Case No. PB 18-07 Nesto’s, 24 Tarrytown Road (P.O. White Plains, N.Y.) – Final Subdivision & Amended Site Plan
A work session to discuss the decision of a final subdivision and amended site plan application involving the proposed expansion of an existing parking lot associated with an existing delicatessen. The applicant proposes to re-subdivide a portion of property consisting of approximately 2,988 sq. ft., recently purchased from the NYS DOT, in order to eliminate an interior lot line, and construct eight (8) new off-street parking spaces adjacent to an existing paved area and drive-thru associated with Nesto’s Delicatessen. The site currently provides seven (7) off-street parking spaces and six (6) queuing spaces, along with adjacent on-street parking availability. The project involves approximately 65 cubic yards of excavation. The property, in total, consists of approximately 15,285 sq. ft. (0.35 acres) and is situated on the north side of Tarrytown Road, at the intersection of Old Kensico Road and Tarrytown Road. The property is located in the DS – Designed Shopping District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.500-310-1.

Case No. PB 18-15 Paolucci-Gallousis, 135 Old Army Road (P.O. Scarsdale, N. Y.) – Preliminary Subdivision & Tree Removal Permit
A work session to discuss a preliminary subdivision and tree removal permit application involving the proposed subdivision of one (1) existing lot, approximately 52,469 sq. ft. in area, into two (2) buildable lots, for the purpose of constructing one (1) new single-family residence. Proposed Lot 1A, which contains an existing single-family residence to remain, would total approximately 26,281 sq. ft. Proposed Lot 1B would total approximately 26,188 sq. ft., and would be improved with one (1) new single-family residence. The applicant proposes the removal of five (5) regulated trees, requiring a tree removal permit through the Planning Board. The applicant has prepared a landscaping plan which includes the proposed planting of two (2) Sugar Maple trees, one (1) Eastern Redbud tree, sixteen (16) Green Giant Arborvitae trees, and ten (10) Holly plants, as replacement. The property consists of approximately 52,469 sq. ft. and is situated on the west side of Old Army Road, approximately 415 feet from the intersection of Ardsley Road and Old Army Road. The subject property is located in the R-20 One-Family Residence District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.540-370-5.

Case No. TB 19-08 Brightview-Metropolis, 289 Dobbs Ferry Road (P.O. White Plains, N. Y.) – Zoning Text and Zoning Map Amendments (Referral from Town Board)
A work session to discuss a zoning map and zoning text amendment referral from the Town Board involving a proposal to create a new floating zone district (Continuum of Care Facility - CCF) to the Town’s Zoning Ordinance and Zoning Map, and to rezone to a CCF Ditrict, an approximately 6 acre portion of Parcel ID: 8.10-1-6, 8.141-94-15,16,17 & 18 [289 Dobbs Ferry Road], for the purposes of permitting a proposal for a 160-unit independent living, assisted living and/or memory care development.

THIS ITEM IS TENTATIVELY SCHEDULED FOR A WORK SESSION, PENDING A REFERRAL FROM THE TOWN BOARD.
 
8.   ITEMS FOR PUBLIC HEARING & PUBLIC DISCUSSION
 
a.  


Case No. PB 19-16 Wang-Liu, 3 Robbin Hill Road (P.O. Scarsdale, N. Y.) – Planning Board Steep Slope Permit, and Tree Removal Permit (Town Forestry Officer approval)
A public hearing to discuss a Planning Board steep slope permit application consisting of the proposed construction of a new, approximately 2,524 sq. ft. modular home, on an existing vacant lot. The applicant proposes 3,091 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), and 949 sq. ft. of disturbances on 25-35% slopes (VERY STEEP SLOPES). The project requires approximately 300 cubic yards of excavation. The applicant proposes the removal of nine (9) regulated trees from the subject property, requiring a tree removal permit from the Town Forestry Officer. The applicant has prepared a landscaping plan which calls for the planting of: one (1) Common Hornbeam tree, one (1) Common Apple tree, two (2) Kwanzan Flowering Cherry trees, two (2) Upright White Pine trees, one (1) Sky Rocket English oak tree, and ten (10) Green Giant Arborvitae trees, as replacement. The property consists of approximately 7,072 sq. ft. (0.16 acres) and is situated on the easterly side of Robbin Hill Road at the intersection of Robbin Hill Road and Mt. Joy Avenue. The property is situated in the R-5 One-Family Residence Zoning District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.470-332-46.

Case No. PB 19-04 MacMillan, 39 Ridge Road (P.O. Hartsdale, N.Y.) – Planning Board Wetland/Watercourse Permit and Tree Removal Permit (Town Forestry Officer approval)
A continuation of a public hearing (June 19, 2019) to discuss a Planning Board wetland/watercourse permit application involving: ( 1) the proposed re-grading of the rear yard of an existing single-family residential property; (2) the proposed piping (95 linear feet of 24” rigid HDPE pipe) of an on-site intermittent watercourse channel, and the directing of it to another on-site watercourse, both located in the rear yard of the subject property, which includes the proposed construction of a 3-foot concrete headwall at the intersection of the two watercourse channels, to make the rear yard space more usable for the property owners; (3) the proposed installation of a drainage system around the existing residence, to direct roof leaders into the proposed piping in the rear yard; (4) a proposed 400 sq. ft. expansion of the existing driveway; (5) the proposed construction of a 3-foot high stone retaining wall approx. 110 linear feet in length along the southerly property line; (6) the proposed installation of a 6-foot high vinyl fence and chain link fence along portions of the south side, north side, and rear yards; (7) the removal of eight (8) regulated trees from the site; and (8) the proposed installation twenty eight (28) trees and various wetland mitigation plantings on the property. The watercourse and watercourse buffer area on the applicant’s property consists of approximately 29,759 sq. ft., and the applicant is proposing approximately 17,000 sq. ft. of disturbance. The applicant proposes 0 cubic yards of excavation, and approximately 650 cubic yards of imported fill, requiring a Fill Permit through the Town Engineer, to carry out the project. The subject properties consist of approx. 47,250 sq. ft. and are situated on the westerly side of Ridge Road, approximately 475 ft. south of the intersection of Ridge Road and W. Hartsdale Ave. The properties are situated in the R-20 One-Family Residence District, and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.190-139-4 & 5.
 
c.   Case No. PB 17-36 Zappico, Old Colony Road (P.O. Hartsdale, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, Wetland/Watercourse Permit and Tree Removal Permit (TO BE ADJOURNED)
A continuation of a public hearing (June 5, 2019 & July 2, 2019) to discuss a preliminary subdivision, steep slope permit, wetland/watercourse permit, and tree removal permit application for a proposal consisting of the subdivision of two (2) existing tax lots, in order to create four (4) zoning compliant lots, for the purposes of constructing four (4) single-family residences. Proposed Lot 1 would consist of 58,372 sq. ft. Proposed Lot 2 would consist of 23,753 sq. ft. Proposed Lot 3 would consist of 17,012 sq. ft., and proposed Lot 4 would consist of 14,973 sq. ft. The applicant proposes 20,193 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 9,058 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES) and 26,002.5 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes to disturb approximately 641 sq. ft. of the 1,236 sq. ft. of regulated watercourse area on the subject property, associated with the proposed piping of an on-site watercourse, and approximately 29,743 sq. ft. of the 46,235 sq. ft. of regulated watercourse buffer area on the subject property. The applicant proposes the removal of seventy (70) regulated trees, requiring a tree removal permit from the Planning Board. The applicant has prepared a landscaping plan which calls for the planting of four (4) Oak trees, sixteen each of (16) Blue Spruce and Norway Spruce trees, nine (9) Green Giant Arborvitae trees, eight (8) White Spruce trees, six (6) Sugar Maple trees, four (4) Eastern Redbud trees, four (4) Shagbark Hickory trees, four (4) White Oak trees, and an assortment of foundation shrubs and plants, as replacement. The properties consist of approximately 114,110 sq. ft. and are situated on the south side of Old Colony Road, opposite the intersection of Old Colony Road and Midvale Road. The properties are located in the R-10 One-Family Residence District, and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.360-259-11 & 12.
