a.   Case No. PB 19-24 Food in Technology (FIT), 1019 Central Park Avenue South (P.O. Scarsdale, N.Y.) – Special Permit (Restaurant)
A work session to discuss the decision of a special permit (restaurant) application involving the conversion of an approximately 1,550 sq. ft. vacant space (formerly Golfsmith), into a restaurant, with seating for 26 persons at a total of 18 tables. The property consists of approximately 247,856 sq. ft. (5.69 acres) and is situated on the west side of Central Park Avenue South (NYS Route 100) approximately at the intersection of Inverness Road and Central Park Avenue South. The property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.590-405-5.

Case No. TB 19-08 Brightview-Metropolis, 289 Dobbs Ferry Road (P.O. White Plains, N. Y.) – Zoning Text and Zoning Map Amendments (Referral from Town Board)
A continuation of a work session (July 17, 2019, August 7, 2019 and September 18, 2019) to discuss a zoning map and zoning text amendment referral from the Town Board involving a proposal to create a new floating zone district (Continuum of Care Facility - CCF) to the Town’s Zoning Ordinance and Zoning Map. If approved, the petitioner seeks to rezone an approximately 6 acre portion of Parcel ID: 8.10-1-6, 8.141-94-15,16,17 & 18 [289 Dobbs Ferry Road], for the purposes of permitting a proposal for a 160-unit independent living, assisted living and/or memory care development to a CCF District.
 
c.   Case No. TB 19-19 Assisted Living Facility Zoning Text Amendment, Zoning Text Amendment (Referral from Town Board)
A continuation of a work session (July 17, 2019, August 7, 2019 and September 18, 2019) to discuss a zoning text amendment referral from the Town Board involving a proposal to include additional special permit criteria associated with Convalescent homes, rest homes, nursing homes or homes for the aged approved, Continuing Care Retirement Communities, and Assisted Living Facilities, in a manner consistent with the Comprehensive Plan.

Case No. PB 18-08 Caspian Realty (Montaage Furniture Gallery), 155 Central Park Avenue North (P.O. Hartsdale, N.Y.) – Site Plan Amendment Request
A continuation of a work session (April 4, 2018) to discuss a request for an amendment to a condition of a previously issued site plan approval of the Planning Board, dated June 2002, under Case No. PB 00-08. Specifically, the applicant requests an amendment to remove a condition of the prior site plan approval which states, “No commercial vehicles shall be permitted to remain on the premises overnight.” The applicant is requesting permission to allow for one (1) commercial vehicle to be parked within the northerly portion of the premises overnight. The property consists of approximately 84,942 sq. ft. and is situated on the western side of Central Park Avenue North, approximately 120 ft. from the intersection of North Washington Avenue and Central Park Avenue. The property is located in the CA – Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID 8.210-155-3.

a.  


Case No. TB 19-22 Ferncliff Cemetery (Mausoleum Expansion), 280 Secor Road (P.O. Hartsdale, N.Y.) – Amended Site Plan (Referral from Town Board)
A work session to discuss an amended site plan application (Town Board approval – referral to Planning Board) for a project consisting of the proposed construction of a 41,373 sq. ft. mausoleum expansion (constituting an expansion of the existing second floor), to the existing 147,651 sq. ft. mausoleum, known as the “Shrine of Memories,” with related improvements, on an existing cemetery site. The project requires area variances from the Zoning Board of Appeals (ZBA 19-28). The property consists of approximately 2,765,189 sq. ft. (63.4 acres) and is situated on the north side of Secor Road, across from the intersection of Secor Road and Eastern Road. The property is located in the R-30 Residence District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.171-123-1.

a.  


Case No. PB 16-21 Loop Road Holdings, LLC, 555 Saw Mill River Road (P.O. Tarrytown N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit
A public hearing to to consider the re-approval of a preliminary subdivision application originally approved by the Town of Greenburgh Planning Board on January 4, 2018, and which expired on July 3, 2018. The applicant proposes to subdivide a 100.18 acre parcel into two (2) lots (Proposed Lot 1 – 60.01 acres and Proposed Lot 2 – 40.17 acres), and to develop a research and development campus on proposed Lot 1, consisting of nine (9) buildings, totaling 1,016,190 sq. ft. of research and development and related space, five (5) parking structures, and related improvements. The property consists of approximately 2,613,996 sq. ft. (100.18 acres) and is situated on the west side of Saw Mill River Road (NYS Rt. 9A) approximately 300 ft. from the intersection of Old Saw Mill River Road and Grasslands Road (NYS Rt. 100C). The property is located in the PED Planned Economic Development District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.71-6-2.

Case No. PB 19-03 BMR-Ardsley Park, 410-460 Saw Mill River Road (P.O. Ardsley, N. Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit & Tree Removal Permit
A public hearing to consider a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application for a proposal consisting of the subdivision of an existing campus (formerly Ciba Geigy and currently Acorda Therapeutics, Inc.) consisting of two (2) building lots, into a total of (3) three building lots, together with various site improvements, including: (1) the proposed enhancement of surface parking areas on proposed Lot 1; (2) the proposed relocation of surface parking from proposed Lot 2 to proposed Lot 1; and, (3) the addition of landscaping, sidewalks, retaining walls, and pervious pavement. The applicant proposes 156,128 sq. ft. on 15-25% slopes (STEEP SLOPES), 25,479 sq. ft. on 25-35% slopes (VERY STEEP SLOPES) and 8,537 sq. ft. on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project involves approximately 14,000 cubic yards of excavation and 0 cubic yards of imported fill. The applicant proposes the removal of thirty (30) regulated trees, requiring a tree removal permit through the Planning Board. The applicant proposes landscaping on the property, as replacement. The project requires amended site plan approval from the Town Board (TB 19-05). On September 19, 2019, the Zoning Board of Appeals granted one (1) area variance required in connection with the project. The properties consist of approximately 1,856,3161 sq. ft. (42.82 acres) and are situated on the easterly side of Saw Mill River Road approximately 1,700 ft. south of the intersection of Saw Mill River Road and Lawrence Street. The properties are located in the GI General Industrial District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8-430-305-7, 8-500-350-3 & 8-500-350-4.

Case No. PB 19-11 Mount Hope Cemetery, 50 Old Jackson Avenue (P.O. Hastings-on-Hudson, N.Y.) – Planning Board Steep Slope Permit, and Tree Removal Permit (Town Forestry Officer approval)
A public hearing to consider a Planning Board steep slope permit application for a proposal consisting of the construction of a 4,916 sq. ft. mausoleum, access road, sidewalks, and grading activities, in connection with creation of additional burial plots on an existing cemetery site. The applicant proposes 14,039 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 4,327 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES), and 3,203 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project involves approximately 20,656 cubic yards of excavation and 685 cubic yards of imported fill, requiring a Fill Permit from the Bureau of Engineering. The applicant has prepared a stormwater management plan to capture and handle runoff from new impervious surfaces. Tree removals are proposed in connection with the project, requiring a tree removal permit from the Town Forestry Officer. The applicant has prepared a landscaping plan which calls for the planting of various evergreen trees, and shrubs, as replacement. The project requires amended site plan approval from the Town Board (TB 19-10). The project requires one (1) area variance from the Zoning Board of Appeals (ZBA 19-14). The properties consist of approximately 5,330,657 sq. ft. (122.38 acres) and are situated on the north side of Jackson Avenue, approximately 34 ft. north of the intersection of Saw Mill River Road and Jackson Avenue. The properties are located in the R-30 Residential District, and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.500-351-3, 8.560-384-1, 8.560-384-3, 8.560-384-4 & 8.560-384-5.


Please be advised that, following the close of a public hearing, but during the period in which the written record period remains open, members of the public who wish to inspect the project file are encouraged to contact the Department of Community Development and Conservation, so that the complete physical file may be made available for review in its office.

If a FOIL (Freedom of Information) Request is submitted during the time period during which the written record is open, while staff will respond within the required 5-day period, it cannot be guaranteed that all documents requested, particularly those documents that are not part of the Planning Board record, will be provided prior to the closure of the written record period.
 
9.   ESTABLISH DATE FOR NEXT MEETING
The next regularly scheduled meeting of the Greenburgh Planning Board will be Wednesday, November 6, 2019 and will begin at 8:00 P.M. in the Greenburgh Town Hall Auditorium.
