN.

NOW THE COMMUNITY IS ENTIRELY SOLD, MADE UP OF 86 DIFFERENT INDIVIDUALS, EACH ONE OF WHOM HAS A SAY AND A VOTE IN THE CONTROL OF THE BOARD.

SO I UNDERSTAND YOUR POINT ENTIRELY, BUT THE DIFFERENTIAL BETWEEN THEN AND NOW IS THEN YOU HAD ONE PERSON WHO CONTROLLED EVERYTHING BECAUSE THEY WERE DEVELOPING IT.

AND NOW WE HAVE 86 PEOPLE WHO, IF ANY OF THEM ARE UPSET, HAVE THE ABILITY TO VOICE THEIR CONCERN WITHIN THEIR COMMUNITY.

RIGHT.

AND SO YOU ARE STATING THAT THE MAJORITY OF THE PEOPLE DON'T USE THIS KIDNEY SERVICE AT ALL.

THAT'S SO HAVING 86 PEOPLE VOTING, YOU'RE NOT TAKING CARE OF THE, YOU'RE NOT, YOU'RE NOT TAKING CARE OF THE MINORITY.

WE HAD TO GET A RECOMMENDATION.

IT WOULD THEN COME BACK TO US.

THERE SHOULD BE ONE FIRE CHIEF THAT COVERS THE ENTIRE DISTRICT.

HIS NAME IS MOSTLY THIS ONE POLICE CHIEF.

YOU TALK ABOUT SAVING A FEW DOLLARS ON A TAX RATE.

IT PALES AGAINST THE AMOUNT OF MONEY THAT WE PAY FOR FIRE.

THEY SEND THE ENGINES OUT JUST TO PUT THE MILEAGE ON THEM.

THEY SEND THE ENGINES TO THE FOOD STORE SO THEY CAN SAY WE HAD THAT MANY MILES.

MY HOME FOR OVER 50 YEARS IS A WONDERFUL COMMUNITY WITH A LONG HISTORY OF NEIGHBORHOODS WORKING TOGETHER IN HARMONY.

SO WHAT THIS INCORPORATION MEANS, ESPECIALLY TO US IN GREENBURG, UNINCORPORATED GREENBURG, I SHOULD SAY, THERE'S A LITTLE SECTION OF THIS BEAUTIFUL TOWN CALLED EDGEMONT WITH A POPULATION OF APPROXIMATELY 8,000 RESIDENTS, WHICH IS ABOUT 17% PROPOSED A NEW VILLAGE PO UH, POISE TO VOTE IN THE REFERENDUM ENABLED BY ARTICLE TWO SECTIONS TWO 16 OF NEW YORK STATE VILLAGE LAW WRITTEN OVER A HUNDRED YEARS AGO.

THIS LAW IS NOT IN SYNC WITH THE VISION AND THE ASPIRATIONS OF EQUALITY OF COMMUNITIES IN THE 21ST CENTURY AND SHOULD NOT BE THE SOLE CONSIDERATION INMAN'S PURSUIT TO BECOME A SEPARATE INCORPORATION INCORPORATED VILLAGE EDGEMAN SUCCESS.

SU SUCCESS, OF COURSE, WILL EXCLUDE THE VOTE OF APPROXIMATELY 48,000, WHICH IS ABOUT 83% OF UNINCORPORATED RESIDENTS.

AS NOTED BY MY COLLEAGUE, THE LOSS OF EDGEMONT 17 MILLION REVENUE WILL FORCE THE TOWN TO MAKE DRASTIC CHANGES.
