OKAY.

UH, WELCOME

[ TOWN OF GREENBURGH OFFICE OF THE TOWN BOARD 177 Hillside Avenue, Greenburgh, NY 10607 Tel: 914-989-1525 Fax: 914-993-1541 Email: JDudek@Greenburghny.com https://ny-greenburgh.civicplus.com/485/Watch-Live-Board-Meetings]

TO OUR WORK SESSION.

THIS IS A CONTINUATION OF THE WORK SESSION.

WE HAD, UM, A MEETING AT A HUNDRED EAST HEARTS DAILY AVENUE EARLIER, UH, TODAY.

UM, COUNCILMAN SHEAN, UM, UM, ALL OF US WERE, WERE, WERE AT THE MEETING, UM, AND I THOUGHT THE PUBLIC WORKS DEPARTMENT AND POLICE DEPARTMENT DID A GOOD JOB.

THEY'RE MAKING A NUMBER OF SAFETY IMPROVEMENTS.

THEY INDICATED THAT, UM, THEY'RE GONNA BE PUTTING IN A TEMPORARY SIDEWALK.

UM, SO PEOPLE ON EAST HARTSDALE AVENUE WILL BE ABLE TO WALK TO THE TRAIN STATION IN THE DOWNTOWN AREA.

AND THAT SHOULD BE DONE, UH, SOON.

AND THEY INDICATED THAT THE CONSTRUCTION SHOULD START IN JANUARY.

THE DESIGN PLAN WILL BE DECEMBER, AND THEN THE CONSTRUCTION WILL START IN JANUARY.

SO I THOUGHT IT WAS A REALLY GOOD MEETING.

YES.

THEY HOPE, EXCUSE ME.

AND THEY HOPE TO HAVE THE, UM, THE CONSTRUCTION DONE BY THE SPRING SO THEY CAN PAY REPAVE THAT AND, UM, AND IT, AND PAINT THE, THE LINES AND THE, AND THE CROSSWALKS.

BUT THEY DIDN'T SAY SPRING OF WHAT YEAR.

NO, THAT'S A JOKE.

BUT, UM, NO, IT WAS GOOD BECAUSE I THINK WE ANSWERED A LOT OF THE RESIDENTS QUESTIONS.

UM, THEY HAD A LOT OF QUESTIONS, AND I THINK, UM, EVERYONE WAS VERY RESPONSIVE TO THEM.

AND WE'LL CONTINUE TO KEEP THEM INFORMED NOW THAT WE HAVE, LIKE, WE'RE GETTING MORE LIKE REAL DETAILED INFORMATION START, STARTING TO HAPPEN.

YEAH.

AND I JUST WANT TO THANK RICH, UH, FUN AND FRANK MODO.

RIGHT.

UM, THE, AND SERGEANT FONT AND CJ FOR DOING A REALLY EXCELLENT JOB.

THEY'RE REALLY WORKING VERY HARD.

UM, SO NEXT, UH, WE HAVE, UH, THE DONATION OF PROPERTY 55 CUMMINGS AVENUE.

WE'RE GONNA HAVE TO RESCHEDULE THAT.

UM, THE OVERNIGHT PARKING FOR RESIDENTS OF A HUNDRED EAST HARTSDALE AVENUE, SOME RESIDENTS, UM, OF EAST HARTSDALE AVENUE.

THEY SAID BECAUSE OF THE CONSTRUCTION, THEY WONDERED WHAT WE'RE GONNA BE DOING DURING THE WINTER MONTHS.

AND, UM, I SPOKE TO JOE LUCCHESE.

PEOPLE HAVE ACCESS TO WHAT FIELD? RICHARD PARK, UH, PRESTON PARK, OUR PARKS COMMISSIONER.

YES.

RIGHT, JOE.

SO, UH, THAT'S THAT.

UM, AND THEN THE, THE ISSUE WITH THE ELECTION SIGNAGE AT THE MUNICIPAL PARKING LOTS, UM, SOME PEOPLE, UH, DURING THEIR EARLY VOTING HAD COMPLAINED.

THEY DIDN'T LIKE THE IDEA THAT, UM, THAT DURING THEIR EARLY VOTING, UH, THEY SAW ALL THESE ELECTION SIGNS.

WE LET CANDIDATES FROM ALL PARTIES, UH, YOU KNOW, UM, PUT UP SIGNS.

BUT I SORT OF THINK THAT, BUT IT HAD TO BE OUTSIDE OF THE A HUNDRED FOOT PERIMETER, WHICH WE, WE ADHERED TO, AND THAT'S THE LAW.

RIGHT.

BUT I STILL THINK THAT, UM, WHEN PEOPLE ARE VOTING, UM, YOU KNOW, I WOULD'VE PREFERRED IF WE HAD A LAW, UH, SAYING GOING FORWARD THAT THE MUNICIPAL PARKING LOT SHOULD NOT BE USED FOR POLITICAL CAMPAIGNING.

IF PEOPLE WANNA PUT UP SIGNS OUTSIDE THE BUILDING, I THINK THAT'S FINE.

UH, BUT I DON'T, I THINK WHEN PEOPLE ARE HERE WAITING ONLINE, I DON'T THINK THERE SHOULD BE ANY, UM, POLITICAL ADVERTISING.

AND I'M, THAT'S THE WAY IT IS OUT IN EVERY POLLING SITE.

YES.

THAT IT JUST A HUNDRED FEET, IT DOESN'T CHANGED YOUR MIND WHEN, WHEN, UM, WHEN A FORMER ASSEMBLYMAN PUT HIS SIGNS OUT AND WHEN A FORMER CLERK PUT PARKED A CAR WITH A HUGE SIGN RIGHT OUTSIDE THAT LINE.

I, I BET, YOU KNOW, I, I, I THINK IT'S ONLY FAIR THE, THIS IS A, AN ELECTION.

WE ARE ALL GIVEN THE, THE DEMOCRATIC ABILITY TO VOTE AND TO MAKE OUR CHOICES.

AND, UM, AND SOMETIMES PEOPLE AREN'T AWARE.

SO IT'S, IT'S EDUCATIONAL FOR THEM TO KNOW.

THAT'S FINE.

YOU KNOW, I JUST BASICALLY GOT COMPLAINTS FROM RESIDENTS AND I FELT THAT PEOPLE FELT, WHEN THEY WERE ONLINE, THEY FELT THAT THE, YOU KNOW, A LOT OF PEOPLE DON'T TRUST GOVERNMENT.

YOU KNOW, THAT'S SAY THAT'S THAT.

BUT WE HAVE THE LAW ON WE WERE, WE WERE ACTING WITHIN THE RULES OF THE LAW.

OKAY, THAT'S FINE.

AND EVERY SIDE THAT WE, THAT, YOU KNOW, IF EVERYBODY WANTS TO, I JUST WANTED TO BRING IT UP BECAUSE PEOPLE COMPLAINED.

YES.

AND ABSOLUTELY.

AND IT'S FINE FOR US TO EXPLAIN TO THE PUBLIC WHO ARE TUNING IN TONIGHT THAT WE ADHERE TO THE LAW, YOU KNOW, ACCORDING TO WHERE WE HAD THE SIGNAGE AND THAT THAT WAS, UM, EXPLAINED EVEN FURTHER TO CERTAIN PEOPLE AND WHATEVER.

SO, BUT IT SHOULD ALSO BE POINTED OUT IN THE PARKS DEPARTMENT, YOU CAN'T PUT A SIGN, UH, A CAMPAIGN SIGN IN THE PARKS.

I REMEMBER WHEN I WAS RUNNING MM-HMM.

, UM, UH, THEY TOOK DOWN MY SIGNS, UH, IN THE VETERAN PARK BECAUSE THEY SAID THAT I WAS ON THE TOWN RIGHT AWAY.

RIGHT.

THEY REMOVED IT.

SO, YEAH.

AND THEY REMOVED IT FROM A LOT OF THE PARKS.

AND I SORT OF FEEL THAT, UM, YOU KNOW, THEY DID IT.

AND I, I RESPECT THE PARKS DEPARTMENT NOT WANTING TO POLITICIZE, UH, UH, HAVING THE LAUNCH SIGNS.

AND I SORT OF REALLY, I STILL FEEL THAT, UH, WHEN PEOPLE ARE VOTING, UM, IT WOULD, IT WOULD MAKE PEOPLE MORE COMFORTABLE AND FEEL BETTER.

BUT

[00:05:01]

THE DIFFERENCE, THE DIFFERENT SUPERVISOR IS THIS IS A POLLING SITE.

SO FOR THE, THE DURATION OF THE ELECTION, THIS IS A POLLING SITE, WHEREAS THE PARKS DEPARTMENT IS NOT.

SO THAT'S FINE.

YOU KNOW, THAT'S END OF THAT.

OKAY.

OKAY.

NOW WE COULD GO ONTO AGENDA REVIEW.

UM, PAUL, I JUST WANT TO MAKE, UM, A POINT THAT WE ALSO HAD THAT DISCUSSION ABOUT THE, UM, ABOUT THE SIGNAGE BECAUSE THE, UM, ELECTIONS AND THE POLLING FALLS UNDER THE TOWN CLERK'S OFFICE.

SO I JUST WANNA MAKE SURE THAT, UM, THE RESIDENTS ARE AWARE.

WE DID HAVE THE CONVERSATION, WE HAD THE CONVERSATION IN ASSOCIATION WITH BOTH, UH, COMMISSIONERS OF BOTH REPUBLICAN AND THE DEMOCRATIC, UM, COMMISSIONERS OF THE BOARD OF ELECTIONS.

AND THEN THAT'S WHEN WE HAD, UM, UH, DISCUSSED THAT THIS WAS PAST PRACTICE AS WELL.

MM-HMM.

.

SO AS LONG AS IT WAS, UM, BEYOND THE 100 PART, UM, 100 FOOT MARK MM-HMM.

, WHICH ARE PAST PRACTICE PLACES THAT AT THE END OF OUR WALKWAY MM-HMM.

.

THEN THAT WAS WHAT WAS AGREED UPON WHEN WE HAD, SORRY.

OKAY.

THAT'S TO MAKE SURE.

THANK YOU MADAM CLERK.

OKAY.

SO LET'S NOW GO THROUGH THE AGENDA.

AND I JUST WANT TO QUICKLY POINT OUT, SHOULD HAVE MENTIONED THIS AT THE START, THAT COUNCIL MEMBERS JACKSON AND SHEHAN ARE ON ZOOM.

WE'RE IN COMPLIANCE WITH STATE AND TOWN LAWS NOW THAT WE HAVE A QUORUM OF THREE PHYSICALLY PRESENT WITHIN TOWN LAW.

THANK YOU.

THANK YOU.

OKAY.

LET'S SEE.

COMMISSIONER DUANE HAD SENT CORRESPONDENCE ABOUT HOLDING OVER THE PUBLIC HEARING THAT WAS ORIGINALLY SCHEDULED FOR TOMORROW NIGHT IN REGARDS TO ACCESSORY DWELLING UNITS, I BELIEVE TO THE NOVEMBER 25TH MEETING, OR THE DECEMBER 11TH.

I'M NOT SURE IF DECEMBER COMMISSIONER'S ON DECEMBER.

YES.

DECEMBER 11TH MEETING.

THAT'S NOT CURRENTLY NOTED.

UM, ON THE AGENDA.

OKAY.

SO, RIGHT.

AND I, I DID POST IT ON THE TOWN WEBSITE, UH, I THINK OVER THE WEEKEND OR LAST WEEK.

OKAY.

YES.

WHAT IS THE PRESENTATION? WHOSE PRESENTATION IS IT? UH, NO, THIS IS JUST, UM, THE ACCESSORY DWELLING UNIT.

NO, NO, NO.

THE PRESENTATION OF THE ARTS AND CULTURE COMMITTEE.

WHAT, WHAT IS THAT? OH, NO, SHE BASICALLY, UM, THAT'S SARAH BRACY WHITE.

UM, MIRIAM.

MIRIAM.

OH, OKAY.

HAS BASICALLY BEEN DOING INTERVIEWS WITH ALL THE ARTISTS.

OKAY.

AND WE'VE BEEN DOING REALLY NICE VIDEOS AND IT'S REALLY ENHANCED OUR, UH, ARTS PROGRAMS. SO WHAT IS THE PRESENTATION? SHE'S GIVING HER AN AWARD.

OKAY.

CRS, BUT IT'LL BE WITHIN OUR TIMEFRAME OF 10 MINUTES.

RIGHT.

YEAH.

WE'LL LEAVE LIKE FIVE MINUTES.

OKAY, GREAT.

THANK YOU.

SORRY, LEMME SEE WHAT ELSE, WHO'S GIVEN THE AWARD? IS THE AWARD FROM TOWN BOARD OR IS THE AWARD FROM SARAH? IT'S AWARD FROM SARAH? WELL, WHILE I STEPPED AWAY, IS THIS AGENDA REVIEW AT PRESENT? YES.

YES.

GARRETT, I JUST MENTIONED THAT THE PUBLIC HEARING IS BEING HELD OVER TO DECEMBER 11TH.

THAT'S CORRECT.

AND IN THE INTERIM, WE ARE STILL COMPILING, UH, QUESTIONS FROM THE PUBLIC AND, UH, PROVIDING RESPONSES SO THAT WE CAN UPLOAD THEM.

UH, SO THAT GOING INTO THAT UPDATED PUBLIC HEARING DATE, UM, THE PUBLIC WILL HAVE THE BENEFIT OF THOSE RESPONSES.

OKAY.

AND ULTIMATELY, I'D LIKE TO COORDINATE A, UH, WORK SESSION DATE WITH THE TOWN BOARD, UM, TO DISCUSS, UM, WHICH UPDATED LOCAL LAW TO POST.

THERE'S SOME QUESTIONS THAT ARE, UM, OUT THERE BASED ON COMMENTS FROM THE PUBLIC, AND I'D LIKE TO GAUGE THE TOWN BOARD'S, UM, UM, REACTIONS ON WHETHER YOU'D LIKE SOME CHANGES MADE TO THE LOCAL LAW.

I HAVE ONE OR TWO SUGGESTIONS THAT I WOULD LIKE TO.

OKAY.

YES.

AND, AND COMMISSIONER, WOULD YOU TURN YOUR VOLUME UP JUST A BIT? YEAH, SURE WILL DO.

THANK YOU.

OKAY.

UM, NEXT, UM, WITH THE BAIT COURT, THET FOUR, I'VE BEEN IN TOUCH WITH, UM, CJ AND HE'S WORKING, HE'S BEEN PROVIDING, UM, UPDATES, UH, UH, TO RESIDENTS OF BABBITT COURT.

'CAUSE I WANNA MAKE SURE THAT THEY'RE NOTIFIED OF ALL THE ACTION THAT IS A LONG PROCESS, UPLIFTING THE HOMES.

BUT, UM, YOU KNOW, WE WANNA MAKE SURE THAT THE RESIDENTS FEEL THAT THEY'RE, THAT THEY'RE BEING KEPT INFORMED.

OKAY.

UM, THE, UH, TB SIX, UH, THE, UH, THE LEASE AGREEMENT WITH,

[00:10:01]

UH, THE GREENBERG NATURE CENTER, UM, ARE WE ALL READY FOR THAT? I HAVE TO HAVE A FOLLOW UP CONVERSATION WITH THEIR COUNSEL? IT IS, YOU KNOW, WE, WE WOULD LIKE TO HAVE THIS FINALIZED BY TOMORROW NIGHT.

UM, IF WE ARE NOT 100% IN COMPLIANCE WITH THOSE TERMS, I CAN NOTIFY THE BOARD AND PERHAPS WE CAN HOLD IT OVER TO THE NOVEMBER 25TH MEETING.

BUT I'M HOPEFUL THAT WE COULD HAVE THIS RESOLVED VERY SOON.

OKAY.

THANK YOU.

THAT'S GOOD.

THEY DID.

I WENT TO THE NATURE CENTER, UH, ON, UM, I THINK FRIDAY.

AND IT'S LIKE AMAZING.

THEY HAVE A STORY, WALK A NEW TRAIL.

MM-HMM.

IT IS LIKE SO SPECTACULAR.

AND, UH, THEY'RE CREATING A NEW VISITOR CENTER.

UM, SO I WAS LIKE, LIKE, YOU KNOW, THEY HAVE A, AN, THEY HAVE LIKE A LITTLE HOUSE FOR A TURTLE WHO'S LIVING, UH, THEY EXPECT THE TURTLE TO LIVE TO 150.

WOW.

WOW.

SO THEY, THEY, IT IS LIKE SMALL LITTLE HOUSE THAT'S HEATED MM-HMM.

.

UM, AND, UH, THAT'S SORT OF AT THE ENTRANCE, BUT I WAS LIKE, SO LIKE STUNNED BY HOW, HOW MUCH PROGRESS THE NATURE CENTER HAS DONE.

WE WERE JUST THERE RECENTLY.

I AGREE.

WE WERE JUST WALKING THROUGH AND IT WAS LOOKED REALLY GREAT.

THEY'VE DONE BEAUTIFUL THINGS.

YEAH.

AND, AND KATHY'S MEADOW IS BEAUTIFUL.

AND, YOU KNOW, IN THE, IN THE, UH, SUMMER, THE BUTTERFLIES, IT'S JUST SPECTACULAR.

YEAH.

SO, BUT IT'S LIKE AMAZING HOW MUCH, HOW MUCH IMPROVEMENTS THEY'VE BEEN MAKING AND, YOU KNOW, I REALLY WAS IMPRESSED.

UM, OKAY.

LET'S SEE, WHAT ELSE? I HAVE A RESOLUTION ON 18 NINE AUTHORIZING THE RETENTION OF A, OF A FIRM TO HANDLE OUR FORECLOSURES, UM, TO BRING US MORE UP TO DATE WITH THE AMOUNT OF LIENS WE CURRENTLY HAVE.

THAT'S GREAT.

EXCELLENT.

THANK YOU.

OKAY.

I ALSO HAVE AN UPDATE WITH RESPECT TO, UH, CD THREE, CD FOUR, AND CD FIVE.

SO THOSE WERE POSTED.

AND ALL THREE OF THOSE RE RESOLUTIONS HAVE TO DO WITH ONGOING PLANNING THAT THE TOWN OF GREENBURG, UH, AND THE NEW YORK STATE DEPARTMENT OF TRANSPORTATION, AS WELL AS THE DEVELOPER FOR THE ELMWOOD, UH, 113 LOT SUBDIVISION.

UM, I'M RESPECTFULLY ASKING THAT THOSE, UH, RESOLUTIONS BE HELD UNTIL, UH, THE NOVEMBER 25TH MEETING.

BUT I WANT THE BOARD TO REST ASSURED, AND I WANT THE PUBLIC TO BE AWARE THAT TOWN STAFF ARE WORKING VERY CLOSELY WITH THOSE TWO OTHER PARTIES, THE STATE AND THE DEVELOPER, UM, WITH THE GOAL OF LINING UP THE SPRAIN PARK RAMPS AT DOBBS FERRY ROAD AND AFFECTING A SAFER AND NEW ENTRANCE THROUGH THE 14.2 ACRES THAT THE TOWN OF GREENBURG WILL ULTIMATELY, UM, TAKE OWNERSHIP OF AS A RESULT OF THAT SUBDIVISION.

SO, UM, BEHIND THE SCENES, LONG STORY SHORT, WE'RE WORKING VERY HARD TO, UM, WORK THIS PUBLIC PRIVATE PARTNERSHIP TO, UH, AFFECT THE SAFETY IMPROVEMENTS, WHICH WILL LARGELY BE LED BY THE DOT, BUT THERE ARE SOME COMMITMENTS FROM THE DEVELOPER IN THE TOWN OF GREENBURG.

UM, BUT WE'RE CLOSE.

BUT I, I'M GONNA PRESENT THESE IN MORE DETAIL, UH, IN ADVANCE TO THE NOVEMBER 25TH MEETING.

SO I WILL RESPECTFULLY REQUEST THAT THOSE BE IDENTIFIED AS TO BE HELD OVER OR WHATEVER THE PROPER TERMINOLOGY IS.

THANK YOU.

THAT'S, THANK YOU, COMMISSIONER.

UM, I JUST WANTED TO MAKE NOTE THAT, UM, I HAD ASKED, UM, COMMISSIONER LUC CASEY TO MAKE SURE THAT THE NOVEMBER 25TH MEETING WAS ON THE, UH, WEBSITE AS FAR AS A CHANGE FROM THE WEDNESDAY.

OKAY.

I SEE IT TALK TODAY DUE TO THANKSGIVING, CORRECT? MM-HMM.

.

LEMME SEE IF THERE'S ANYTHING ELSE.

ANYTHING ELSE? THAT LOOKS GOOD TO ME.

OKAY.

SO THEN, THANK YOU.

ANY QUESTIONS I HAD WERE ASKED? SO, OKAY.

SO THEN I'D LIKE TO MOVE THAT WE GO INTO EXECUTIVE SESSION FOR THE PURPOSES OF DISCUSSING PERSONAL MATTERS INVOLVING SPECIFIC INDIVIDUALS AND TO SEEK LEGAL ADVICE ON VARIOUS MATTERS.

SECOND, THAT'S PERFECT.

ALL IN FAVOR? ALL IN FAVOR.

AYE.

AYE.

AYE.
