OKAY.[ TOWN OF GREENBURGH OFFICE OF THE TOWN BOARD 177 Hillside Avenue, Greenburgh, NY 10607 Tel: 914-989-1525 Fax: 914-993-1541 Email: JDudek@Greenburghny.com https://ny-greenburgh.civicplus.com/485/Watch-Live-Board-Meetings]
TODAY'S AUGUST 13TH, AND, UM, WELCOME TO OUR TOWN BOARD WORK SESSION.UH, THE FIRST ITEM THAT I'D LIKE TO DISCUSS IS JUST THE CAPITAL BUDGET, JUST AN, AN UPDATE WHERE WE ARE, UM, UH, WHEN THE TOWN WILL BE FOLLOWING UP WITH A BOND, YOU KNOW, RESOLUTIONS, UM, WHICH IS A REQUIREMENT BEFORE WE COULD ACTUALLY IMPLEMENT THE CAPITAL BUDGET THAT WE, UM, WE APPROVED.
AND, UM, UH, RICH, ARE THERE ANY, UM, IMPACTS TO NOT VOTING ON THIS, YOU KNOW, TOMORROW? UM, IN TERMS OF OUR ABILITY OF, UM, OF, OF DOING SOME OF THE NECESSARY INFRASTRUCTURE WORK THAT WAS APPROVED? AND I HAD A CONVERSATION WITH KIMBERLY EARLIER.
UM, I WANT TO POINT OUT THAT SHE'S CERTAINLY CROSSING HER T'S AND DOTTING UP LINES.
WE, UH, UNLIKE YEARS PAST, WE ARE REQUIRED TO PUT TOGETHER MAPPING AND GET AN ENGINEERING REPORT TOGETHER FOR THE, UH, SEWER IMPROVEMENTS THAT IS BEING WORKED ON.
I'M HAPPY TO ANNOUNCE FOR THE FIRST TIME IN ALMOST FOUR YEARS, THE TOWN'S ENGINEERING DEPARTMENT IS FULLY STAFFED.
UM, SO THAT MAPPING IS BEING WORKED ON.
I KNOW THAT IS HOLDING THINGS UP.
BUT AT THIS POINT, WE'RE MOVING FORWARD WITH THE PROJECTS WE HAVE.
RICH, RICH COMMISSIONER, COMMISSIONER FA.
UNFORTUNATELY, HERE, UM, IN, IN THE MAIN AUDITORIUM, WE'RE HAVING SOME TECHNICAL DIFFICULTIES.
YOU'RE COMING OUT VERY LOW, SO I'M NOT SURE IF YOU'RE PROJECTING OUT TO THE PUBLIC LOW.
SO WE HAVE, UM, OUR CABLE DIRECTOR RESOLVING IT.
SO IT MUST BE THE AUDITORY, YOU'RE JUST VERY LOW.
CAN WE DO A TESTING WITH, UM, ELLEN, ELLEN, COUNCILWOMAN HENDRICKS AND COUNCILMAN SHAHAN, PLEASE.
STARTING WITH COUNCILWOMAN HENDRICKS.
SO IT APPEARS THAT WHAT'S GOING OUT OR WHAT'S COMING INTO US, INTO THE MAIN ROOM, THAT IT IS VERY LOW.
SO WE'RE JUST HAVING, UM, THE CABLE DIRECTOR JUST ADJUSTING THAT BECAUSE WE WOULD LIKE TO HEAR EXACTLY WHAT YOU'RE SAYING.
UM, JOAN, LIKE THE FIRE, SHE MAY HAVE TO DO IT HERE.
IT MIGHT BE TURN SOMETHING DOWN.
I THINK WE TURNED THIS DOWN, BUT I MUTED THIS SO I DON'T WANT IT'S, I I PUT IT ON MUTE SO I DON'T WANT JUST TO GO ON.
AND THEN WE HAVE THAT THIS ISN'T ON YOU SEE THE LITTLE, SEE THE LITTLE THING THERE? WE TURNED IT ALL THE WAY DOWN.
BUT CAN YOU DO ANOTHER CHECK? 1, 2, 3 TESTING, UH, COUNCILWOMAN COUNCILWOMAN HENDRICKS TESTING.
CAN YOU HEAR ME NOW? THANK YOU SO MUCH.
WHAT ABOUT RICH? COULD, RICH COMMISSIONER VAUGHN, PLEASE? YES, CAN YOU? EXCELLENT.
COUNCILMAN FRAN, WE DOING ROLL? I KNEW YOU WANTED TO HEAR FROM ME.
THE PUBLIC SAYS, THANK YOU VERY MUCH.
SO, UH, COMMISSIONER FA, CAN YOU JUST START FROM THE BEGINNING AND WITH YOUR, UM, RESPONSE, PLEASE? THANK YOU.
SO THE ANSWER IS NO, WE'RE MOVING AHEAD.
LET ME START BY SAYING, FOR THE FIRST TIME IN ALMOST FOUR YEARS, OUR ENGINEERING DEPARTMENT, AS OF THIS WEEK, IS FULLY STAFFED.
SO WE'RE CATCHING UP A LOT OF MATERIAL AND A LOT OF PROJECTS THAT WE HAVE IN THIS, IN THE, UH, IN THE QUEUE.
UM, AT THIS POINT, UNLIKE YEARS PAST, UH, OUR TOWN CONTROLLER, KIMBERLY IS REALLY CROSSING HER T'S AND DOTTING OUR I'S, UH, WE'RE PUTTING TOGETHER MAPPING AND AN ENGINEERING REPORT FOR THE SEWER WORK THAT WE WANNA DO.
THAT IS THE HOLD UP AT THIS POINT FOR THAT.
UM, BUT RIGHT NOW THE TOWN IS ENGAGED IN OUR PAVING.
WE'RE GONNA BE LOOKING TO DO CURBING SOON.
SO, SO IF WE, UH, DO THE BORROWING AT THE NEXT TOWN BOARD MEETING, WHICH IS IN SEPTE SEPTEMBER 14TH, IS THAT FINE WITH YOU? YEP.
REITERATE THAT FOR MANY MONTHS WE WERE DOWN TO TWO ENGINEERS, AND NOW WE'RE BACK TO SIX.
SO WE'RE IN MUCH BETTER SHAPE THAN WE WERE.
NO, NO, I'M NOT, I'M NOT, YOU KNOW, BEING CRITICAL.
I'M JUST SAYING IN TERMS OF THE TIME.
I JUST DID IMPORTANT SUPERVISOR YEAH.
FOR OUR CONSTITUENTS TO KNOW WHY THINGS MIGHT HAVE DRAGGED A LITTLE BIT AND HOW NOW THINGS ARE MOVING FULL SPEED AHEAD.
SO IT, I DON'T THINK IT WAS A CRITICISM.
NO, WE JUST WANNA DO IT RIGHT.
AND IT'S BASICALLY BEING DONE RIGHT.
AND AS LONG AS THE CA IF THE CAPITAL, BUT IF WE DO THE BORROWING, SAY IN SEPTEMBER
[00:05:01]
MM-HMM.UM, AND THEN, UM, AND THEN WE COULD BASICALLY BY OC EARLY OCTOBER, WE COULD FINISH THE, DO THE BIDDING PROCESS WILL, YOU KNOW, BE COMMENCED AND THEN WE COULD START, WE COULD START MOST OF THE WORK.
I GUESS WE'LL START THEN IN THE SPRING.
IS THAT RICH? IF WITH THIS, WE'RE GONNA START OUTTA THE GATE.
ONCE TELL THE BOTTOM LINE, THE BOTTOM LINE IS WE DON'T HAVE A CHOICE BECAUSE WE DIDN'T HAVE RESOLUTIONS FROM THE BOND COUNCIL.
I, I KNOW YOU WANT GAVE, UH, KIMBERLY UNTIL FRIDAY TO HAVE THE RESOLUTIONS, UH, FROM THE BOND COUNCIL.
FRIDAY CAME AND PASSED, I THOUGHT, OKAY, WE'LL GIVE SATURDAY, WE'LL GIVE SUNDAY.
WE DIDN'T PUBLISH AN AGENDA WAITING FOR THE BOND RESOLUTIONS, BUT THEY NEEDED ADDITIONAL INFORMATION.
WE CAN PASS THINGS THAT DON'T EXIST.
SO THAT'S WHY IT WASN'T ANYBODY DRAGGING.
IT'S JUST BOND COUNSEL'S THE ONE THAT CONTROLS THESE THINGS AND NEEDS TO PROVIDE US DOCUMENTS THAT HE OR SHE CAN DEFEND.
SO YEAH, NO, THERE'S, THERE'S REALLY NO PROBLEM WITH THIS.
IT'S JUST BASICALLY, I JUST WANTED A LITTLE CLARIFI, YOU KNOW, CLARIFICATION BECAUSE ORIGINALLY, YOU KNOW, WE WERE HOPING TO GET THIS DONE, YOU KNOW, TOMORROW, AND THEN BE ABLE TO TAKE ADVANTAGE OF THIS COMING SEASON TO AT LEAST GET SOMETHING STARTED.
BUT, YOU KNOW, IT'S NOT THE END OF THE WORLD.
SO THEN THE EAST HARTSDALE AVENUE UPDATE, UH, RICH, DO YOU WANT TO HAVE ANY, DO YOU HAVE ANY UPDATES? I KNOW THAT THERE'S STILL, UM, UH, I MEAN, WE DID AN UPDATE FOR RESIDENTS, UM, ABOUT A WEEK AGO.
AND I, WHEN WE TALKED THIS MORNING, YOU SAID THAT, UH, WE PROBABLY NEED ANOTHER FEW, FEW DAYS BEFORE WE COULD GIVE A SUBSEQUENT UPDATE.
WELL, I, WE DO HAVE SOME GOOD NEWS.
UH, THE ENGINEERS ARE WRAPPING UP THEIR DESIGN, UH, ON THE SHEATHING THAT THERE HAS TO BE PUT IN PLACE.
UH, JASON CAP, THE TOWN ENGINEER, I BELIEVE, REACHED OUT TO THE OTHER ENGINEERS TONIGHT TO SET UP A MEETING.
UH, LIZ, GARY AND MYSELF SPOKE TO THE BUILDING MANAGER TODAY, UM, AND KIND OF UPDATED HER AND SENT SOME THINGS THAT THEY WERE LOOKING FOR.
UM, WE'RE HOPEFUL THAT WE START WORKING OUT THERE AGAIN SOON.
AGAIN, THIS IS A VERY, UH, DIFFICULT PROJECT, THIS REPAIR.
UM, AGAIN, I WANT TO THANK THE CONTRACTOR AND THE ENGINEERS THAT HAVE BEEN HELPING US, BUT WE'RE HOPEFULLY ON THE MOVE AGAIN AFTER TOMORROW.
UM, NEXT, UH, THE FOIL APPEAL.
I SENT THIS VIA EMAIL, BUT COULD YOU ALSO TAKE ONE AND PASS IT AROUND PLEASE? SO, WE RECEIVED A FOIL APPEAL ON JULY 31ST FROM THE FIRM OF HARDING MDI, AND THE FOIL WAS SENT ON JUNE 25TH, 2024, TO SERGEANT HERY, WHO IS THE COMMANDING OFFICER OF RECORDS AT GREENBERG POLICE DEPARTMENT.
AFTER SPEAKING WITH SERGEANT HERY, AFTER RECEIVING THIS FOIL, HE HAS CONFIRMED THAT HE COULD NOT OPEN THE FOIL REQUEST.
HE ASKED THAT THE FOIL REQUEST BE RESENT.
UNFORTUNATELY, IT WAS SENT THE SECOND TIME AND HE ALSO COULD NOT READ IT THE SECOND TIME AS WELL.
UH, SERGEANT HERY AND THE POLICE DEPARTMENT HAD NO WAY OF BEING ABLE TO ANSWER THIS SPECIFIC FOIL REQUEST BECAUSE OF THE INABILITY TO OPEN IT UP.
THE APPLICANT POINTS TO SOME OTHER PREVIOUS FOILS FROM THE PAST, FROM 2023 AND EARLIER 24, THAT THEY WERE NOT HAPPY WITH THE RESULTS.
TO BE HONEST, I DON'T HAVE KNOWLEDGE OF THOSE FOILS.
HOWEVER, I WILL SAY THAT AN APPEAL MUST BE DONE WITHIN 30 DAYS OF A DENIAL, WHICH DID NOT OCCUR.
SO THE SPECIFIC FOIL WE'RE LOOKING AT DATED JUNE 25TH, 2024, WAS NOT ABLE TO BE OPENED.
I AM SUGGESTING THAT THE REQUEST THE FOIL APPEAL BE DENIED, BUT THAT THE APPLICANT KNOW THEY CAN RESUBMIT ANOTHER REQUEST AND THAT THEY SEND IT IN A REGULAR PDF FORM OR SOME WAY THAT'S VERY EASY FOR A USER TO OPERATE.
THE WAY IT WAS SENT WAS A SECURE MESSAGE THAT YOU NEED TO PUT A PASSWORD AND FOR WHATEVER REASON THAT WASN'T WORKING.
EVEN IF YOU LOOK AT THE CORRESPONDENCE FROM JULY 31ST DURING THEIR APPEAL, THEY INCLUDE A SCAN OF THE FOIL REQUEST.
I ASKED SEVERAL OTHERS TO TRY TO HELP ME READ IT AS WELL.
UM, I CAN MAKE OUT WORDS HERE AND THERE, BUT I CANNOT MAKE OUT WHAT'S BEING ASKED SPECIFICALLY.
SO I WOULD ASK THAT THEY REFILE AND SERGEANT HERTY HAS A OBVIOUSLY AGREED IN PURSUANT TO OPEN MEETINGS LAW TO REVIEW THE REQUEST IN ITS ENTIRETY AND AND TO COMPLY.
SO I DON'T KNOW IF ANY BOARD MEMBERS HAD ANY QUESTIONS
[00:10:01]
OR ANY OTHER SUGGESTIONS OR ANY OTHER INFORMATION YOU NEED ABOUT THIS REQUEST? I TRY.I TRIED TO BLOW IT UP, BUT THE MORE I BLEW IT UP, THE MORE PIXELATED IT BECAME AND IT WAS BASICALLY UNREADABLE.
IT EVEN MAY LOOK LIKE IT WAS ON THE PRIOR CLERK'S FO DOCUMENT, SO I'M NOT REALLY SURE WHERE THAT CAME FROM OR HOW OLD IT IS.
UH, IT'S ESSENTIALLY UNREADABLE.
AND EVEN THAT DOCUMENT THAT WAS SENT AS PART OF THE FOIL APPEAL, I DON'T BELIEVE SERGEANT HERY EVEN SAW THAT.
I DON'T BELIEVE HE WAS ABLE TO OPEN IT AT ALL IN ITS ENTIRETY.
SO TO RESPOND TO, UM, THE, SO I'LL MAKE THAT MOTION.
SO I WILL DRAFT THAT UP FOR THE, FOR THE BOARD, AND I WILL ALSO REACH OUT TO THE APPLICANT TO ASK THEM TO RESUBMIT, BECAUSE I'M SURE THEY STILL WANT THAT INFORMATION.
AND WE'LL GLADLY TAKE A LOOK TO SEE WHAT THEY'RE ENTITLED TO PURSUANT TO FOIL LAW.
DO THEY HAVE TO SUBMIT A HARD OR SHOULD THEY SUBMIT A HARD COPY VIA MAIL AS WELL? MM-HMM.
A, A REGULAR, WE GET MOST OF THEM JUST THROUGH AND CLERK, PLEASE CORRECT ME IF I'M WRONG, BUT I BELIEVE MOST FOILS COME IN VIA EMAIL AND A, A REGULAR PDF THAT ARE EASY TO OPEN.
AND THIS JUST CAME IN VIA SECURE MESSAGE, SO IT WAS MORE DIFFICULT.
BUT YOU DON'T TYPICALLY RECEIVE HARD COPIES MAILED TO YOU.
HOWEVER, WHEN THEY COME IN AND THEY DO WALK-INS, UM, THEN WE ASK THEM TO, UH, FILL OUT A FORM.
UM, BUT I JUST WANNA MAKE NOTE THAT THIS, THIS WAS DATED 2023, NOT 2024 OR FOUR, OR YOU'RE TALKING ABOUT THE RESPONSE.
I'M LOOKING AT THE FOIL REQUEST AND I'M LOOKING AT SEPTEMBER.
THERE ARE PAST FOIL REQUESTS FROM THIS APPLICANT AS WELL.
I DID NOT LOOK INTO THOSE BECAUSE THE APPEAL WAS NOT TIMELY.
THIS, THIS MAY HAVE MEANT TO BE A DUPLICATION OF PRIOR REQUESTS IN THE JUNE 25TH, 2024 UNDERSTOOD FOIL, BUT I DON'T KNOW BECAUSE WE WERE NOT ABLE TO OPEN.
UH, JOE, YOU ASKED ME TO JUST MENTION THAT THE EDGEMONT INCORPORAT INCORPORATION, UH, SUFFICIENCY PETITION HEARINGS WILL BE HELD ON AUGUST 30TH, UM, AT TWO O'CLOCK IN THE AFTERNOON.
AND THEN WE'RE GONNA BE AD YOU KNOW, PROBABLY ADJOURN IT, WE'RE GONNA ADJOURN IT YES.
TO SEPTEMBER 18TH AT 7:30 PM HERE AT TOWN HALL.
UH, SO IT'S BASICALLY TWO HEARINGS AND IT'S ALL BY STATE STATUTE IN TERMS OF WHEN THE HEARINGS COULD BE HELD.
IT'S PUR, IT'S PURSUANT TO VILLAGE LAW.
AND ANYBODY WHO SPEAKS, IF YOU HAVE OBJECTIONS TO THE PETITIONS PURSUANT TO VILLAGE LAW, THE OBJECTION SHOULD BE IN WRITING AS WELL SUBMITTED TO SUPERVISOR FINER, WHO WILL MAKE HIS DETERMINATION WITHIN 10 DAYS OF THE CLOSING OF THE HEARING.
AND THIS IS NOT LIKE A HEARING WHERE YOU COULD SAY, OH, I LIKE INCORPORATION OR I DON'T LIKE IT.
THIS IS ONLY ON, ON, UH, THE PETITION SUFFICIENCY.
SO THE PUB, THE PUBLIC NOTICE THAT WENT OUT SAYS THE CONTENTS OF THE PETITION, WHICH ARE NECESSARY PURSUANT TO VILLAGE LAW AND OBJECTORS SHOULD FOCUS ON THOSE ITEMS ONLY IF PEOPLE, UH, ARE SUPPORTIVE OF THE PETITION.
UH, COULD THEY ALSO SPEAK OR, UH, THAT THAT'S NOT REALLY THE APPROPRIATE FORUM FOR IT? THIS IS REALLY ABOUT COLLECTING OBJECTIONS.
HOWEVER, THEY ARE FREE TO COME OUT DURING OUR PUBLIC COMMENTS ON REGULARLY SCHEDULING MEETINGS OR SENDING EMAILS OF SUPPORT OR ANY OTHER MANNER.
THE, THE POINT OF THE HEARING IS TO REVIEW THE CONTENTS OF THE PETITION.
SOMEONE COULD COME OUT AND CLAIM THAT ALL OF THE CONTENTS OF THE PETITION ARE ACCURATE AND FOCUSED AND HIGHLIGHT THOSE AREAS THAT WOULD BE ACCEPTABLE.
BUT GENERAL STATEMENT OF SUPPORT OR GENERAL STATEMENT OF NON-SUPPORT IS REALLY NOT THE RIGHT FORUM FOR A HEARING LIKE THIS.
AND THIS IS OF COURSE, PURSUANT TO, UH, VILLAGE LAW SUPERVISOR FINER MEETING.
UM, IT'S NOT A TOWN BOARD MEETING.
TOWN BOARD DOESN'T HAVE TO ATTEND, AND IT'S UP TO SUPERVISOR ALONE TO MAKE A DETERMINATION.
IS THIS GONNA BE OKAY? I HAVE PAUL, I HAVE, SORRY, SUPERVISOR.
I HAVE A QUESTION JUST ABOUT THE DATE.
I MEAN, THAT'S THE FRIDAY AFTERNOON BEFORE LABOR DAY WEEKEND, SO, WELL, YOU KNOW, WE, IS THAT WE BASE A GRADE WE'VE CHOSEN FOR A PARTICULAR REASON.
SO I JUST, THAT'S WHAT, SO BEFORE YOU ANSWER, SO THAT'S WHAT I WANTED YOU, CAN YOU JUST OUTLINE FOR EVERYONE THE REQUIRED DATES AND THE TIMEFRAME? SO ONCE YOU RECEIVE THE DATE, YOU HAVE 30 DAYS TO DO THIS.
I THINK THAT WILL BE CLEAR, BECAUSE I DID SEE THE EMAILS AS COUNCILMAN HABER SAW THE EMAILS AND WE SAW THE EMAILS COME IN.
I THINK THERE WAS SOME CONFUSION OR SOME CONCERN
[00:15:01]
ABOUT THE DATES BEING RIGHT BEHIND THE HOLIDAY OR RIGHT BEFORE A HOLIDAY.SO CAN YOU EXPLAIN WHAT THE TIMEFRAME, YOU KNOW, BASED ON, SO, OKAY.
WELL, THERE, THERE'S A STATUTE THAT YOU HAVE, IT'S, I THINK UP TO 30, 30 DAYS, UH, TO SET THE HEARING.
AND, UM, WE CONFERRED WITH OUR ATTORNEYS AND THEY RECOMMENDED, UM, YOU KNOW, THAT, YOU KNOW, THAT FRIDAY, ANY DAY THAT WE HAD THE HEARING WOULD'VE BEEN A BE A DAY IN THE SUMMER.
UH, YOU KNOW, THE EDGEMONT INCORPORATION PETITIONERS, UH, THEY GOT MOST OF THEIR SIGNATURES IN 2022 AND IN 2023.
SO THEY COULD HAVE FILED, IF THEY DIDN'T WANT TO HAVE A HEARING, THAT WOULD INCONVENIENCE PEOPLE DURING THE SUMMER MONTHS.
THEY COULD HAVE BASICALLY FILED IT IN JANUARY OR FEBRUARY OR MARCH.
THEY COULD HAVE FILED IT MUCH EARLIER IN THE YEAR.
THEY CHOSE TO FILE IT AT A TIME WHEN THEY KNEW THAT PEOPLE WERE VACATIONING AND IT WOULD BE CONVENIENT.
SO W WITH 30 DAYS FROM WHAT DATE? FROM JULY 15TH WAS WHEN THE PETITION WAS FILED.
SO, SO WE PASS, SORRY, IT'S BUSINESS DAYS.
WE'RE, IT'S NOT THAT I THINK, I THINK FOR TIME TURN, I APOLOGIZE.
I THINK WHAT COUNCILMAN HABER AND I ARE TRYING TO MAKE SURE THAT EVERYONE CLEAR IS ON THE SCHEDULING.
SO I'M NOT, SO, I MEAN, YOU'VE BEEN THROUGH THIS, SO, YOU KNOW, BUT THE, THE REAL, THAT'S WHY I INDICATED WHEN WE ANNOUNCE THE HEARING MM-HMM.
AND AGAIN, ALL WE'RE ASKING FOR IS INFORMATION.
IS THE PETITION SUFFICIENT? THERE'S A PETITION NOT SUFFICIENT.
AND, YOU KNOW, AGAIN, UM, IT'S, IT'S VERY DIFFICULT TO REVIEW A PETITION WHEN A LOT OF PEOPLE ARE ON SUMMER VACATIONS.
SO THIS WAY, THE EXTRA TIME IS GIVING MORE PEOPLE, UM, A REASONABLE AMOUNT OF TIME TO REVIEW IT.
AND WE'LL THEN HAVE TO SAY IT'S SUFFICIENT.
JUST WANNA MAKE SURE WE FALL IN PROCESS AND EVERYONE UNDERSTANDS THE PROCESS.
IF IT'S SUFFICIENT, THEN, UH, I THINK I HAVE TILL SEPTEMBER 29TH TO MAKE A DECISION.
AND IF I MAKE A DECISION THAT THE PETITION IS SUFFICIENT, THEN THE HEAR THE REFERENDUM WOULD BE HELD WITHIN 40 DAYS AFTER THE CLOSE OF THE HEARING.
SO THE, SO WELL AS, AS COUNCILMAN JACKSON SAID, THIS WAY, WE AVOID ANY APPEARANCE OF, OR TRYING TO HAVE IT AT A TIME WHERE IT'S NOT REALLY ACCESSIBLE FOR ANYONE WHO WANTS TO COME.
SO YOU'RE, IF YOU'RE GONNA ADJOURN IT, THEN THAT'S GOOD.
AND, AND THAT'S WHY THE PUBLIC NOTICE SPECIFICALLY STATED THE SECOND DATE AS WELL.
SO PEOPLE CAN BEGIN PREPARING NOW AS WELL.
AND WHILE WE'RE, AND THEN YOU COULD ALSO SEND IN OBJECTIONS, UH, WRITTEN AND DON'T NECESSARILY HAVE TO ATTEND THE HEARING AS WELL.
AND ONE OF THE OTHER THINGS WE'RE GONNA DO IS WE'RE GONNA USE THE DIGITAL BOARDS, AND WE'RE GONNA PUT ONE, UH, THERE'S A, I SPOKE TO, UH, WHERE I'VE BEEN IN CONTACT WITH SERGEANT FONTELLA AND, UM, WE'RE GONNA PUT ONE IN FRONT OF THE TOWN HALL, AND THEN HE HAS A BOARD ON EAST HARTSDALE AVENUE.
AND JUST GOING TO, UH, MENTION THREE DAYS BEFORE THE HEARING BOTH HEARINGS, UH, JUST REMINDING PEOPLE THAT THE HEARING IS GONNA BE, IS GONNA BE HELD ON, ON THOSE, YOU KNOW, DATES, WHICH WE HAVEN'T DONE IN PREVIOUS YEARS.
AND I SUGGEST REMINDING PEOPLE DURING THE APPROACHING WORK SESSIONS AND TOWN BOARD MEETINGS AS WELL.
OKAY, NEXT WE HAVE THE, UH, THE WORK SESSION AGENDA.
UM, NO, WE HAVE THE AGENDA TO BOARD, YOU MEAN THE AGENDA, THE REGULAR AGENDAS? YES.
SO THE FIRST THING I JUST WANTED TO BRING UP, UM, IS I HAD SUBMITTED, UH, TO JOAN, UM, IN A TIMELY MANNER, A PROPOSED RESOLUTION, UH, SUSPENDING, UH, TB ONE AND ASKING FOR A LEGAL OPINION.
HAVING THE TOWN BOARD, UH, WHILE THERE'S A SUSPENSION, ASKING FOR A LEGAL OPINION FROM, UM, THE ASSOCIATION OF TOWN'S COUNSEL, WHETHER OR NOT THE LAW, THE RESOLUTION IS LEGALLY, UM, UH, SUFFICIENT.
I, I BELIEVE THAT IT'S NOT SUFFICIENT BECAUSE, UM, IT'S DONE AS A RESOLUTION, UM, RATHER THAN AS A LOCAL LAW.
UM, AND, YOU KNOW, I JUST REALLY WANTED AN OPINION BEFORE, UM, BEFORE WE ENFORCE IT.
I UNDERSTAND THAT OTHER MEMBERS OF THE BOARD DISAGREE WITH ME, WHICH IS YOUR PREROGATIVE.
UM, I JUST SORT OF FEEL, THE THING THAT'S BOTHERING ME IS, UM, SINCE I'VE BEEN TOWN SUPERVISOR, UM, WE HAVE NEVER CENSORED ANY ELECTED OFFICIALS, UH, ABILITY TO PUT ANYTHING ON THE AGENDA, BECAUSE I'VE BEEN DOING THIS FOR NOW 34 YEARS, AND EVERY TIME I WANT SOMETHING ON THE AGENDA, IT GETS PUT ON THE AGENDA.
AND IF NOBODY SUPPORTS IT, THE RESOLUTION, THERE'D BE NO SECOND, WHICH IS FINE, BUT AT LEAST YOU, I FEEL THAT, YOU KNOW, FIRST I WAS REALLY ANGRY YESTERDAY AND LIKE CURSING EVERYBODY.
BUT THEN I SAID, YOU KNOW WHAT? I'M REALLY NOT ANGRY.
I REALLY SHOULD BE SAD BECAUSE I REALLY FEEL THIS IS AN EROSION OF DEMOCRACY.
I FEEL WE DON'T KNOW, YOU KNOW, WE, YOU KNOW,
[00:20:01]
WE NEED TO ENCOURAGE PEOPLE WHO AGREE WITH US AND DISAGREE WITH US TO BE INVOLVED AND TO EXPRESS THEMSELVES.AND I FEEL THAT ELECTED OFFICIALS, YOU KNOW, THERE COULD BE A TIME 10 YEARS FROM NOW WHERE THERE COULD BE A REPUBLICAN ON THE BOARD AND THERE COULD BE A FOUR, FOUR DEMOCRATS, ONE REPUBLICAN.
AND WHAT ARE WE GONNA DO? WE'RE GONNA SAY THAT, UH, LEGISLATOR, THAT COUNCIL PERSON CAN'T PUT SOMETHING ON A RESOLUTION IF EVERYBODY, IF OTHER MEMBER DISAGREE.
PAUL, I DON'T MEAN TO INTERRUPT YOU, BUT I'M GOING TO, UM, IS THIS, THIS TO ME, 'CAUSE I'M NOT EXPERIENCED THIS BEFORE.
THIS IS A MATTER OF WHAT IS OUR POLICY AND PROCEDURE.
SO CAN SOMEONE WHO, CAN SOMEONE EXPLAIN, MAYBE FRANCIS, YOU CAN WEIGH IN ON WHAT IS THE POLICY FOR PUTTING A RESOLUTION ON IF THERE'S NO GOING TO BE NO SECOND FOR IT.
ANY, I'VE DONE THIS FOR 34 YEARS.
SO PAUL, PAUL, BUT PAUL, COULD YOU GIVE ME AN EXAMPLE OF SOMETHING THAT YOU HAVE DONE IN THE PAST THAT YOU PUT A RESOLUTION ON THAT HAD NO SECOND? UH, BASICALLY I'VE PUT RESOLUTIONS ON THE AGENDA FOR, FOR YEARS, AND BASICALLY WE'LL SAY TOWN SUPERVISOR RESOLUTION.
AND THEN, UM, IF NOBODY, I WOULD MAKE A MOTION.
AND IF NOBODY FOR, IF NOBODY SECONDED, THAT'S THEN, THAT'S NOT AN EXAMPLE.
BUT, BUT LET ME SAY THE, IF GEORGE LATIMER IS PROBABLY GONNA GET ELECTED TO CONGRESS, LET'S SAY THE REPUBLICANS KEEP THE HOUSE, WHICH I HOPE THEY DON'T, BUT IF THEY DO AND HE WANTS TO INTRODUCE A RESOL, UH, LEGISLATION BEFORE THE HOUSE OF REPRESENTATIVES AND THE SPEAKER SAYS YOU CAN'T DO THAT, THAT'S SOMETHING THAT EVERYBODY WOULD THINK IS REALLY BAD IN THE STATE LEGISLATE.
EVERY LEGISLATIVE BODY THAT I'VE EVER SEEN, ANY ELECTED OFFICIAL COULD PUT SOMETHING ON THE AGENDA.
AND, UM, AND ALSO, I DON'T KNOW HOW IT WAS TAKEN OFF THE AGENDA BECAUSE OUR RULES INDICATE THAT, UM, THAT THE RESO PROPOSED RESOLUTIONS HAVE TO BE PRESENTED, PUT ON THE AGENDA A WEEK BEFORE.
I THINK WE'RE SWITCHING RULES.
SO I THINK THIS WOULD BE PROBABLY A GOOD TIME CASE.
CAN WE TRY TO GET AN ANSWER FOR, FOR COUNCIL NEIGHBOR? I JUST WANNA KNOW THE APPROPRIATE AND CUSTOMARY PROCEDURE FOR THIS.
SO I'VE BEEN ON THE, I'VE BEEN ON THE BOARD, WHAT, 18 YEARS NOW.
AND PAUL HAS REPEATEDLY TOLD US IT TAKES THREE BOARD MEMBERS TO DO SOMETHING, THREE BOARD MEMBERS TO GO ON THE AGENDA, THREE BOARD MEMBERS TO GET IT OFF THE AGENDA.
AND THAT'S WHAT WE HAVE BEEN FOLLOWING.
IF YOU, WHAT IS THE PURPOSE OF PUTTING ON A RESOLUTION ON AN AGENDA, UH, WHERE YOU KNOW, YOU HAVE NO SECOND, WELL, MAYBE WE DO IT, IT ALL IT IS, IS TO CREATE CHAOS AND DYSFUNCTION.
YOU HAVE THE ABSOLUTE RIGHT AT A TOWN BOARD MEETING TO SAY, TOMORROW NIGHT I WANTED TO PUT ON A RESOLUTION, BUT I DIDN'T HAVE SUPPORT FOR IT.
WELL, HOW DO I KNOW THAT I DON'T HAVE SUPPORT? NOBODY'S STOPPING YOU FROM SAYING THAT TO YOU TO, TO FILL AN AGENDA WITH ITEMS THAT HAVE NO CHANCE OF PASSING.
IT CAN'T EVEN BE DISCUSSED BECAUSE ACCORDING TO ROBERT'S RULES TO BE DISCUSSED, YOU HAVE TO HAVE A SECOND TO HAVE THE DISCUSSION.
SO ALL IT BASICALLY IS, IS WINDOW DRESSING.
I DON'T THINK ANYBODY HAS ANY, ANY, UH, MISUNDERSTANDING OF YOUR POSITION ON THIS.
I'M NOT SURE, YOU KNOW, YOU'RE GOING TO JUST KEEP PUTTING RESOLUTIONS ON EACH AGENDA FROM THAT.
IT'S NOT, THERE'S NO PRECEDENT THAT I CAN HAVE.
REMEMBER WHERE YOU PUT SOMETHING ON THE AGENDA FOR IT TO BE VOTED DOWN, NOT EVEN FORGET ABOUT VOTED DOWN, BUT YOU DIDN'T GET A SECOND ACT VOTE.
'CAUSE THERE WOULDN'T BE NO VOTE ON THIS.
OKAY, WELL, LET ME, FRANKLY, FRANKLY, WE HAVE AN OPINION.
WE HAVE A LEGAL OPINION, WE HAVE A TOWN ATTORNEY.
THIS IDEA OF DIMINISHING, AND IT HAPPENED AT THE PLANNING COURT LAST WEEK, AND IT HAPPENED PRIOR THIS YEAR WHERE APPARENTLY IT DOESN'T MATTER WHAT OUR TOWN ATTORNEY'S OFFICE SAYS, IF SOMEBODY DISAGREES WITH IT, YOU KNOW, THEY, THEY BAN THE, UH, DEPUTY FIRST DEPUTY TOWN ATTORNEY, UH, FROM GIVING AN OPINION.
UH, NOW YOU ARE BASICALLY SAYING JOE IS WRONG AND YOU WOULD LIKE TO GET AN OPINION FROM SOMEPLACE ELSE.
JOE HAS SHOWN IN EVERY SITUATION, EVERY CASE, INCLUDING THAT DISASTROUS SITUATION WITH THE POLICE STATION, WHERE HE WAS BRAND NEW ON AS A TOWN ATTORNEY.
BUT HE WITHIN A WEEK SAID TO US, THIS DOES NOT SEEM RIGHT TO ME.
AND WITHIN TWO WEEKS IT WAS DETERMINED THAT THE EFFORT THAT WAS GOING ON TO HAVE THE VILLAGES PAID FOR OUR POLICE STATION, HE SAID, YOU CAN'T DO THAT.
[00:25:01]
WELL, LET ME JUST SAY SOMETHING.SINCE I'VE BEEN SUPERVISOR, WE HAVE, I HAVE ALWAYS PUT ANYTHING ON THE AGENDA THAT I WANTED.
AND BASICALLY NOBODY'S, UNTIL THIS TIME, NOBODY'S EVER, UM, SAID, I CAN'T PUT A PROPOSED RESOLUTION.
ALL IT WOULD'VE REQUIRED WOULD'VE BEEN, UM, IT SAID, WOULD'VE SAID SUPERVISOR PROPOSED RESOLUTION.
AND THEN I WOULD MAKE A MOTION.
AND THEN IT WOULD BY EITHER BE SECONDED OR, YOU KNOW, OR, OR IT WOULDN'T BE SECONDED.
INSTEAD, IF IT'S SECONDED, THERE WOULD'VE BEEN A VOTE.
I ALSO BELIEVE THAT, UM, IT'S REAL THAT THIS IS REALLY A BIG EROSION OF DEMOCRACY.
BECAUSE BASICALLY WHAT WE'RE DOING IS WE'RE, UM, WE'RE, UH, DEPRIVING, UH, THE PUBLIC OF A CHANCE TO, UM, UM, TO HEAR DIFFERENCES OF OPINIONS.
AND IT'S, YOU KNOW, AND, AND AGAIN, IT DOES TO ME, UM, IF WE HAVE THE RESOLUTION AND NOBODY SECONDED, I WOULD'VE TAKEN ONE SECOND.
IT'S GOING TO, IT'S, THERE'LL BE MORE DISCUSSION IF IT'S NOT ON THE AGENDA QUESTION, BECAUSE WE'RE THE, SO I HAVE A QUESTION FOR YOU, SUPERVISOR.
YOU'VE, YOU'VE ASKED, UM, HOW WOULD YOU KNOW IF NO ONE SUPPORTED IT? YOU RIGHT.
WHY CAN'T YOU CONTACT US AND CALL US AND NOT JUST TALK TO US? ONLY LET ME, LET ME FINISH.
WHY CAN'T YOU CALL US AND HAVE A CONVERSATION WITH US AND SAY GINA, OR SAY JOY OR SAY FRANCIS OR SAY ELLEN, I JUST, I KNOW YOU, I UNDERSTAND WHAT YOU PASSED TB ONE, HERE'S MY CONCERNS.
HERE'S WHAT I WOULD LIKE TO PUT OUT HERE.
ARE YOU SUPPORTING THIS? WHY CAN'T YOU HAVE THAT CONVERSATION AND PULL US BEFORE YOU CREATE A RESOLUTION AND PUT THIS ON THERE? SO WE'RE NOT AT THIS POINT THAT'S CALLED CONVERSATIONS OR TALKING OR COMMUNICATING.
BUT LET ME, LET ME, I THINK THAT WOULD PROBABLY BE BETTER.
SO IT DOESN'T CONSULT, YOU DON'T HAVE THIS FRUSTRATION.
AND AS YOU MENTIONED, YELLING AND CURSING, I HEARD THAT YOU WERE VERY UPSET YESTERDAY.
AND IT'S FINE 'CAUSE WE'RE, WE'RE OKAY.
IT'S OKAY TO BE UPSET AT TIMES, BUT I THINK THAT MAYBE IF YOU COMMUNICATE WITH US, YOU KNOW, YOU KNOW, AND TALK TO US, MAYBE YOU WOULD HAVE AN UNDERSTANDING AND KNOW HOW WE FELT.
BUT I MEAN, WE WERE CLEAR HOW WE, I MEAN, WE'VE ALWAYS HAD THIS DISCUSSION.
THIS IS NOT NOTHING, THIS IS NOT ANYTHING THAT YOU ARE NOT FAMILIAR WITH OR THAT YOU DO NOT KNOW THAT HOW THAT HOW WE FEEL.
NO, BUT LEMME JUST SAY BECAUSE WE DO.
I I I KNOW, BUT YOU, I DON'T, I JUST WANNA GET MY POINT LIKE YOU DO.
SO I JUST, IT'S JUST IMPORTANT FOR US TO REALLY HAVE THAT DIALOGUE WITH THE BOARD.
AND NOT COME OUT HERE AT THIS TIME AND GIVE AN OP, GIVE AN ALLUSION TO EVERYONE THAT WE ARE JUST, YOU KNOW, AGAINST YOU AND WE'RE NOT JUST WORK, WORK WITH US.
YEAH, BUT LEMME JUST, THAT'S THE BOTTOM LINE TO THAT.
WHY DON'T YOU WORK UNDEMOCRATIC? I THINK THAT THAT IS REALLY ROUGH.
OTHER, WELL, IT IS UNDEMOCRATIC, BUT NOT WORKING WITH US AND TALKING WITH US.
NO, LET ME JUST SAY SOMETHING.
I'VE BEEN FOLLOWING THE, THE RULES OF THE BOARD.
SO JOAN BASICALLY SAID THE AGENDA CLOSES.
UH, SO SHE SAID SUBMIT THE RESOLUTIONS BY MONDAY.
I BASICALLY HAD TWO RESOLUTIONS.
AND THEN SHE BASICALLY SAID, DO YOU KNOW WHICH ONE DO YOU WANT? AND I SAID, YOU KNOW WHAT, I DON'T WANT TO HAVE ONE THAT'S GONNA BE, UM, YOU KNOW, VERY NEGATIVE ABOUT TB.
ONE, I WANT TO JUST, UH, SECOND RESOLUTION THAT JUST FOCUSED ON ASKING FOR A LEGAL OPINION.
SO THEN I BASICALLY ON FRIDAY LOOKED FOR THE AGENDA.
I DIDN'T SEE THE AGENDA POSTED.
I LOOKED SATURDAY ON THE, UH, WEBSITE.
I LOOKED SUNDAY ON THE TOWN WEBSITE.
I DIDN'T SEE THE AGENDA POSTED ON MON.
SO I WAS JUST ASSUMING THAT, UM, YOU KNOW, EVERYTHING THAT I DID IN A TIMELY MANNER, UH, WOULD BE, UM, WOULD BE, WOULD BE POSTED.
AND I ALSO FEEL THAT EVEN THOUGH SOME PEOPLE ON THE BOARD MAY BE, MAY HAVE BEEN AGAINST IT LAST WEEK, I THINK THAT THE, THE CITIZENS OF GREENBERG ARE GONNA BE SUPPORTIVE OF AN EFFORT TO GET A SECOND OPINION ON, ON, BECAUSE NOBODY REALLY WANTS TO SEE PLANNING BOARD MEMBERS HARASSED OR PLANNING BOARD MEMBERS INTIMIDATED PAUL.
AND THEY, THEY WANNA HAVE, PEOPLE WANNA HAVE, THEY'RE ACCUSING US OF HARASSMENT AND WELL, IT'S TRUE.
PAUL DOES THE ASSOCIATION OF TOWNS, UH, GIVE LEGAL OPINIONS? THEY DO.
WHY IS THEIR LAWYER GONNA, 'CAUSE THEY BASICALLY, THEY, IN THE PAST, UM, THEY'VE RESPONDED TO THE TOWN ATTORNEY RATHER, YOU KNOW, AND WHEN I'VE WRITTEN TO THEM, THEY WON'T, THEY'LL, THEY SAID THERE'S A, A BETTER CHANCE THEY'LL RESPOND TO A TOWN, ATTORNEY ATTORNEY.
BUT I DON'T THINK THERE'S A CLEAR CUT POLICY, I THINK NO, BUT THAT'S WHAT THEY OF TOWNS WILL RESPOND TO A MUNICIPAL OFFICIAL.
THEY HAVE NO, THEY'VE ALWAYS TOLD ME IT'S A ATTORNEY GENERAL.
YOU HAVE TO HAVE, THEY DON'T CORRESPONDENCE FROM AN ATTORNEY.
I, I'LL I, I'LL WRITE TO THEM AND I'LL ASK FOR AN OPINION, BUT I THINK I'D HAVE A BETTER CHANCE IF, UH, IF THE TOWN ATTORNEY, IF THE BOARD WOULD SAY, THIS IS SOMETHING THAT WE'RE LOOKING AT.
YOU KNOW, AND YOU KNOW, WE BASICALLY, I'M NOT UNDERSTANDING WHY WE WOULD NOT USE OUR TOWN ATTORNEY'S ADVICE BECAUSE BASICALLY I'M,
[00:30:01]
I AM ALMOST CERTAIN THAT YOU CAN'T DO IT BY RESOLUTION.YOU CAN'T TAKE THIS ACTION BY RESOLUTION.
AND I BASICALLY FEEL THAT THE, AND SO BASED ON, SO BASED ON, SO LET ME JUST SAY THIS.
SO I, 'CAUSE WE'RE NOT GONNA GO BACK AND FORTH.
WE DO HAVE TO GET A AGENDA REVIEW.
WE DO HAVE PEOPLE THAT WE HAVE TO MEET WITH THIS LEAVING THIS EVENING.
SO WHAT RESEARCH DID YOU PERSONALLY DO TO, TO SHOW JOE AND TO SAY, JOE, THIS IS THE RESEARCH I HAVE PERSONALLY DONE AND I WANT TO CONFIRM WITH YOU YOUR THOUGHTS ON THIS.
SO CAN YOU UP WITH US, BASICALLY, UM, AN ACTION LIKE THIS, THE TB ONE, UM, SHOULD HAVE BEEN DONE BY A LOCAL LAW, RIGHT? NO, LEMME JUST SAY IT SHOULD HAVE BEEN DONE LOCAL LAW BY RESOLUTION.
THERE SHOULD HAVE BEEN A, IS THAT THROUGH ROBERT'S RULES? IS IS THAT, I JUST WANTED TO KNOW WHERE YOU, WHERE'D YOU, WHERE'D YOU FIND THAT IN? WELL, THIS, I'M JUST TELLING YOU FROM, YOU KNOW, THE, UH, THE REVIEW I'VE HAD WITH LAWYERS, NO, LEMME JUST SAY WAS THAT YOU CAN INTERRUPT SPEAK AFTER I DO SECOND.
THE LAW, THE RESOLUTION AS WORDED IS VERY, VERY BROAD.
UH, YOU DON'T HAVE DEFINITIONS AND YOU DON'T EVEN HAVE ENFORCEMENT PROVISIONS IN THE, IN THIS SECTION.
SO FOR EXAMPLE, IF IT SAYS NOBODY, UH, ON A LAND USE BOARD COULD BE A MEMBER OF A, A PLANNING BOARD OR YOU, IF YOU ARE, NOBODY COULD BE PART OF A, NOT COULD HAVE A, NOT-FOR-PROFIT.
BE ON A BOARD OF A NOT-FOR-PROFIT.
IF YOU'RE ON, UM, A LAND ON A LAND USE COMMITTEE.
IT DOESN'T TALK ABOUT, UM, WHAT THE PENALTIES ARE.
HOW DOES IT GET ENFORCED? UH, YOU KNOW, ARE THERE APPEALS PROCESSES? WHAT ARE, WHAT ARE THE DUE PROCESS, UH, YOU KNOW, PROVISIONS.
SO THERE, THERE'S TONS OF, I I COULD DO A, A WHOLE ESSAY.
SO CAN YOU JUST ANSWER MY QUESTIONS? WHERE, WHERE WAS YOUR, WHERE WAS YOUR LEGAL OPINION THAT YOU SUBMITTED TO JOE STATING THAT WE DID THIS INCORRECTLY? I, I JUST WANTED GET, I I, I'VE SPOKEN TO, I'VE SPOKEN TO JOE A FEW TIMES, BUT CAN YOU JOE, TO, I JUST, I RESPECTFULLY, I BELIEVE THAT LEGAL ADVICE SHOULD BE GIVEN IN EXECUTIVE SESSION, BUT SINCE WE'VE TALKED ABOUT THIS FOR QUITE SOME TIME NOW, I'LL SAY SUPERVISOR FINER.
I RESPECTFULLY DISAGREE WITH YOU.
I THINK THE POLICY IS APPROPRIATE AND LEGAL.
I THINK YOU CAN HAVE ENFORCEMENT THE WAY IT'S CURRENTLY DRAFTED.
I BELIEVE THAT IT DOES NOT INFRINGE UPON OUR OWN CODE OF ETHICS.
AND I THINK THAT WE ARE ENFORCING IT.
LETTERS WENT OUT TO ALL TOWN BOARD MEMBERS, PLANNING BOARD MEMBERS, AND ZONING BOARD MEMBERS ABOUT THIS MATTER.
ALMOST EVERYONE HAS REPLIED EXCEPT FOR FOUR, UH, FIVE INDIVIDUALS.
WE PASS POLICIES EVERY YEAR THROUGH RESOLUTIONS AND IT'S NEVER BEEN AN ISSUE UNTIL THIS ONE.
SO I DON'T UNDERSTAND WHY THERE IS SUCH A PROBLEM WITH T 1ST OF JULY 10 24.
OKAY, SO CAN, CAN WE MOVE ON? CAN WE GO ON WITH THE AGENDA? CAN WE PLEASE MOVE ON TO THE AGENDA? 'CAUSE WE DO HAVE A SCHEDULE.
UM, YOU KNOW, I I'VE INDICATED TO THE BOARD THAT I'M GONNA HOLD OVER, UH, THE APPOINTMENT OF DYLAN PINE TO THE PLANNING BOARD, NOT BECAUSE I, UH, DON'T THINK DYLAN WOULD DO A GOOD JOB, BUT BECAUSE I THINK THAT WE SHOULD HAVE A PROCESS, UM, DECIDING, UM, WHAT, HOW MANY VACANT WAIT'S.
NO, LEMME SAY ANOTHER EXAMPLE OF YOU NOT, LEMME, LEMME SAY I'M, I'M HOLDING IT OVER TOMORROW.
AND IF YOU DON'T WANT TO HEAR MY REASONS, THAT'S WHY I DO WANNA HEAR YOUR REASONS.
YOU STARTED OFF BY SAYING, AS I INDICATED TO THE BOARD, WHEN WAS THAT? WHEN DID YOU INDICATE OKAY, WHEN DID, LET ME, THIS IS THE FIRST TIME HEARING.
IT'S THE FIRST TIME I HAD SENT EMAILS TO THE BOARD, BUT IT'S, IT TURNED EARLIER TODAY, BUT IT TURNED OUT THAT EVERYTHING GOT, I WAS SPEAKING TO PETER.
ALL THESE EMAILS THAT I'VE BEEN SENDING OUT FOR THE PAST FEW DAYS WERE GETTING IN THE DRAFT FORM.
SO HE, HE WAS CORRECTING IT AT THEN, BUT THIS IS BASICALLY, YOU KNOW, MY, MY WELL THEN DON'T, DON'T PROJECT.
FINE, BECAUSE THAT'S NOT TRUE.
SO THEN THAT, SO LET ME, SO IF YOU TALK TO YOURSELF, IT DOESN'T MEAN YOU TALK TO US.
LEMME JUST TELL YOU MY REASONS FOR HOLDING IT OVER.
FIRST OF ALL, AS I SAID, I THINK DYLAN HAS BEEN AN EXCELLENT, I, UH, LEADER OF THE EDGEMONT INCORPORATION, UH, EDGEMONT EDGEMONT, ECC, UM, UM, YOU KNOW, I THINK THAT HE'S WORKED NICELY, UH, WITH THE TOWN AND I THINK THAT, UM, HE WOULD BE, UM, YOU KNOW, QUALIFIED TO HOLD, UH, AN APPOINTED, UH, YOU KNOW, POSITION WITH THE TOWN.
UM, THE REASON I'M HOLDING THIS OVER, UH, TILL THE NEXT MEETING IN SEPTEMBER IS BECAUSE I FEEL, AGAIN, I WANT TO REACH OUT TO, UH, THE ASSOCIATION OF TOWNS.
UH, I AM GONNA DO THAT ON MY OWN, ASKING FOR A LEGAL OPINION.
UM, AND, UM, I WANT TO, NO, I'M GONNA, I'M TELLING YOU, PAUL, REGARDLESS OF THAT, WE HAVE TWO PLANNING BOARD MEMBERS WHO NEED TO BE REAPPOINTED, RIGHT? THEY, THEIR TERMS HAVE EXPIRED.
RIGHT? BUT LEMME TELL YOU, I'M, I'M HOLDING, I'M HOLDING IT OVER.
NO, THAT'S OUR, NO, THAT'S OUR DECISION WHETHER WE APPOINT SOMEONE ELSE, RIGHT? BUT
[00:35:01]
I HAVE A RIGHT TO HOLD OVER BECAUSE LET ME JUST SAY I'M, I DECIDED I'M HOLDING IT OVER.I BASICALLY FEEL THAT, UH, WE SHOULD INVITE THE CURRENT MEMBERS WHO ARE BASICALLY HAVE SERVED.
WE, WE'VE NEVER, NO, BUT YOU KNOW WHAT? YOU, YOU JUST MAKE, YOU KEEP MAKING ME.
NO, BUT LET ME, I PROMISE YOU, LET ME SAY THIS, AND IF THIS IS WHAT YOU CALL DEMOCRACY, I, NO, LET ME SAY I NEED A NEW DEFINITION BECAUSE AS WE GO EACH DAY, WE SIT HERE.
I DON'T KNOW WHAT I'M LOOKING NO, LEMME JUST SAY, BECAUSE YOU, YOU MAKE UP A NEW RULE AS YOU GO.
WE'VE BEEN FOLLOWING THIS PROCESS AS WE'VE BEEN APPOINTING NEW MEMBERS.
NO, BECAUSE, AND NOW WE'RE CHANGING PROCESS THIS IN THE PAST.
SO TELL, TELL US WHY YOU DON'T WANT, IN THE PAST, YOU FOLLOWED EVERY POSITION IN THE, IN THE, IN THE PAST.
EVERY TIME THERE'S BEEN A VACANCY ON A BOARD, UH, YOU'VE ALWAYS SUGGESTED THAT WE ADVERTISE THE POSITION BRING WHICH, NO, WHICH, NO, WHICH WE WAIT, LEMME SAY, OKAY, PAUL.
SO, SO YOU'VE ALWAYS SUGGESTED THAT WE ADVERTISE THE POSITION.
THERE'S BEEN TIMES I'VE MADE RECOMMENDATIONS AND THE BOARD HAS SAID, YOU KNOW WHAT? ADVERTISE A POSITION.
WE, WE GET RESUMES FROM PEOPLE WHO WANT IT.
WE INTERVIEW EVERYBODY, AND THEN BASICALLY WE SELECT THE ONE WE WANT.
SO IT MAY, IT MAY, IT MAY TURN OUT THAT BETWEEN NOW AND SEPTEMBER, UH, AND WE FOLLOW THE PROCESS THAT I WANT, WE MAY HAVE 10 RESUMES.
WE START, WELL, WE'RE NOT CHANGING THE PROCESS IN THE MIDDLE OF THE PROCESS.
ARE WE HOLDING OVER? ARE WE HOLDING OVER THE, ALL THE OTHER APPOINTMENTS? WELL, BECAUSE YOU, WELL ACTUALLY ELLEN BERNSTEIN, I HAVE TO JUST LET YOU KNOW.
TROY, THEY JUST MAKE APPOINT TAKE HER OFF.
ARE WE HOLDING ALL, ALL THESE, ALL THESE APPOINTMENTS AS WELL, RIGHT? NO.
SO WE, SO WE ONLY HOLD, SO WE'RE GONNA HOLD OVER, UH, KEN JONES, WE'RE GONNA HOLD OVER ELLEN, UM, BOORSTEIN, WE'RE GONNA HOLD DARA BOYD.
SO WE'RE HOLDING ALL NO, WE'VE, WE'VE, WE'VE, BECAUSE THIS IS A NEW, THIS IS NEW PROCEDURES.
NO, WE'VE HAD, WE'VE INTERVIEWED PEOPLE FOR THE BOARD OF ETHICS, WE'VE INTERVIEWED OTHER CANDIDATES FOR THE BOARD OF ETHICS.
WE'VE BEEN INTERVIEWING PEOPLE ALL SUMMER FOR THE BOARD OF ETHICS.
SO ALL I'M SAYING IS THAT, FIRST OF ALL, WE CAN'T PLAN.
SO THIS IS JUST IN THE PLANNING BOARD NOW? NO, NO.
SO FIRST OF, SO NOW WAIT, SO NOW, OKAY, SO THE PLANNING BOARD, THE PLANNING BOARD IS BASICALLY, THE APPOINTMENT IS IS TILL 2030.
SO IT'S, IT IS BASICALLY A, A, A LONG APPOINTMENT.
AND BASICALLY, I, I DON'T HAVE, YOU HAVE TWO MEMBERS THAT APPOINTMENT HAS EXPIRED, BUT YOU KNOW WHAT YOU HAVE BEEN TALKING ABOUT MAKING SURE THAT WE DO OUR REAPPOINTMENTS, BUT YOU KNOW WHAT THEY MAY, YOU HAVE BEEN TALKING TO THE TOWN CLERK TO MAKE SURE THAT WE HAVE A, OKAY, A LETTER, A LIST OF COMMISSIONS AND THE DATES AND MAKING SURE THAT THEY'RE UP TO DATE.
SO AS WE ARE WORKING TO MAKE SURE THAT EVERYTHING IS UP TO DATE, NOW YOU'RE PUTTING, NOW YOU'RE SAYING THAT WE CAN'T MOVE FORWARD.
NO, BECAUSE, SO I'M NOT SURE IF YOU WANT US TO MOVE FORWARD OR IF YOU WANT TO KEEP MOVING BACK.
NO, BECAUSE I BASICALLY HAVE SOME HOW ARE WE GONNA MOVE FORWARD? BECAUSE LEMME SAY SOMETHING, LEMME SAY SOMETHING.
I BASICALLY WANT, YEAH, YOU'VE SAID A LOT.
YOU'VE SAID A LOT IN MIS SUPERVISOR, LET OTHER PEOPLE TALK.
YOU KNOW, YOU, YOU'RE MAKING UP RULES AS YOU GO ALONG.
YOU TALK, ON THE ONE HAND, YOU TALK ABOUT US BEING CONTRARY TO DEMOCRACY, AND THEN YOU WANNA CHANGE THE RULES AS YOU GO ALONG, WHICH IS IT.
AND I WOULD HOPE THAT IT'S IN, ON THE SIDE OF DEMOCRACY, REAL DEMOCRACY.
YOU CAN'T CHANGE THE RULES TO SUIT WHAT YOU WANT WHEN YOU WANT IT.
WE ARE ASKING THAT SOMEONE THAT WE KNOW, THAT WE HAVE WORKED WITH, WHO'VE WORKED WITH OUR, OUR DPW, WHO'VE WORKED WITH OUR PLANNING COMMISSIONER, SOMEONE WHO WE KNOW VERY WELL AND ABOUT THE PROCESS ARE ABSOLUTELY CONFIDENT.
SOMETHING ABOUT TO THEN GO THROUGH A WHOLE, A WHOLE, UH, PROCESS THAT IS REDUNDANT AND ONLY BECAUSE IT'S THE WAY YOU FEEL, NOT BECAUSE IT IS OUR DEMOCRATIC VALUES.
SO REALLY WHAT IT'S BOILING DOWN TO, IT SEEMS TO ME THAT IT'S WHATEVER PAUL FINER SUPERVISOR OF GREENBERG FEELS IS HOW WE SHOULD OPERATE THIS TOWN.
AND THAT TO ME IS CONTRARY TO DEMOCRACY.
OKAY? WELL, BASICALLY EVERY BOARD MEMBER IN THE PAST, WE ALL HAVE THE RIGHT AND THE PREROGATIVE TO HOLD OVER ANY ITEM WE WANT THAT'S IN THE RULES.
SO WE'VE, WE'VE DONE, OTHER MEMBERS HAVE HELD OVER ITEMS. SO I'M SAYING I WANNA HOLD OVER.
OTHER MEMBERS HAVE, UH, TIMES HELD OVER ITEMS. SO I'M HOLDING OVER THIS ITEM TILL THE NEXT MEETING.
AND BASICALLY THEN I HAVE THE RIGHT TO HOLD IT OVER.
AND IF THE BOARD WANTS TO, IF THE BOARD WANTS TO, THAT WE WANT TO VOLUNTEER.
OKAY? BUT THIS IS, THESE ARE PEOPLE, WELL, YOU, SCHWART AND WALTER, SIMON AND JOHAN SNAGS, THEY ALSO WANNA VOLUNTEER AND YOU TREATING THEM LIKE A PIECE OF DIRT.
PAUL, YOU KNOW WHAT? YOU'RE TREATING THEM, YOU'VE HARASSED THEM AND YOU'VE INTIMIDATED THEM JUST BECAUSE YOU DISAGREE WITH THEM.
I FEEL HARASSED AND INTIMIDATED.
THERE'S ALL HARASSMENT HERE, BUT IT'S OKAY.
IT'S OKAY BECAUSE WELL, JOHANN, THE WAY YOU, JOHAN, OKAY, JOHAN'S, ONE OF THE MOST OUTSTANDING LEADERS IN THE TOWN, HAS NOTHING TO DO WITH, WITH THE PLANNING.
THIS HAS TO DO WITH THE PLANNING BOARD.
HE'S ON THE, YOU'RE TRYING TO FORCE PEOPLE OFF THE BOARD WHO YOU DISAGREE WITH.
JUST BECAUSE THEY DISAGREE WITH YOU ON THE AADA, A YOU'RE KICKING THEM OFF THE BOARD.
OKAY? THAT'S NOT, NOT, PLEASE DON'T KEEP FORWARDING THOSE LIES.
[00:40:01]
DO THAT.BUT EVERYONE, THIS IS EXACTLY WHAT HE WANTS YOU TO SEE.
SEE, THIS IS THE EXCITEMENT THAT HE WANTS TO GIVE.
THIS IS THE SHOW THAT HE WANTS TO SHOW YOU.
SO IF YOU WANNA CONTINUE TO CONTINUE TO GO AFTER US AND NOT WORK WITH US AND, AND AGREE WITH PEOPLE WHO ARE DOING THINGS INCORRECTLY, THIS IS WHY EACH ONE OF US ARE ELECTED TO MAKE SURE THAT WE ARE FOLLOWING DEMOCRACY TO MAKE SURE THAT WE ARE FOLLOWING POLICIES AND PROCEDURES.
UNFORTUNATELY, YOU DON'T GET THAT.
IT'S ALL BY WHAT THE FEEL OF THE DAY IS.
UNFORTUNATELY, THIS IS HOW WE MANAGE AND THIS IS HOW WE ARE GOING TO WORK.
UH, COUNCILMAN HAY, GO AHEAD, PLEASE.
OKAY, THIS IS, SO WE HAVE TO REMOVE THE APPOINTMENT OF ELLEN BERNSTEIN, WHO'S NOT ABLE TO SERVE ON THE, UH, HUMAN RIGHTS COMMITTEE FROM THE AGENDA.
ANYTHING ELSE? OKAY, UH, BEFORE WE GO ON, BECAUSE PAUL SAID, MADE A STATEMENT THAT'S ABSOLUTELY NOT TRUE.
HE SAID THAT WE'VE ALWAYS, WHEN SOMEBODY WANTED TO HOLD SOMETHING OVER, ALLOWED IT TO BE HELD OVER.
WITH ONE EXCEPTION WHEN I WANTED TO HOLD SOMETHING OVER THAT PAUL REALLY WANTED, AND THEN HE HAD A VOTE TO SUSPEND THE RULES,
SO, AS COUNCILWOMAN, UH, JACKSON WAS SAYING IS YOU MAKE UP THE RULES AS YOU GO ALONG.
SO YOU SAY, HEY, WE HAVE AN, I HAVE AN ABSOLUTE RIGHT TO DO THIS, BUT WHEN I WANTED TO HOLD SOMETHING OVER THAT YOU WANTED AND YOU WANTED TO GET YOUR WAY, YOU SUSPENDED THAT RULE SO THEY COULD BE VOTED ON OVER MY OBJECTION.
SO THE PROBLEM THAT YOU HAVE, PAUL, IS THAT I HAVE BEEN ON THIS BOARD QUITE A LONG TIME AND I KNOW WHAT HAS HAPPENED IN THE PAST.
AND SO WHEN YOU MAKE STATEMENTS THAT ARE NOT TRUE, I'M GONNA CALL YOU ON IT.
AND SO I DON'T KNOW WHAT WE'RE GOING TO DO TOMORROW.
THIS, UH, YOU KNOW, YOU YOU TRY TO MIX THIS IN WITH, HEY, WE'RE OPPOSED TO AFFORDABLE HOUSING.
WE HOPE THAT THE PEOPLE THAT ARE, UH, NO LONGER GONNA BE ON THE PLANNING BOARD AND BE PART OF A FULL-TIME EFFORT TO PROMOTE AFFORDABLE HOUSING IN TOWN, THAT'S GREAT.
THAT'S NOT DEPRIVING THEM OF WORKING TO DO AFFORDABLE HOUSING.
WHAT WE'RE SAYING IS NOT, WHAT IS APPROPRIATE IS FOR WORKING PEOPLE TO WORK WITH A DEVELOPER TO DEVELOP LAND IN THE UNINCORPORATED AREA OF THE TOWN OF GREENBURG, AND THEN COME TO THE PLANNING BOARD ON, UPON WHICH THEY SWITCH, UH, SIT.
THERE'S THREE MEMBERS THAT ARE PERMANENT.
SO POTENTIALLY BOARD MEMBERS IN THE PLANNING BOARD THEN GETS TO DECIDE, OH GEE, I WONDER WHICH WAY THEY'RE GONNA VOTE ON A PROJECT THAT THEY HELPED THE DEVELOPER DEVELOP.
AND YOU CAN, YOU CAN MAKE IT SEEM LIKE WE'RE OPPOSED TO AFFORDABLE HOUSING.
NO, WE HOPE PEOPLE REALLY DO GO OUT AND WORK TO DEVELOP AFFORDABLE HOUSING.
WE ARE KNOWN FOR IT IN THE TOWN OF GREENBURG.
SO THAT NARRATIVE JUST ISN'T GONNA FLY EXCEPT FOR THE FEW PEOPLE THAT BENEFIT FROM IT.
SO LET'S SAY ANYTHING ELSE ON THE AGENDA.
SO WE'RE GONNA GET THE OTHER, THE WRITEUPS FOR EVERYONE IN THE MOMENT.
WE'LL GET THE WRITEUPS FOR THAT.
YEAH, I WAS TRYING TO PUT THE, UH, PICTURES UP, UM, BUT I WAS HAVING TROUBLE DOING THAT BECAUSE OF THE FORMAT THAT THEY, UH, THAT THEY WERE IN.
UM, JOY HAS AN ABSOLUTE EXPERTISE IN TAKING 2000 WORD OBITUARY AND DISTILLING IT DOWN.
UH, PAUL, PAUL IN A, AN OBITUARY FOR, UM, UH, PHILLIPS, AND, UH, YOU KNOW, IT'S PROBABLY OVER 2000 WORDS.
UH, WE CAN'T DO THAT ON OUR AGENDA.
UM, FIRST OF ALL, IT DOES A DISSERVICE TO EVERYBODY ELSE WHO'S ON THE AGENDA.
YOU KNOW, THAT WE DON'T DO 2000 WORDS.
SO WE NEED TO HAVE SOME KIND OF A STANDARD FOR THE PEOPLE THAT ARE ON THERE.
DO YOU HAVE A, TO SHARE WITH ME THE, ALL THE OBITUARY? IT'S ON THE EMAIL.
I DIDN'T SEE, I DIDN'T, THE QUESTION WE'LL, WE'LL HAVE TOLL, WE'LL GET IT TO A FEW LINES FOR EVERYBODY.
I THINK THAT WAS THE ONLY OTHER THING, RIGHT? I DO HAVE A, UH, QUESTION REGARDING THE RESOLUTION WHERE WE'RE PAYING FOR DAMAGE TO A CAR THAT, UH, SEVERAL THOUSAND DOLLARS OF DAMAGE TO A, A VEHICLE THAT WAS PARKED AT ANTHONY VETERAN PARK IN THE PARKING LOT BECAUSE PEOPLE WERE DOING LANDSCAPING.
I HAVE A HARD TIME UNDERSTANDING
[00:45:01]
HOW SO MUCH DAMAGE COULD BE DONE.YOU WOULD THINK AFTER THE, THE FIRST IMPACT OF A THROWN STONE OR SOMETHING LIKE THAT, UM, THAT THE PERSON WOULD'VE STOPPED.
WHICH ONE IS THAT? UM, FRANCIS.
UH, I DON'T HAVE THE AGENDA IN FRONT OF ME.
UM, BUT IT'S, IT'S ONE OF THE, UH, CLAIMS, UM, OH, I KNOW WHO IT IS.
IT'S AN, IT'S, UM, I WAS THINKING IT WAS 13, BUT I DON'T THINK IT'S THE ONE, UH, IT'S, UM, OLIVER.
SO WE COULD, WE COULD PROVIDE A MEMO TO THE BOARD BEFORE YOU VOTE TOMORROW NIGHT.
AND IF THERE'S ANY FURTHER QUESTIONS THEN, YOU KNOW, YOU COULD FEEL FREE TO HOLD IT OVER, BUT WE WILL PROVIDE ADDITIONAL INFORMATION FOR ALL OF THESE.
BECAUSE MOST OF THEM ARE PRETTY CLEAR CUT.
I THINK THAT'S THE ONE THAT, OKAY.
SO MY QUESTION ISN'T SO MUCH QUESTIONING THE DAMAGE, IT'S HOW DID, HOW DID OUR PEOPLE CONTINUE TO CREATE THAT AMOUNT OF DAMAGE? UH, IF IT, IF THE VEHICLE, IF THE, UH, LAWNMOWER OR WHATEVER WAS BEING USED, FIRST OF ALL, THE, MOST OF THE PARKING LOT IS VERY FAR AWAY FROM ANY, ANY GRASS.
SO I, I'D JUST LIKE TO GET SOME MORE DETAILS ABOUT WHAT THAT IS.
I'LL PROVIDE THAT TO THE ENTIRE BOARD.
AND THE MEMO THAT WE HAVE DOESN'T EXPLAN.
SO BY THE WAY, YOU ALL LOOK GREAT ON THE OWL
EVERY ONE OF YOU IS INDIVIDUALLY, YOU KNOW, THERE.
UM, AND THEN IT'S A 360, UH, DEGREE IMAGE OF THE ROOM.
I CAN SEE LISA IS SMILING AWAY.
DOES ANYBODY HAVE ANYTHING ELSE? NO.
COUNCILMAN SHEEN? COUNCILWOMAN? I'M GOOD.
COUNCILWOMAN? UH, UH, HENDRICKS? NO.
COUNCILMAN HABER? I'M STILL LOOKING THROUGH, BUT NO, I DON'T THINK SO.
SO WE'RE GONNA, SO WE CAN MOVE THEN, MAKE A RIGHT.
AND, UM, FOR THE PEOPLE WHO WERE, UM, CONCERNED ABOUT THE GREENBERG NATURE CENTER, UM, YOU KNOW, CONTRACT THAT'S GONNA BE DISCUSSED IN EXECUTIVE SESSION.
SO I MOVE THAT, UH, WE, UH, HAVE AN EXECUTIVE SESSION FOR THE PURPOSES OF, UH, INTERVIEWING, UM, UM, CANDIDATE PERSONNEL MATTERS, UH, INVOLVING SPECIFIC INDIVIDUALS AND TO SEEK LEGAL ADVICE ON VARIOUS MATTERS INCLUDING, UH, THE GREENBERG NATURE CENTER CONTRACT.
WE WON'T BE COMING BACK TILL TOMORROW EVENING FOR OUR TOMORROW BOARD MEETING TOMORROW EVENING.
