a.  


Case No. PB 20-07 Cuomo, 18 Bradley Avenue (P.O. White Plains, N.Y.) – Wetland/Watercourse Permit
A work session to discuss the decision of a wetland/watercourse permit application involving the proposed construction of an approximately 574 sq. ft. single level deck to be built around an existing above ground pool, in the rear yard of the subject property. The watercourse and watercourse buffer on the applicant’s property consists of approximately 18,056 sq. ft., and the applicant is proposing approximately 574 sq. ft. of disturbance. The applicant proposes approximately 2.4 cubic yards of excavation in order to install deck footings. No imported fill is required in connection with the project. The applicant proposes a 4” bed of crushed stone under the deck to assist with stormwater infiltration. The subject property consists of approximately 23,087 sq. ft. and is situated on the north side of Bradley Avenue, at the corner of Bradley Avenue and Park Avenue West. The property is situated in the R-10 One-Family Residence District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.30-22-1

Case No. PB 19-31 Lewis Masters Holdings, LP (Shoprite), 320 Saw Mill River Road (P.O. Elmsford, N.Y.) – Planning Board Steep Slope Permit
A work session to discuss the decision of a Planning Board steep slope permit application for a project involving the proposed redevelopment of a site containing a now closed movie theater and associated retail building. The proposal includes the demolition of an existing approximately 42,000 sq. ft. multiplex cinema and separate multi-level retail building, and the construction of a new approximately 75,711 sq. ft. grocery store with an accessory interior restaurant space, together with approximately 10,765 sq. ft. of attached separate retail space, an approximately 3,000 sq. ft. retail outbuilding towards the front of the lot, and associated site grading, parking and stormwater management facilities. The applicant proposes to construct 519 off-street parking spaces where 544 spaces are required. On April 1, 2020, the Planning Board approved a shared parking reduction of 25 parking spaces. The project involves approximately 427,436 sq. ft. of disturbance, with 12,257 sq. ft. of proposed disturbance on 15-25% slopes (STEEP SLOPES), 4,725 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES), and 6,317 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 37,000 cubic yards of excavation and 0 cubic yards of imported fill. The applicant proposes the removal of 218 regulated trees, requiring a tree removal permit from the Town Forestry Officer. The applicant proposes the planting of 170 trees, 393 shrubs and grasses, and various groundcovers and perennial plants, as replacement. On May 13, 2020, the Town Board adopted a resolution approving the site plan application (TB 19-03). The project also requires a special permit (restaurant) from the Zoning Board of Appeals. The property consists of approximately 458,437 sq. ft. and is situated on the northeast corner of Saw Mill River Road and Old Country Road. The applicant proposes to reconfigure the existing signaled intersection at Saw Mill River Road and construct a new driveway along Old Country Road. The property is located in the DS – Designed Shopping District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.120-19-25.

Case No. TB 20-03/PB 20-06 GHP Taxter LLC, 555-565 Taxter Road (P.O. Elmsford, N.Y.) – Amended Site Plan (Town Board Referral), Planning Board Steep Slope Permit, and Wetland/Watercourse Permit
A continuation of a work session (May 6, 2020) to discuss an amended site plan (Town Board approval – referral to Planning Board), Planning Board steep slope permit and wetland/watercourse permit application for a project consisting of the proposed construction of 108 parking spaces on the subject site, over two existing stormwater detention areas. New subsurface stormwater detention facilities are proposed to be constructed under the proposed parking to replicate existing conditions. The additional parking is required to facilitate the change of a portion of the tenant space to medical office. The medical office conversion would result in 1,227 parking spaces required, where 1,126 exist. The applicant is proposing 108 additional spaces, which will result in a total of 1,234 spaces. The applicant is proposing to land bank the 108 proposed spaces, and only would be developed should the demand be realized. The applicant proposes approximately 5,663 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), 4,356 sq. ft. of disturbance to 25-35% slopes (VERY STEEP SLOPES), and 27,097 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 17,000 cubic yards of imported fill. The project requires disturbance to the existing on-site drainage basins which necessitates a wetland/watercourse permit. The applicant proposes the removal of up to 17 regulated trees, requiring a tree removal permit from the Town Forestry Officer. The applicant proposes to replace all trees ultimately removed, at a 1:1 ratio. The project also requires area variances from the Zoning Board of Appeals. The property consist of approximately 747,933 sq. ft. (17.17 acres) and is situated on the west side of Taxter Road, south of the intersection of Taxter Road and West Main Street. The property is located in the OB Office Business District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.240-103-1..L5.

Case No. TB 20-05 Chapter 285 – Telecommunications Local Law – Zoning Text Amendment (Referral from Town Board)
A work session to discuss a referral from the Town Board associated with a proposed zoning text amendment to Section 285-37 of the Zoning Ordinance entitled, “Antennas,” to address, and comply with, applicable federal legislation, including establishing requirements for the deployment of small wireless facilities in the Town of Greenburgh.
 
b.   Case No. PB 19-27 Manhattan Avenue Senior, LLC, 48-58 Manhattan Avenue (P.O. White Plains, N.Y.) – Site Plan, Planning Board Wetland/Watercourse Permit, and Tree Removal Permit (Town Forestry Officer approval)
A work session (pre-submission conference held on October 2, 2019) to discuss a site plan and Planning Board wetland/watercourse permit application consisting of the proposed demolition of six (6) on-site, single-story buildings containing a total of thirty (30) senior affordable housing units, and the construction of one (1) new, three (3) story multi-family dwelling containing seventy (70) units of senior affordable housing, together with forty-four (44) off-street parking spaces, related infrastructure, and other amenities. Access to the site will be provided from the existing curb cut on Manhattan Avenue which will be widened and improved. A gated, emergency access drive will be provided, north of the existing curb cut. The applicant proposes approximately 49,703 sq. ft. of wetland/watercourse buffer disturbance within the 49,703 sq. ft. of wetland, watercourse and adjacent buffer area on the subject property. The applicant proposes the removal of 34 regulated trees, requiring a tree removal permit from the Town Forestry Officer. The applicant also is seeking approval from the Town Board to permit an increase in the height of the proposed building, from 2½ stories, 30 feet (permitted) to 3 stories, 46 feet (proposed), as permitted under Section 285-22.1(C)(7) of the zoning ordinance (TB 20-06). The property consists of approximately 113,839 sq. ft. (2.61 acres) and is situated on the west side of Manhattan Avenue, across from the intersection of Manhattan Avenue and Florence Avenue. The property is situated in the M-SH-62 Multifamily Senior Housing District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.410-228-9.

Case No. PB 20-08 Greystone-on-Hudson PUD, Carriage Trail (P.O. Tarrytown, N.Y.) – Planning Board Site Plan and Steep Slope Permit
A work session to discuss a Planning Board site plan and steep slope permit application for a proposal consisting of the buildout of a residential development site with a total of ten (10) primary residences and fourteen (14) accessory residences. The applicant previously petitioned for and was granted a zoning change to a Planned Unit Development (PUD) District, allowing for multiple dwellings on a single lot (Case No. TB 19-02). The applicant previously received a Planning Board steep slope permit in connection with prior subdivision approval (Case No. PB 11-13). As part of the updated buildout of the site, the applicant proposes approximately 10,000 sq. ft. of additional regulated steep slope disturbance to Lot 11, associated with the reorientation of the driveway layout. The properties consist of approximately 2,463,675 sq. ft. (56.6 acres) and are situated on the east side of Broadway (NYS Rt. 9). The properties are located in the PUD Planned Unit Development District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 7.290-141-9.1, 7.290-141-9.2, 7.290-141-9.3, 7.290-141-9.4, 7.290-141-9.5, 7.290-141-9.6, 7.300-142-3.7, 7.300-142-3.8, 7.300-142-3.9, 7.300-142-3.10, 7.300-142-3.11, and 7.300-142-3.12.

Case No. PB 16-04 DJF Real Estate, 23-25 Warehouse Lane (P.O. Elmsford, N.Y.) –Site Plan, Planning Board Steep Slope Permit, Wetland Watercourse Permit, and Tree Removal Permit (Town Forestry Officer approval)
A public hearing to discuss a site plan, Planning Board steep slope, wetland/watercourse and tree removal permit application (Town Forestry Officer approval) for a proposal consisting of the demolition of two (2) existing commercial buildings and the construction of one (1) new, three-story 19,200 sq. ft. multi-use automotive and truck repair facility, with related site improvements. The applicant proposes forty-four (44) parking spaces, nineteen (19) light duty and automotive truck repair staging locations, and four (4) heavy duty truck bays, for a total of sixty (67) spaces. The applicant proposes 1,800 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes 19,930 sq. ft. of disturbance within the 23,285 sq. ft. of regulated watercourse and watercourse buffer area on the project site. The project involves approximately 4,013 cubic yards of cut and approximately 1,500 cubic yards of imported fill, requiring a fill permit from the Bureau of Engineering. The project also requires a floodplain development permit from the Town Engineer. The applicant proposes the removal of twenty-nine (29) trees, requiring a tree removal permit from the Town Forestry Officer. On October 17, 2019, the Zoning Board of Appeals granted area variances required in connection with the project. The property consists of approximately 76,837 sq. ft. (1.76 acres) and is situated on the south side of Warehouse Lane approximately 389 feet from the intersection of Saw Mill River Road. The property is located in the LI Light Industrial District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.180-52-17 & 7.180-52-18.
