SO WHAT YOU SEE ON THIS SCREEN RIGHT NOW IS A STACKING PLAN AND, UH, WE HAVE DESIGNATED AREAS THAT ARE MAPPED OUT IN THE TRAFFIC MANAGEMENT PLAN. NOW, THE TRAFFIC MANAGEMENT PLAN IS FOR GRAND OPENING PERIODS, BUT ALSO IF THERE'S A SURGE, A SPECIAL EVENT GOING ON AT COUNTY CENTER, IT'S KEPT ON SITE AND IT WILL BE USED TO MANAGE THE TRAFFIC, UH, IS SPELLED OUT IN THAT MANAGEMENT PLAN 30 DAYS PRIOR TO OPENING. WE WILL BE MEETING WITH THE POLICE DEPARTMENT, THE TOWNS CONSULTANT, UH, TO GO OVER THE PLAN, MAKE ANY FINE, UH, LAST MINUTE CHANGES. UH, AS PART OF THE PLAN CHICK-FIL-A WILL PAY FOR, UH, UH, OFF-DUTY, UH, POLICE, UH, FROM, UH, GREENBURG. SO, UH, AFTER THE CHANGES FROM WHITE PLAINS OF NOT HAVING THAT QUOTE EXTRA LOT FOR, FOR STORAGE, UH, WE WENT THROUGH THE PLANS, UH, WITH THE POLICE DEPARTMENT AND YOUR TOWN TRAFFIC CONSULTANT. SO WE HAVE AS DISPLAYED ON THIS DRAWING, UH, ONCE THE NORMAL PEAK STACKING REACHES THE POINT LABELED A ON THAT DRAWING, UH, WE, WE HAVE AN AREA WHICH ARE ON THE NORMAL CONDITIONS WOULD BE PARKING SPACES ALONG THE WESTERLY PORTION OF THE SITE THAT'S ANGLED PARKING ONE WAY SYSTEM, UH, WHICH WAS DEVELOPED AND FINE TUNED ACTUALLY THROUGH DISCUSSIONS WITH THE PLANNING BOARD. AND THAT AREA, UH, DURING THE GRAND OPENING PERIOD WOULD BE CONNED OFF. SO PEOPLE COMING TO THE SITE WOULD NOT PARK IN THOSE SPACES DURING THE GRAND OPENING PLAN. IT WOULD BE USED FOR EXTRA VEHICLE STACKING, AND WE CAN PROVIDE, UH, TWO LANES OF STACKING THERE IN THAT AREA. UH, WHEN THE STACK WOULD REACH UP TO THE POINT LABELED B, UM, THEN WE WOULD, UH, EXTEND THE STACKING. SO THIS, I THINK IS EXHIBIT ONE OR TWO, CHARLIE, DOES IT SHOW ON THE BOTTOM OF THAT? I THINK? AND I'D LIKE TO POINT OUT THAT THAT DRIVEWAY LOCATION, UH, ON THIS SITE PLAN IS ACTUALLY SHIFTED AWAY FROM WHERE THE, THE CURRENT DRIVEWAY IS TODAY TO THE SITE. THE, THE DRIVEWAY IS SHIFTED FURTHER NORTH AWAY FROM THE SITE. SO JUST SO YOU UNDERSTAND THAT, THAT REPRESENTS THE FUTURE CONDITION OF THAT DRIVEWAY. UM, UNDER THIS PLAN, I BELIEVE WE HAVE 55 SPACES FOR STACKING, I BELIEVE IS THE, THE NUMBER. AND, UM, WHAT WE FOUND AT THE YONKERS FACILITY DURING THE GRAND OPENING, AND THEY DID NOT HAVE THE ABILITY TO STACK 55 CARS ON THE SITE. UH, SO WHAT THE POLICE DEPARTMENT DID ACTUALLY, UH, HAD THE VEHICLES QUEUE ALONG THE PARKING LANE OF CENTRAL PARK AVENUE. AND THAT WENT ON FOR SEVERAL DAYS. WE WENT BACK AND MADE OBSERVATIONS, WHICH ARE ALL REPORTED TO IN OUR OCTOBER 9TH LETTER TO THE PLANNING BOARD. AND WE FOUND THAT, YOU KNOW, AFTER THAT INITIAL GRAND OPENING, THAT THINGS STABILIZED AND WENT TO WHAT WE WOULD CALL NORMAL CONDITIONS. NOW DURING THAT TIME PERIOD, THE, UH, WALK-IN FACILITY, UH, AT, UH, THE MIDWAY SHOPPING CENTER ALSO OPENED, UH, IN AUGUST. SO THAT, UH, WAS ANOTHER VARIABLE THAT CAME INTO PLAY THERE. SO, UM, DURING THE PEAK, INCLUDING THE VEHICLES THAT WERE STACKING ON CENTRAL PARK AVENUE IN YONKERS, UH, THE MAXIMUM WE OBSERVED WAS AROUND 50 VEHICLES. I THINK IT WAS 52 ON ONE DAY, UH, WHICH WE HAVE ON THIS PLAN 55 VEHICLE STACKING THE, UH, PLAN IN TERMS OF THE, UH, ONSITE, UH, CONTROL CAN BE DONE BY TEAM MEMBERS. ANYTHING RELATED TO THE DRIVEWAYS OF OR OFFSITE ARE COORDINATED WITH THE POLICE DEPARTMENT AND WOULD BE CONTROLLED BY THE POLICE BECAUSE THE TEAM MEMBERS CAN'T GO INTO THE ROADWAY. THEY CAN ONLY WORK ON THE SITE. TO ME, THAT CREATES A BOTTLENECK. BUT IT ALSO ELIMINATES 14 PARKING SPACES THAT RUN ALONG THE SIDE OF OLD KENSICO. AND IF YOU COUNT IN THREE, THREE LANES OF TRAFFIC, IT LITERALLY LEAVES NO ROOM 11 FEET OR LESS FOR THE, FOR AN ONCOMING CAR TO GET INTO THE DIAGONAL, BUT INTO THE SLANTED PARKING SPACES, THE ANGLED PARKING SPACES THAT ARE, UH, IN THE MIDDLE OF THE PROPERTY. SO THEY'RE 13 ANGLED SPACES ACROSS FROM THE 14 THEY'RE GONNA ELIMINATE FOR GRAND OPENING. OKAY? THOSE SPACES WILL NOT BE ABLE TO BE USED. SO THEY'RE ALREADY LOOKING AT OVER 50 CARS IN THE STACKING LIMITS. SO THOSE PEOPLE ARE GOING TO BE RECOMMENDED TO PARK, BUT THERE AREN'T ANY PARKING SPACES TO PARK IT. UH, SO WHAT AN BRINGING AN ACTIVE USE TO THIS SITE WILL DO, WILL BE ENSURE THAT IT IS CONSTANTLY CLEAN. CHICK-FIL-A TAKES GREAT PRIDE IN ITS PROPERTIES AND ITS FACILITIES, WHICH YOU LIKELY CAN SEE FROM THE CURRENT GREENBURG FACILITY OR THE YONKERS FACILITY. ALL GARBAGE WILL BE SWEPT AND CLEANED DAILY. UH, THERE IS A COMPLETELY ENCLOSED REFUSE LOCATION, WHICH WILL DETER ANY ANIMALS FROM GETTING IN THERE. AND CERTAINLY THE SITE WITH AN ACTIVE USE ON IT WILL BE MUCH MORE CLEAN THAN CURRENTLY EXISTS, UH, RELATED TO AIR POLLUTION AND, UH, SMELLS. THERE IS NO STATE REGULATED AIR EMISSION SOURCE HERE. WE'RE NOT TALKING ABOUT A POWER PLANT, WE'RE SIMPLY TALKING ABOUT A RESTAURANT. UH, THERE WAS A CONCERN FROM THAT OWNER OF 10 COUNTY CENTER ROAD THAT WE DISCUSSED WITH HIM AT LENGTH WAS SOMETIMES YOU CAN SMELL BURGER KING. UM, CHICK-FIL-A IS VERY DIFFERENT. CHICK-FIL-A, UH, COOKS ALL THEIR FOOD IN PRESSURE COOKERS AND HAS PROPER VENTILATION SYSTEMS. SO THERE WILL BE NO ODORS EMANATING FROM THE BUILDING. LET'S SEE, WHAT ELSE DO WE HAVE HERE? AMENDED SEEKER DETERMINATION DATED OCTOBER 16TH, 2024, RELATED TO OUTDOOR SEATING ASSOCIATED WITH A QUICK SERVICE FAST FOOD ESTABLISHMENT. THE APPLICANT'S PLANS HAVE SHOWN PROPOSED OUTDOOR SEATING SINCE THE PROJECT WAS ORIGINALLY DISCUSSED BY THE PLANNING BOARD AS PART OF A PRE-SUBMISSION CONFERENCE HELD ON MAY 18TH, 2022. IN RESPONSE TO THE COMMENT RELATED TO A STATEMENT PROVIDED IN A LETTER TRANSMITTED BY THE CITY OF WHITE PLAINS PLANNING BOARD SECRETARY EILEEN MCLEAN DATED JULY 18TH, 2024, RELATED TO A REQUEST WITH, UH, RELATED TO A REQUEST THAT WITH RESPECT TO THE CHICK-FIL-A APPLICATION IN GREENBURG, ANY APPROVAL NOT INCLUDE THE COMMERCIAL PARKING LOT IN THE CITY OF WHITE PLAINS FOR MEETING PARKING REQUIREMENTS. PLEASE NOTE, THE CITY OF WHITE PLAINS PLANNING BOARD RESOLUTION FOR SPECIAL PERMIT AND SITE PLAN APPROVALS FOR THE NEW COMMERCIAL PARKING LOT ADOPTED OCTOBER 15TH, 2024, ONLY PROHIBITS THE USE OF THE COMMERCIAL PARKING LOT FOR QUEUING OF CUSTOMER VEHICLES. OUR OFFICE IS ALSO IN RECEIPT OF CORRESPONDENCE BY THE COUNCIL OF GREENBURG CIVIC ASSOCIATIONS DATED NOVEMBER 12TH, 2024, WHICH WAS SENT OR, OR DIRECTED TO DEPUTY BUILDING INSPECTOR ELIZABETH GARRITY. THAT DOCUMENT WAS ALSO FORWARDED TO THE PLANNING BOARD IN AN EMAIL DATED NOVEMBER 14TH, 2024. MS. GARRITY RESPONDED TO THE CORRESPONDENCE RECEIVED THANKING THE CGCA OR COUNCIL OF GREENBERG CIVIC ASSOCIATIONS FOR POINTING OUT THE TOPO TYPOGRAPHICAL ERRORS IN CODE SECTIONS ON THE DENIAL LETTER ISSUED BY THE BUILDING DEPARTMENT, WHICH WERE HAVE SINCE BEEN CORRECTED. FURTHER, THE RESPONSE FROM MS. GARRITY STATED, PLEASE BE ADVISED THAT TEMPORARY CONDITIONS AS SHOWN ON A GRAND OPENING PLAN, WHICH TEMPORARILY REDUCES AISLE WIDTH BY USING MOVABLE TRAFFIC CONES AND TEMPORARILY DIRECTS VEHICLES TO QUEUE IN PARKING SPACES BY A COMBINATION OF CHICK-FIL-A STAFF AND WITH GREENBURG POLICE ON SITE, ARE NOT UNDER THE PURVIEW OF THE BUILDING DEPARTMENT WITH REGARD TO LOT SIZE AND SETBACKS. THESE COMMENTS WERE PREVIOUSLY ADDRESSED IN A MAY 28TH, 2024 MEMORANDUM FROM THE BUILDING INSPECTOR'S OFFICE TO THE ZONING BOARD OF APPEALS. I JUST WANTED TO READ THAT INTO THE RECORD FOR THE BENEFIT OF THE BOARD MEMBERS OF THE PUBLIC AND THE APPLICANT. THANK YOU. OKAY, THANK YOU ERIN. UM, REGARDING THE CGCA COMMENTS AND THE, UM, RESIDENT MARIA GOMEZ'S COMMENTS TONIGHT ABOUT THE AMENDED NECK DECK AND THE, UH, ADDITIONAL VARIANCE FOR OUTDOOR SEATING, UM, THE PLANNING BOARD MAY MAKE RECOMMENDATIONS TO THE ZONING BOARD ON ANY VARIANCES AS IT HAS DONE HISTORICALLY AT THE REQUEST OF THE ZONING BOARD, BUT IS ONLY REQUIRED TO MAKE RECOMMENDATIONS ON VARIANCES ASSOCIATED WITH SUBDIVISION APPLICATIONS. THAT'S PURSUANT TO TOWN LAW 2 77, SECTION SIX. UH, SO THE VARIANCE HERE, WHICH THE PLANNING BOARD DID NOT NECESSARILY MAKE A RECOMMENDATION ONTO THE ZONING BOARD, WAS TO PERMIT OUTDOOR SEATING AS PREVIOUSLY DISCUSSED. ZONING BOARD DID NOT REQUEST THE PLANNING BOARD MAKE A RECOMMENDATION ON THE OUTDOOR SEATING VARIANCE BEFORE VOTING ON ALL VARIANCES AT ITS LAST MEETING, NOR DID IT REQUEST THAT THE PLANNING BOARD CONSIDER FURTHER AMENDING THE AMENDED NE NEGATIVE DECLARATION PRIOR TO ISSUING A DECISION ON THE VARIANCES. OUTDOOR SEATING HAS BEEN SHOWN ON THE PLANS PRIOR TO THE ORIGINAL SUBMISSION. THE PLANS, INCLUDING THE OUTDOOR SEATING WERE REVIEWED SUBSTANTIALLY BY PLANNING BOARD AND STAFF AT SEVERAL MEETINGS. THE APPLICANT PRESENTED THE PLANS WITH OUTDOOR SEATING AT THE PUBLIC DISCUSSION ON NOVEMBER 15TH, 2023. PLANNING BOARD MEMBERS COMMENTED ON THE OUTDOOR SEATING AND DISCUSSED POTENTIAL IMPACTS, INCLUDING THE DESIRE OF PATRONS TO SIT OUTSIDE AND NO PUBLIC COMMENTS RELATED TO THE OUTDOOR SEATING WERE MADE OR RECEIVED PRIOR TO ISSUANCE OF THE NEGATIVE DECLARATION OR AMENDED NEGATIVE DECLARATION. UM, THE PLANS WERE REVIEWED IN THEIR ENTIRETY WHEN CONSIDERING THE IMPACTS AND DRAFTING THE NEXT DECK. AND CHANGES TO PLANS OFTEN OCCUR DURING THE PLANNING REVIEW PROCESS AFTER NEC AND AMENDED NEC ARE ISSUED. GENERALLY [01:55:01] THEY'RE ASSOCIATED WITH PUBLIC COMMENTARY, SOMETIMES RECEIVED AT A PUBLIC HEARING, UH, RESULTING IN ADDITIONAL VARIANCES BEING IDENTIFIED AS REQUIRED BY SECRET. THE PUBLIC HEARING HELD AFTER SECRET DETERMINATIONS MADE CHANGES THROUGH THE PLANNING REVIEW PROCESS ARE GENERALLY ADDRESSED BY INCORPORATING MITIGATION MEASURES PURSUANT TO DEVELOPMENT OF PLANS PURSUANT TO THE SECRET REGULATION SECTION SIX 17.7 E. UM, IF THERE IS A CHANGE AS PREVIOUSLY DISCUSSED BY COUNCIL FOR SEQUELA, THE PLANNING BOARD WOULD REEVALUATE IT, WHICH IS WHY WE HAD AN AMENDED NEGATIVE DECLARATION, UM, FOR THE, UM, CHANGES RESULTING FROM WHITE PLAIN'S DECISION. AND IF THERE WAS A SUBSTANTIAL IMPACT FOUND DUE TO CIRCUMSTANCES OR ADDITIONAL CHANGES, THE PLANNING BOARD, UH, WOULD AMEND OR COULD ALTERNATIVELY RESCIND ITS ORIGINAL NEGATIVE DECLARATION. HOWEVER, IN THIS CASE, THE OUTDOOR SEATING HAS BEEN SHOWN ON THE PLAN SINCE THE ORIGINAL SUBMISSION PLANNING BOARD AND STAFF REVIEW. THE OUTDOOR SEATING PROPOSED PRIOR TO ISSUING THE NECK DECK AND AMENDED NECK DECK AND DETERMINED THAT THERE WERE NO SIGNIFICANT IMPACTS ASSOCIATED WITH THE PLANS. AND SINCE THE OUTDOOR SEATING HAS BEEN SHOWN SINCE THE ORIGINAL SUBMISSION, FINDING THAT THERE'S NO NEED TO REEVALUATE THE, UH, SECRET IMPACTS. THANK YOU. THANK YOU. I THINK INCREDIBLY WELL SAID.
